1985-68 Reversing The Decision Of The Planning And Zoning Commission With Regard To The Preliminary Approval Of The Lake Side Subdivision, First Addition.KODIAK ISLAND BOROUGH
RESOLUTION NO. 85-68-R
A RESOLUTION OF THE KODIAK ISLAND BOROUGH REVERSING THE DECISION OF
PLANNING AND ZONING COMMISSION WITH REGARD TO THE PRELIMINARY APPROVAL OF
LAKESIDE SUBDIVISION, FIRST ADDITION.
WHEREAS, the Kodiak Island Borough Planning and Zoning Commission
its regular meeting on Wednesday night, April 17, 1985 held a public
and subsequently voted four to three to deny preliminary approval
the Lakeside Subdivision, First Addition, northwest of Selief Lane and
Lake Drive (Case Number 5-85-012), and
WHEREAS, Kodiak Island Borough Code Chapter 16.32 provides for an
process in subdivision cases, and
WHEREAS, the Kodiak Island Borough has the right to appeal the
both as the applicant and as a governmental agency and did file an
, and
WHEREAS, the appeal hearing was held on July 2, 1985 in accordance
the Kodiak Island Borough Code.
NOW, THEREFORE, BE IT RESOLVED, that the Kodiak Island Borough
reverses the decision of the Planning and Zoning Commission for the
following reasons:
1. The proposed residential lots are buffered by ample greenbelts from
the industrial lots, eliminating any potential land use conflicts;
2. Of all of the property owned by the Kodiak Island Borough that could
be developed for residential lots this is the most desirable land
and the infrastructure of roads and utilities are being provided
with the Selief Lane construction making this land available for
residential development in 1986.
3. The Kodiak Island Borough has provided large areas for parks within
the subdivision which is ample park land for the area;
4. Increased residential traffic on Selief Lane should be relieved by
the intersection into Mill Bay Road;
5. Adverse public testimony at the recent public hearing and previous
public hearings indicates that adjacent residents do not want this
area developed but the greater good of the entire 13,000 borough
residents dictates that good land management, including utilization
of existing infrastructure, should occur prior to large expenditures
in undeveloped areas. Therefore, this area should be developed and
made available to the public at this time.
BE IT FURTHER RESOLVED that the preliminary subdivision of Lakeside
First Addition is approved.
