RESOLUTION NO. 85-64-R
A RESOLUTION OF THE KODIAK ISLAND BOROUGH ASSEMBLY AUTHORIZING THE
BOROUGH MANAGER TO BORROW MONEY FROM THE U.S. ENVIRONMENTAL PROTECTION AGENCY
ON BEHALF OF THE KODIAK ISLAND BOROUGH.
WHEREAS, Kodiak Island Borough is a local educational agency
(hereinafter, "LEA") within the meaning of the Asbestos School Hazard Abate-
ment Act of 1984, 10 U.S.C. 4011, et seq., (hereinafter, the "Act); and
WHEREAS, Borough Manager (hereinafter, the "representative") is
authorized to borrow money on behalf of the LEA and in connection therewith
to make, execute, endorse and deliver any notes, drafts, acceptances, agree-
ments or any other obligations of the LEA as may be necessary or required in
connection therewith; and
WHEREAS, the representative has entered into a loan agreement with
the United States Environmental Protection Agency (hereinafter, "EPA) for
funds to undertake an asbestos abatement project;
NOW, THEREFORE, BE IT RESOLVED by the Kodiak Island Borough Assembly
that the loan agreement and promissory note and other documents or instruments
relating to said agreement or note (hereinafter, collectively, the "Agreement")
executed by the representative with the EPA are authorized and confirmed, and
are valid and binding on the LEA in accordance with their terms; and
NOW, THEREFORE, BE IT FURTHER RESOLVED, that the foregoing resolution,
shall remain in effect until all terms and conditions of the Agreement are met.
