A RESOLUTION OF THE KODIAK ISLAND BOROUGH ASSEMBLY REVERSING THE
DECISION OF THE PLANNING AND ZONING COMMISSION ON CASE 84 -054 DENYING A
REQUEST FOR AN EXCEPTION FROM SECTION 17.17.020 (PERMITTED USES) OF THE
I BOROUGH CODE TO ALLOW THE EXCAVATION OF ROCK AND GRAVEL FROM A RURAL
1 RESIDENTIAL LOT. LOT 9A, BLOCK 4, MONASHKA BAY ALASKA SUBDIVISION; 2660
OTMELOI POINT ROAD; REQUESTED BY MR. ERIC GOOSSEN,
WHEREAS, the Kodiak Island Borough Planning and Zoning Commission,
at their April 18, 1984 meeting, denied a request for an exception from
Section 17.17.080 (Permitted Uses) of the Borough Code to allow the excavation
of rock and gravel from a rural residential lot. Lot 9A, Block 4, Monashka
Bay Alaska Subdivision (2660 Otmeloi Point Road) requested by Mr. Eric
Goossen; and
WHEREAS, Mr. Goossen has appealed the decision of the Planning and
Zoning Commission to the Borough Assembly; and
WHEREAS, the Borough Assembly has considered the appeal record and
other written and oral testimony relevant to the appeal.
NOW, THEREFORE, BE IT RESOLVED that the Kodiak Island Borough
Assembly hereby reverses the decision of the Planning and Zoning Commission
for the following reasons:
1. The removal of some rock and gravel is implicitly allowed by the Borough
Code, if the extraction is related to site preparation for a permitted
use in the zoning district; and
The removal of rock and gravel as proposed in the development plan for
this lot is generally related to site preparation for a permitted use;
and
NOW, THEREFORE, BE IT FURTHER RESOLVED that the Kodiak Island
Borough Assembly grants an exception to Mr. Eric Goossen to remove 8,000 cubic
yards of rock and gravel from Lot 9A, Block 4 Monashka Bay Alaska Subdivision

, in order to provide adequate access to his building site, an area for a
building site, and an area for a properly functioning septic system. The
available topsoil will be used to cover the area around the building,
