1984-63 Reversing An Interpretation Of The Planning And Zoning Commission Regarding Sand, Gravel, And Rock Extraction.J 1 KODIAK ISLAND BOROUGH RESOLUTION NO. 84 - 63 -R A RESOLUTION OF THE KODIAK ISLAND BOROUGH ASSEMBLY REVERSING AN INTERPRETATION OF THE PLANNING AND ZONING COMMISSION REGARDING SAND, GRAVEL, AND ROCK EXTRACTION. WHEREAS, the Kodiak Island Borough Planning and Zoning Commission at their April 18, 1984 meeting made the following motion... "that any extracting of sand, gravel, and rock from other than industrial areas requires an exception from the Planning and Zoning Commission;" and WHEREAS, this interpretation of Borough Code has been appealed to the Kodiak Island Borough Assembly; and WHEREAS, the Kodiak Island Borough Assembly has confirmed the appointment of an ad hoc task force to address this issue; and WHEREAS, the Borough has obtained attorney's opinions on several aspects of this issue as well as reviewing the appeal record, information from the "gravel extraction task force," and public testimony. NOW, THEREFORE, BE IT RESOLVED that the Kodiak Island Borough Assembly hereby reverses the decision of the Planning and Zoning Commission for the following reasons: Some site preparation including, sand, gravel, and rock extraction is required for the development of virtually every lot in the Kodiak Island Borough; Z Sand, gravel, and rock extraction which is required for site development of a use permitted in a zoning district is implicitly allowed in the Borough Code; 3 Current regulations are adequate to protect neighbors and the community against excessive sand, gravel, and rock extraction in residential and commercial areas; and ' 4. The exception process places on undue burden on a private developer if he meets all the other requirements of the Borough.
