1984-53 Adopting A Grievance Procedure In Regard To Federal Revenue Sharing Funds.1 KODIAK ISLAND BOROUGH RESOLUTION NO. 84 -53 -R A RESOLUTION OF THE KODIAK ISLAND BOROUGH ADOPTING A :RIEVANCE PROCEDURE IN REGARD TO FEDERAL REVENUE SHARING FUNDS. WHEREAS, the federal Office of Revenue Sharing IRS) by Section 504 regulations (31 C.F.R. 51.55 [d] [2]) requires a reci•'ent government to have a grievance procedure in place; and WHEREAS, the following procedures are tended and felt to satisfy that requirement. A complaint should be filed in writing or verbally, contain the name and ' address of the person filing it, and briefly describe the alleged violation of the regulations. the following i 2. A complaint should be filed within thirty (30) days after the complainant becomes aware of the alleged violation. 3. An investigation, as may be appropriate, shall follow a filing of a complaint. The investigation will be - - -� -�� will be conducted by the Borough Manager. These rules contemplate informal but thorough investigations, affording all inter - ested person and their representative, if any, an opportunity to submit evidence relevant to a complaint. Under 31 C.F.R. 51.55 (d)(2), the Kodiak Island Borough need not process complaints from applicants for employment or from applicants for admission to post- secondary educational institutions. 1 1 4. A written determination as to the validity of the complaint and descrip- tion of resolution, if any, shall be issued by the Borough Manager and a copy forwarded to the complainant no later than fifteen (15) days after its filin 5. The section 504 coordinator shall maintain the files and records of the Kodiak Island Borough relating to the complaints filed. ' 6. The complainant can request a reconsideration of the/case in instances where he or she is dissatisfied with the resolution. / The request for reconsideration should be made within fifteen (15) dKays to the Kodiak Island Borough Manager. 7. The right of a person to a prompt and equjtable resolution of the com- plaint filed hereunder shall not be impaired/by the person 5 pursuit of other remedies such as the filing of a Section/04 complaint with the Office of Revenue Sharing, U.S. Department of the/Treasury. Utilization of this griev- ance procedure is not a prerequisit to the pursuit of other remedies. 8. These rules shall be constr d to protect the substantive rights of interested person, to meet app opriate due process standards and to assure that the Kodiak Island Bororgh complies with Section 504 and the ORS regulations.
