A RESOLUTION OF THE KODIAK ISLAND BOROUGH ASSEMBLY CORRECTING
!RESOLUTION NO. 83 -133 -R PERTAINING TO A BOARD OF ADJUSTMENT DECISION GRANTING
11682 ;PRELIMINARY APPROVAL TO THE SUBDIVISION OF TRACTS "8" AND "D" OF U.S. SURVEY
INTO WOODLAND ACRES SUBDIVISION, THIRD ADDITION.
I WHEREAS, Timothy Hurley, Timothy Hill and John Rauwolf submitted
'a preliminary plat for subdivision of Tract "B" and Tract "0 ", USS IjWoodland Acres, Third Addition, to the Planning and Zoning Commission8on,nto
'July 21, 1983, and

( WHEREAS, the Planning and Zoning Commission conducted an advertised
land noticed public hearing at its August 17, 1983 regular meeting and granted
;preliminary approval of the subdivision subject to sixteen conditions, and
WHEREAS, Timothy Hill appealed the Planning and Zoning Commission
';decision on August 24, 1983 requesting relief from condition #7 (roadway
access to Mission Road), and
WHEREAS, the Kodiak Island Borough Assembly, seated as a Board of
Adjustment at its November 9, 1983 regular meeting conducted an advertised
'and noticed public hearing on the appeal request, and
WHEREAS, the Board of Adjustment reversed the Planning and Zoning
,Commission's recommendation regarding condition #7 (roadway access to Mission
Road) but did not reverse the Planning and Zoning Commission's preliminary
approval of the Woodland Acres, Third Addition, Subdivision as erroneously
!indicated in Resolution No. 83- 133 -R.
NOW, THEREFORE, BE IT RESOLVED by the Kodiak Island Borough Assembly
that this resolution is to clarify Resolution No. 83 -133 -R to indicate that the '
! jBoard of Adjustment confirmed a decision of the Planning and Zoning Commission
;:which granted preliminary approval to the subdivision of Tracts "8" and "D ",
I S. Survey 1682 into Woodland Acres Subdivision, Third Addition with the
'exception of condition #7 which was deemed inappropriate for the following
t reasons:
