A RESOLUTION OF THE KODIAK ISLAND BOROUGH ASSEMBLY A:T -.R-
IZING A FIFTEEN ACRE PARCEL OF LAND FOR A COMPETITIVE FIVE ;5) YEAR
LEASE.
WHEREAS, the Kodiak Island Borough Assembly has determined
a fifteen acre parcel of land fronting on Otmeloi Point within the
'City of Kodiak Sanitary Fill Land Site Survey to be surplus to the
Borough needs during the next five years; and
WHEREAS, lands within the parcel are zoned conservation;
and,
WHEREAS, it is requested the parcel be offered for lease.
NOW, THEREFORE, BE IT RESOLVED by the Kodiak Island Sorcu,^,
Assembly that the following described parcel be offered for a five
year lease:
A parcel of land located within the City of Kodiak Sanitary
Fill Site Survey, Plat #69 -10 filed in the Kodiak Recording District
December 12, 1969, described as follows:
Beginning at Corner #3 of U. S. Survey 3945; thence
N34 ° 39'00 "W 394.46 feet to a point; thence N43 ° 25'09 "E
1535.85 feet to a point; thence S ° 35' 59 "E 635.71 feet to
a point of intersection with the Otmelol Point Road right-
of-way; thence S ° 3 4 '51 "E approximately 1242 feet along
the said highway right -of -way to the northeasterly boundary
of U. S. Survey 3945; thence N3 ° 39'00 "W along the
northeasterly boundary of U. S. Survey 3945 103.40 feet to
Corner #3 of U. S. Survey 3945, the point of beginning.
Containing 14.99 acres more or less.
SE IT FURTHER RESOLVED the Borough Manager prepare a public
offering to lease the above described parcel under the provisions
6f Title 18 of the Kodiak Island Borough Code of Ordinances with
phe following special conditions:

2. The Lessee will provide a boundary survey for the
parcel with survey monuments at all angle points and
a well marked boundary line between each mon•unent to
assure the Lessee of the leased limits. The boundary
survey and line clearing shall be completed within 60
days of signing the lease agreement.
3. There is to be a 100 foot buffer zone inside and
contiguous to the leased exterior boundary in which no
clearing, tree cutting, or other use is to be allowed.
An exception to this is the access road and cleared
areas as existing on July 1, 1981.
4. If the owner of the improvements is not the high
bidder at auction the successful bidder will be
required as a condition of the lease to purchase the
improvements from the owner at appraised price as
established August 27, 19b1.
5. No land clearing, filling, or leveling costs incurred
by the Lessee shall be reimbursed by the Borough, but
such benefits to the land will inure to the Borough at
the expiration or termination of the lease.
6. The minimum rental rate shall be 10 percent of the
appraised value as determined by the Borough Assessor.
Rental payments shall be paid monthly based on the
annual rent bid divided into twelve equal payments.
