1985-11 Amending General Provisions•
AN ORDINANCE OF THE KODIAK ISLAND BOROUGH ASSEMBLY AMENDING CHAPTER
17.03, GENERAL PROVISIONS AND USE REGULATION, OF THE BOROUGH CODE.
The Kodiak Island Borough Hereby Ordains:
Section 1: That Section 17.03.060, Building Permits, is hereby amended:
17.03.060 Building Permits Zoning Compliance. A building permit Zoning
compliance is required for the site grading (excavation and fill), erection,
1 construction, establishment, moving, alteration, enlargement, repair, or
conversion of any building or structure in any district established by this
title, subject to the following:
A. Grading (as defined in Chapter 70 of the Uniform Building Code),
exclusive of grading as excepted in Section 7003 of Chapter 70 of the UBC, in
a residential or conservation district requires an exception from the Planning
and Zoning Commission.
AT B. An application for a building permit zoning compliance will be
filed with the building effieie* Community Development Department end on a
form approved - - hire provided by the department. If the application meets the
requirements of this title, as verified by the aening effieer department, and
other applicable regulations, the a permit will be issued.
BT C. In all cases where the planning commission or the board of adjust-
ment has granted a variance or an exception to this title, the hal ding
effie#ei department will issue a building permit zoning compliance to allow
the building work to be done in accordance with the decision, except that no
permit will be issued following the granting of a variance or exception until
the time for filing an appeal has expired and it is verified that no appeal
has been filed.
GT D. No building permit shall be issued by a building official until
the teeing effieer Community Development Department has verified from the
application for a building permit zoning compliance for a proposed building
that it conforms and will be occupied for a use in conformity with the
provisions and regulations of this title, except that this provision shall not
apply to building permits for residential structures when no yard or height
changes are involved. Any building permit issued in conflict within this

Section 2: That this ordinance shall be in full force and effect upon
passage.

The Kodiak Island Borough Hereby Ordains:
