ORDINANCE NO. 85-7-0
AN ORDINANCE OF THE KODIAK ISLAND BOROUGH ASSEMBLY AMENDING CHAPTER
18.50 O~ ~UROUGR CODE TO CHANGE SPECIAL LAND USE FEE STRUCTURE.
The ~odiak Island Borough Assembly Hereby Ordains:
SECTION 1: That Chapter 18.50, Fees, is amended to change Section
18.50.030.B., as follows:
18.50.030 Special Land Use Permits. The Assembly may approve, by
resolution, special land use permits for those instances where privately owned
residences are located on Borough land. Special land use permits shall be
considered on a case-by-case basis. The following terms and conditions shall
apply:
A. Application. Application for a special land use permit shall be
made on a form provided by the Community Development Department.

meaeh? Annual minimum rental or fee shall be computed under the terms and
conditions set forth in Kodiak Island Borough Title 18.40.050, 18.40.070, and
18.40.080.
C. Term. Special land use permits shall be issued for a one (1)
year term which may be renewable. A permit shall automatically expire on the
date of a land sale involving the land occupied.
D. Assignment. Special land user permits shall not be assignable
without the prior written permission of the Borough.
E. Residence. A residential structure must be present on the land
involved which is occupied by the person or persons requesting the special
land use permit. No construction of new buildings shall be permitted. No
permit shall be issued for vacant land.
SECTION 2: This ordinance shall be in full force and effect upon passage and
adoption.
