carried 4 - 1 with . rs. Kavanaugh castin: one NO vote.

ilr. Jack was advised that the borough attorney stated he should
withdrawf from discussion and voting on items of old business
according to State law.
At. Estes moved that the motion and decision that was made on this
case on June 16, 1977 stand. Seconded. by sir. Peterson. _lotion
failed 3 - 1 with Mrs. Kavanaugh casting. one NO vote and Mr. Jack
abstaining. Iir. testes novA to reconsider the previous motion.

Mr. Estes moved that the assessors° valu .a on show an. irregular
modification -20% for items deposited on from of property in lieu of

The Chair noted that - sir. Jack will abstain from participation and

felt that any place in Kodiak that provided a elace to live that

Mr. Peterson read correspondence from Mr. Haney and the appeal.
Hrs. Hall feels 15 20% of property has been lost by erosion at the
waterline. Mr. Jack moved that Lot 13E, USS 3100 be assessed as

Hrs. Kavanaugh moved that the assessor ;s valuation stand On Lot 1.
USS 3101. Seconded Ly Ir. Estes. Area has been reduced from 54,450
square foot to 37,950 square feet for a road right -of -way.. :lotion
carried 4 - 0 with lr . Jack abstaining,;.

Mr. Jack read correspondence from :Ir. Haney and the appeal.
There is an extremely steep .. gradient ,. from the oral down to the house,
a great deal of alnd.has been lost,by erosion.. Mr. Estes moved that

Hr. Jack read correspondence from Mr, Haney and the appeal.
Mr. Okey Chandler acting as agent, stated that much of the lot has
been lost by erosion, approximately 15 to 20 %. Mr. Estes. because
of the size of the lot moved to adjust the tax valuation to E5 pe'
square foot with +20% for view. Seconded by 1Ir. Peterson. Ir. Ja
stated there isa distinct loss and undercut from erosion. Mr. Pete
amended the motion by adding -5% for topography. Seconded by `?r
Estes. Ir. Haney stated that the owner has not made a statement
about losing land. .lr. Jack amended the amended motion to add -20%
for "other" (potential loss of land). 'lotion died for lack of second.
The amended motion carried by unanimous roll call vote. lain motion

Case No. 10, Henry Houet, Lot 25, USS 3101.
Mr. Haney read the assessor's correspondence and the appeal. `ors.
Wallin pointed out that an appeal cannot be based on an outside area.
This lot has a swamp in the middle. 'ir. Estes moved that the
topography be changed to -20 %, irregular modification to -20 %,
view +20 %, drainage -10 %to be assessed at 500 per square foot. Secon
by ;lr. Jack. Motion carried by unanimous roll call vote.
