CALL TO ORDER
The continuation of the May 3, 1977 Board of Equalization Meeting
was calle d to order by Presiding Officer, James Peotter at 7:30 pm
in the meeting room of the Borough Building.
Legal opinion on the Powers of the Board of Equalization from Michael
W. Sharon, Borough Attorney was read by Betty Wallin.
II APPEALS DECISIONS
Case n. 1 Donald W. Peterson, Special Use Permit located in
Zacher Bay.
Dr. Emmick moved that because of the remote site of the property, the
inaccessibility of the property and the short time that they used
the property, and the age of the property, being 4 or 5 years old,
on the depreciation schduele the buildings should be at $1,845.00
and the permit remain the same $1,000.00 for an adjusted total of
$2,845.00. Motion was seconded by Sandra Kavanaugh. Motion carried
5 -1 with Mr. Peterson casting a NO vote.
Case no. 2 Mr. Paul Stover, Lot 2, USS 3104
Murl Estes moved that the assessment as is. Motion was seconded and
carried 4 -2. NO votes being cast by Betty Wallin and Frank Peterson
Case n. 3 Lot 9, Southeast Addn., Mary Gallagher
Motion was made by Sandra Kavanaugh that the assessment stand. Motion
seconded and carried 4 -2. Betty Wallin and Frank Peterson casting
NO votes.
Betty Wallin made a motion that those taxpayers that have not appeal-
ed notice of the assessment which they feel to be excessive which also
instructs the land owners not heretofore appearing before the Board
that we give them thirty (30) days from the date of mailing from which
to appeal to the board. Seconded by Mr. Peterson.
After discussion by the Board of Equalization Mrs. Wallin amended her
motion to read the same with the designation that the extension be
given to the Spruce Cape area from the end of cutoff road out to the
Loran Station on both sides of that road. The thirty (30) days to
be based on the date of mailing from the Assessing Department of
May 9, 1977. Motion was seconded by Mr. Peterson. Motion passed by
unanimous roll call vote.
Dr. Emmick moved that decision on the remaining cases be defered un-
til after the 30 day extension. Seconded and passed by unanimous
roll call vote.
COMMENTS:
Okey Chandler: Stated that there has been a gross exageration of the
true price pertaining to the lots in the Spruce Cape Area. Expressed
a wish for someone from the Board to come out and look at the lots
in question.
Edward Jack: Stated that he felt there had been inequities in assessment
in that the whole Kodiak Island Borough had not been raised,accord-
ing to a study made. Also asked that a close scrutiny of all proper-
ties in the Borough be made.
o Hajdu: Mrs. Hajdu stated that the reason she didn't appeal her
ssessment is because it did seem to be in the range of fair market
alue. However, she stated that at the time she was not aware that
the Spruce Cape area had been raised twice in a row.
Louis Lindsey: Expressed gratitude to Mr. Chandler for information
concerning the inequities of assessment.
Anthony Perez: Stated that one reason he didn't appeal assessment
was the fact that to go before the Baord of Equalization he
would have the State Law staring him in the face. Stated that Spruce
Cape has had a steady climb in assessment each year since 1973. Said
that there had been a 100% increase in Spruce Cape in 1977; and he
would like to see a 100% increase of assessment throughout the borough.

T.T. Jackson: Stated that he wished to add his support to every-
thing stated before him. Suggested that a study of all assessments
throughout the Borough be made for a fair and equitable assessment.
BOARD COMMENTS:
Sandra Kavanaugh: Stated that next year she hoped that there would
be people other that Borough Assembly sitting at the Board of Equal-
ization.
Dr. Emmick: Stated he didn't particulary like the job of sitting
on the B.O.E. but he feels like it should be taken in consideration
that the Assessor and his assistants are human. Said that the Borough
Assessing procedures did not lend itself to assessing every year as
we would perhaps like it-to be. However the same thing exist in the
Federal tax structure. The concern of the citizen does help to bring
about the necessary changes. Wanted everyone to know that everything
possible was being done to help the Assessor's office streamline his
operations and make it possible to deal with people problems instead
of having to sit and push out the answer on a calculator. Wanted the
people to know that the Board was aware of the problems and hopefully
next January 1st we could push a button and come out with the numbers
that will be the assessment roll for everyone in the Borough. Maybe
in this way everyone would be able to pay their fair share of taxes.
Betty Wallin: Wanted it known that when she made her motion she had
wanted to include the entire Kodiak Island Brough, but in no way
could in order to get the budget completed. Said she had been assured
that the whole K.I.B. will be looked at quite closely by the next
tax roll. Mrs. Wallin stated that she was aware that property values
were going up in all areas. She said that it was a very uncomfortable
position to sit on the BOE, but is a position that has been forced
on the Assembly for several years in Kodiak and all over. She stated
hat it was a responsibility that should be accepted with the office.
rank Peterson: Said that he felt that there had been a misunderstanding
regarding true value versus fair market value. He asked that Mr. Haney
eloborate on the difference. Also, posed the question as to why the
property in the Borough was assessed piecemeal instead of all at once.
Mr. Haney: In answer to Mr. Peterson's questions explained that True
value is a thing of the mind; depending on a person status as owner,
seller or buyer. That Fair Market Value was the price brought on the
market today under the prevailing conditions between a willing seller
and a willing buyer.
In answer to the second question, Law says through various court de-
cisions, that the very legal way to do a complete assessment was once
per year on all properties. That the only way this can be done was
with a computor.
Mr. Peotter: Said that he was sure the entire board wished every-
thing to be assessed at 100% true market value and that we are all
striving to reach that goal. Said that everyone agreed that it was
a difficult task.
