1997-04-07 Regular Meeting WOMEN'S BAY SERVICE AREA BOARD REGULAR l\1EETING APRIL 7, 1997 CALL TO ORDER The meeting was called to order by Chair, Dave Conrad at 7:32 p.m. on April 7, 1997 in the Women's Bay Firehall. Motion passed with a unanimous voice vote. The minutes of March 3, 1997, were approved as written. Motion passed with a unanimous voice vote. CITIZENS COMMENTS Citizens will be able to comment as each agenda item is brought up. OLD BUSINESS FIRE DISTRICT Helmet Purchase Dave Conrad reported that a dozen helmets had been ordered and received. 1 Women's Bay Service Area Board Minutes, April 7, 1997 Page Two P.A.S.S. Devises There is a new variety ofP.A.S.S devises that goes right on the Scott Air Packs. The fire district is looking to purchasing 4 units. Price quotes have been received from two places and they are still looking for a price quote from one more place. Lab Safety listed at $641/per unit and Vallen Safety listed at $550/per unit. Grant Submission A grant was submitted to the Department of Division Forestry the results will not be known until the middle of May. ROAD SERVICE Kodiak Transfer The question on the first responder issue has been answered. The Borough passed Ordinance 97-03 creating a Service Area to be known as Kodiak Island Borough Airport Fire Protection District for the purpose of providing fire protection within the Service Area. Kalsin Drive Drainage This is an upcoming project that deals with a drainage problem which will be diverted to drain towards U gak Drive. South Russian Creek Road Drainage This project has been completed. U gak Drainage This issue deals with a resident who did non-permitted excavation and filling in a right of way. After several attempts to get the resident to solve the problem the KIB Engineering/Facilities Department sent a letter giving the resident sixty (60) days to resolve the issue, if no action is taken the Service District will be instructed to remove the culvert and the costs that are incurred will be billed to the resident. 2 Women's Bay Service Are Board Minutes, April 7, 1997 Page Three Bells Flats Road (Bundy Driveway) A driveway permit and plan were submitted on November 15, 1996, the driveway construction proceeded however it had not proceeded according to the permit plan. KEA had contacted the Borough to get a permit to put electricity on the lot. There was a discussion on April 15, 1996 regarding a culvert that had been installed. This culvert is causing a drainage problem on Bells Flats Road. A letter was issued on March 27, 1997 to the resident stating that until the driveway is put back the way the plan was submitted there will be no permit issued to KEA for electricity. If this problem is not solved within sixty (60) days of receipt ofletter the Service District will be instructed to perform any repairs or remove any obstruction that is causing the drainage problem on that road. Dave Conrad said that he spoke with A-K construction and because of the nature of these particular workorders that are issued they will respond in a timely manner. Russian River Estates The residents of this subdivision have two options to choose from: 1) They can form a special service district to pay for the upgrade of their roads or 2) the Service District can annex the subdivision and agree to accept the costs to upgrade the roads and drainage in that area. A meeting with the residents of the subdivision will have to take place to discuss this. The Service District will need to make a recommendation to the Borough Assembly. The decision will need to be made by July 1997 so it can go on the ballot for the next election. Dave Conrad will contact the Borough on this issue. NEW BUSINESS FIRE DISTRICT P.A.S.S. Devices Dave Conrad asked the board if they would like to vote now on the potential purchase of the P.A.S.S. devises. George Lee moved to approve the purchase of four (4) P.A.S.S. devises. Linda Hinson seconded. Motion passed with a unanimous voice vote. 3 Women's Bay Service Area Board Minutes, April 7, 1997 Page Four ROAD SERVICE KEA Project South Russian Creek Road This issue deals with KEA proceeding with the underground cable replacement from Noch Drive back to South Russian Creek Road. One section of conduit has already been replaced where the drainage project on South Russian Creek Road was done. Ed Gondek will contact the property owner about a drainage easement across their property. KEA Project Lake Orbin Drive KEA will be replacing the direct buried cable on the left hand side of Lake Orbin going up toward Women's Bay Drive. A permit hasn't been received yet as of this time. This will make it possible to do ditching on the road. K.I.B. Ordinance #97-07 Service Exemption Dave Conrad explained to the Board that Ordinance #97-07 was introduced at the Kodiak Island Borough Assembly meeting on April 3, 1997. This ordinance deals with ten (10) parcels of land that is zoned commercial along the Chiniak highway that is within the boundaries of the Women's Bay Service Area. The ten (10) property owners are requesting to be exempted from the road service area as they receive no direct road service by the Service District. If they are exempted they will no longer pay the 2 mills tax required for road district but would still remain in the fire district and pay the 1.255 mills. Dave Conrad explained that the KIB Mayor asked the Board to meet with the property owners and give the Borough Assembly their recommendation on the issue. Betty Fitzgerald, along with Dave W oodrutT, Jim Rippey, and Don Lockhard attended this meeting. They voiced their concerns that they did not receive any road maintenance service, snow removal and sanding as their lots are on a state highway. They also stated that they will never receive the service and did not feel they should pay the tax. George Lee commented he did not think the property owners should pay for services they did not receive. Linda Hinson agreed and said she felt the property owners were being double taxed. Ed Gondek stated his opinion as 1) the property owners knew when they bought their property that it was in the service district area and would be taxed accordingly, and 2) probably several people who use these businesses also use the service district roads. Everyone needs to pay for the roads or they cannot be maintained and he felt the property owners should not be exempt from the road service. Dave Conrad's concern was that a trend may be started. 4 Women's Bay Service Area Board Minutes, April 7, 1997 Page Five Also noted in the Ordinance # 97-07 on the second whereas it states road construction. Dave Conrad noted that he would request this be taken out of the ordinance as the service district does not do road construction. There was discussion on procedure for a recommendation to the Borough Assembly, as there are three (3) Board members absent. With no objection from the Board Dave Conrad will do a telephone poll of the Board and get a general consensus. He will'then write a letter to the Borough Assembly and present it at the Borough Assembly's worksession on Thursday, April 10, 1997 along with the minutes of this meeting. BOARD MEMBER COMMENTS George Lee, Ed Gondek, and Linda Hinson had no comments. Dave Conrad commented that there will be a meeting Monday, April 21, 1997 at the Women's Bay firehall regarding a potential plan for recreational use in the area and possible sale of Borough lands. It is important as a Board Member to try and look ahead at these issues as these lands could be annexed into the service area before they are developed in the future.
