My family has lived on Mission Lake for five generations. I have maintained the tide gate for 33 years. The Kodiak Island Borough created the Mission Lake Service District. They appointed three members. The members were instructed to: 1. Design 2. Install 3. Maintain a new tide gate The first meeting of the new service district was held in August of 2002. The borough dictated the date, time, and place for this meeting. At the first meeting, we agreed on three goals: 1. A plan for a new tide gate 2. Acquire necessary easements 3. Estimate cost Goat #1— The Plan: 1. A plan was presented by Peratrovich, Nottingham, & Drage, Inc., in June of 1998 2. This plan had been given to the borough manager six years ago. 3. The Mission Lake Service District committee unanimously approved the plan. 4. The plan showed the location of the new tide gate at the right hand side of the reef. 5. The new location was approved, as the minutes will verify. 0J The borough rejected the plan because it was not stamped. A question was posed: why did the borough have the plans for six years and not get them stam _pW There is not an excuse as to why the plans were not stamped. That the borough engineer could have studied the plan to see if it worked, and signed it. This he refused to do. Goal #2 - Easement: It was decided by all that an easement was necessary before the project could go to bid. It was also agreed by all that a survey was necessary to locate the proposed project. The minutes will show that all agreed as to the location —it should be on the right hand side of the reef. As chairman of the service district, I contacted Horizon Surveyors regarding conducting the survey necessary for the proposed tide gate. They understood what had to be done, offered to do it, did so at my request, and sent me a bill for $450. This bill was presented to the chief engineer and to date, I have not been paid. Ordinance 80-29-0, section 4.15.050, states that "Board members shall be compensated as provided by resolution of the assembly, and shall be reimbursed for reasonable expenses incurred in the performance of their duties." It has been pointed out that the engineering department should acquire the easement because they tell us we cannot advertise for bids until this is accomplished. At this point in time, the engineer has not made any attempt to acquire the easement It is also pointed out that the engineers have had six years to acquire an easement. One must come to the conclusion that the Borough is not interested in the tide gate nor has it made any effort which might result in a new tide gate --- a shameful situation. They tell us that they are too busy, that they have other projects with higher priority, and after all, the old tide gate is still working. It is true that the old tide gate is still working part of the time. It works fine in good weather, but when we have bad storms and heavy rainfall, I have to go over and dig it out, which I have done on several occasions. A new tide gate would eliminate the cost of maintenance. The taxpayers of Mission Lake are having to pay for the maintenance of the old tide gate, which is absolutely ridiculous, when a new tide gate would eliminate that expense. It is a fact that a year ago I could have installed the new tide gate for $30,000, complete. We had two grants of $10,000 each at that time, which meant that the tide gate would only cost us $10,000. Today, the Borough estimates that the new tide gate will cost $50,000 as a result of the 10/02/2003 13:45 4868425 SUTLIFF PAGE 03 Borough's indecision to do anything. It is obvious that the Kodiak Island Borough Engineering Department has a problem. They either have more work than they can handle, or they don't have enough help, or they are not capable of handling the situation. Perhaps all three are true. The Borough has developed a bad habit of not answering telephone calls, £axes, and letters on a timely basis. I think any tax -paying citizen that communicates with the Borough for information deserves an answer. Perhaps the Borough Assembly should establish a policy. Respectfully submitted by Norman Sutliff Board Chairman, Kodiak Mission Lake Service District 3 Mission Lake Update OCT - 2 PROJECT Install a new tide gate to replace the existing tide gate that is 34 years old. RECENT STORM FLOODING . This storm has created flooding in a number of places around town including Mission Lake. The flooding occurring along Mission Lake is a result of the amount of rain falling, an ineffective tide gate and the plugging of the intake structure by aquatic grasses. (These are grasses that grew thick in Mission Lake this summer and are now dying and floating as "grass island" down to the exit of the lake). Though not clogging the culvert, this grass is clogging the intake structure. . A lot of water has fallen on Kodiak. Mr. Sutliff's hangar is flooded. His hangar is located at the water's edge, and with the increase in rain and the raisir g of the lake level it appears that his is the only structure that has been flooded by the rain. MISSION LAKE TIDE GATE SERVICE AREA . The group consists of Norm Sutliff, Marian Johnson and Bill Hinkle. This group needs to meet to again. They want to hold a public hearing for residents around the lake and discuss the plans drawn up by the engineer. . Staff received as of September 122003 the tide gate design by the marine engineer hired by service area. PERMITS There are at least two agencies that may have jurisdiction over this project and probably more. . Corps of Engineers' review (navigable waters review) . ADF&G review (Anadromous Fish/fish passage permit) EXISTING TIDE GATE . The tide gate is failing. During this last storm, the front of the culvert (holding one of the flapper valves) fell off. Though it may not provide any real protection it is an indication of the condition of the rest of the pipe. STATUS . KID has actively maintained that tide gate using KID personnel. Since this storm, staff has been babysitting the tide gate due to the vegetation issue cited above. . Staff received a copy of the engineer's design as of September 12, 2003 . NEEDS 1. Review and approval of design by the service area board and Agencies 2. Drafting easement documents 3. Approval of easements by effected property owners is needed 4. Composition of project specifications 5. Advertising and award of bid 6. Construction of tide gate 7. Installation of a tide gate CONCLUSION Mr. Sutliff's concern about the speed of the process is a good one. Borough staff has been focusing on other projects that, up until the storm, were of higher priority. But the speed of the project has not been an issue with others on the committee. This speed is dictated by having the proper items in place, design drawings, agency review, easement acquisition, and public meeting needs.
