MUNICIPAL AIRPORT FIRE AID AGREEMENT
THIS AGREEMENT is made and entered into this QO day
of �v.(�uS� , 1990 by and between the City of Kodiak,
the Kodiak Island Borough, and Fire Protection Area Number One.
RECITALS
A. The following described parcels of real property
adjacent to the Kodiak Municipal Airport have been, or may be,
leased to private parties by the City of Kodiak for the purpose
of parking or storing aircraft using the municipal airport:
Lots 1 - 15, Block 1, U.S.S. 3467 in the Kodiak Record-
ing District, Third Judicial District, State of Alaska.
Lots 1 - 15, Block 2, U.S.S. 3467 in the Kodiak Record-
ing District, Third Judicial District, State of Alaska.
B. One or more of the parties leasing the aforesaid
parcels from the City of Kodiak may wish to construct aircraft
hangars or similar structures on the premises.
C. The above-described parcels are not yet served by
the City of Kodiak water system and the City of Kodiak Fire
Department does not possess a tanker or pumper truck giving it
the capability to fight fires in the absence of access to a fire
hydrant or similar connection to a pressurized water source.
This situation has rendered it impossible for some of the
lessees of the aforesaid parcels to obtain building permits
authorizing the construction of hangars and similar structures
on the premises.
D. Fire Protection Area Number One, which is also
known as the Bayside Fire Department, possesses a tanker or
pumper truck which gives it the capability of fighting fires in
the absence of a hookup to a pressurized water source and is
willing and able to respond to fire emergencies occurring on the

aforesaid premises, which are approximately equidistant between
the City of Kodiak fire station and the Bayside fire station.
NOW, THEREFORE pursuant to A.S. 18.70.150 the parties
hereby agree as follows:
1. Response to Fire Emergencies. Upon receiving a request
for assistance with a fire emergency occurring upon one or more
of the aforesaid parcels of real property adjacent to the Kodiak
Municipal Airport, Fire Protection Area Number One (the Bayside
Fire Department) shall respond as expeditiously as possible with
its tanker or pumper truck and such personnel and other equip-
ment as it may deem appropriate under the circumstances. Noth-
ing in this paragraph shall, however, be construed as requiring
the Bayside Fire Department to dispatch personnel or equipment
in response to a fire emergency occurring on the above-described
premises if said personnel or equipment are required to respond
to another emergency within Fire Protection Area Number One.
The City of Kodiak Fire Department shall also respond to fire
emergencies on the aforesaid premises and, upon arriving on the
scene shall initiate measures to replenish the tanker or pumper
truck by means of a hose hookup to the nearest available fire
hydrant. When both units are on the scene, overall control and
direction of all fire fighting operations shall rest with the
City of Kodiak Fire Department, unless other mutually acceptable
arrangements are made at the scene.
2. Extension of City Water Services. The City of Kodiak
hereby expresses its intention to extend city water services to
the above-described parcels as soon as is reasonably feasible.
Nothing in this agreement shall be construed as creating an
enforceable right on behalf of the lessees of the aforesaid
parcels, however, or as in any way restricting the City's right
to charge for water hookups and usage.
3. Term. This agreement shall be of indefinite duration
but shall be terminable upon 30 days prior written notice by any

party to it.
4. Enabling Resolutions. Each party hereby agrees to use
its best efforts to secure the prompt ratification and approval
of this agreement in the form of a duly enacted resolution auth-
orizing the actions set forth herein pursuant to A.S. 18.70.150.
Unless such resolutions are obtained from all parties by July 5,
1990, this agreement shall cease to be of any further force or
effect.

A RESOLUTION OF THE COUNCIL OF THE CITY OF KODIAK RATIFYING
A MUNICIPAL AIRPORT FIRE AID AGREEMENT
WHEREAS, the Lots 1 - 15, Block 1, and Lots 1 - 15, Block 2,
USS 3467, within the Kodiak Municipal Airport are leased to
private parties for the purpose of parking or storing aircraft
using the municipal airport; and
WHEREAS, one or more of the parties leasing the these tie -
down parcels may wish to construct aircraft hangars or similar
structures on the premises; and
WHEREAS, the tiedowns are not yet served by the City of
Kodiak water system and the City of Kodiak Fire Department does
not possess a tanker or pumper truck giving it the capability to
fight fires in the absence of access to a fire hydrant or simi-
lar connection to a pressurized water source; and
WHEREAS, this situation has rendered it impossible for some
of the lessees of the aforesaid parcels to obtain building per-
mits authorizing the construction of hangars and similar struc-
tures on the premises; and
WHEREAS, Fire Protection Area Number One, which is also
known as the Bayside Fire Department, possesses a tanker or
pumper truck which gives it the capability of fighting fires in
the absence of a hookup to a pressurized water source and is
willing and able to respond to fire emergencies occurring on the
tiedowns,
NOW, THEREFORE, BE IT RESOLVED that the Council of the City
of Kodiak, Alaska, does hereby ratify the Municipal Airport Fire
Aid Agreement, dated July 5, 1990, with the Kodiak Island Bor-
ough and Fire Protection Area Number One to provide fire suppres-
sion services to the tiedown parcels at the Kodiak Municipal
Airport.
