Dear Mr. Hartman:
On 27 June 2016, this Department sent you a Courtesy and Advisory Notice regarding the
activities taking place at the property described above. That notice outlined specific violations of
Kodiak lsland Borough (KlB) Code and the penalties and remedies to those violations.
Subsequent to the issuance of the Courtesy and Advisory Notice, your agent George Hartman,
contacted this department to inquire about the vehicle removal request from FY-2009. The Code
Enforcement Officer reviewed the files for the program and determined that your vehicles where
not removed because they did not meet the requirements of the program. Your agent informed
this department that you had not received the returned titles for the vehicles in question. The
Code Enforcement Officer told your agent on 10 August 2016 that KIB would reimburse you for
the cost of replacing the titles for the vehicles but not remove them from your property.
With the authority found in KIB Code 17.210.010, you are ordered to take the following actions
on the property described as Kodiak Townsite, Block 1, Lot 26, 412 Sargent Drive, Kodiak, AK
9961 5.
1. Remove and properly dispose of alljunk or abandoned vehicles and other junk items
from the property.
2. Cease using the property as a junkyard or for outdoor storage.
Failure to comply with this notice by 4 November 2016 will result in further enforcement
action required to ensure compliance. That enforcement action may include fines of $300.00
per violation (each day is a separate violation) and additional legal actions as prescribed by
KIBC 17.210.030.

1 7.21 0.030 Penalties and remedies.
A. A person who violates any provision of this title, an order issued under KIBC
17.210.010(A) or any term or condition of a conditional use, variance or other entitlement
issued under this title, is guilty of a misdemeanor and upon conviction is punishable by a
fine of not more than $300.00, in addition to the surcharge required to be imposed under
AS 12.55.039.
B. Notwithstanding the availability of any other remedy, the borough or any aggrieved
person may bring a civil action to enjoin any violation of this title, any order issued under
KIBC 17.210.010(4), or any term or condition of a conditional use, variance or other
entitlement issued under this chapter; or to obtain damages for any injury the plaintiff
suffered as a result of a violation. An action for injunction under this section may be
brought notwithstanding the availability of any other remedy. Upon application for
injunctive relief and the finding of an existing or threatened violation, the superior court
shall enjoin the violation.
C. Each act or condition violating this title, any order issued under KIBC 17.210.A106|
or any term or condition of a conditional use, variance, or other entitlement issued under
this title, and each day during which the act or condition exists, continues or is repeated
shall be a separate and distinct violation.
D. The penalties provided for violation of this chapter are in addition to and not in lieu of
any other penalty provided for in state law or any civil remedy available to the borough.
ln the event that you disagree with this determination, you have certain rights of appeal as
prescribed by the following KIB Code:
17.220.020 Commencement of appeal - Stav.
A. A decision of the community development department director is final unless
appealed to the commission within 10 working days of receipt of notification of the
decision.
B. An appeal is commenced by filing with the community development department a
written notice of appeal, specifically stating the reason for the appeal and the relief
sought, and payment of the appropriate fee. Upon commencement of an appeal, the
decision appealed from is stayed untilthe decision on appeal becomes final.

Dear Mr. Hartman:
The Code Enforcement Officer conducted an investigation of a complaint against your property
for possible violations of Kodiak lsland Borough Code. During the investigation, the Code
Enforcement Officer identified activities taking place on your property that appear to be in
violation of Kodiak lsland Borough Code (KIBC) Title 17, Zoning. Our investigation revealed the
following:
1. A sufficient amount of junk vehicles and other junk is being openly stored on the
property. We have determined that the property is being used as a junkyard as defined
by KIBC 17.25.110 and is not a permitted land use in the R3 - Multifamily residential
district. Land uses not listed as a permitted use in a district are prohibited by KIBC
17.15.080.
7 7.25.1 10 J definitions.
"Junk yard" means any space 100 square feet or more of any lot or parcel of land used
for the storage, keeping or abandonment of junk or waste material including scrap
metals or other scrap materials, or tor the dismantling, demolition, or abandonment of
automobiles, other vehicles, machinery or any parts thereof. [Prior code Ch. 5 subch. 2
$98. Formerly $1 7.06.3401.

Land uses not listed as a permitted use in a district are prohibited. [Ord. 8l-54-O Sl,

1 7.85.020 Permitted uses.
The following land uses are permitted in the multifamily residential district:

7 7.85.025 Conditional uses.
The following land use may be permitted by obtaining a conditional use permit in
accordance with Chapter 17.200 KIBC:
A. Recreationalvehicle parks. [Ord. FY2016-07 52, 2016].
Accordingly, you are hereby notified that violations of Kodiak lsland Borough Code Title 17 exist
on the property described as Kodiak Townsite, Block 1, Lot 26,412 Sargent Drive, Kodiak, AK
9961 5.
With the authority found in Kodiak lsland Borough Code section 17.21O.010
You are ordered to take the following actions to address this violation:
1 . Cease the use of the property as a junkyard.
2. Properly remove all junk vehicles and other junk from the property.
According to standard policy, a thirty (30) day deadline from the date of this correspondence is
hereby established for you to abate these violations and to achieve compliance with the
applicable zoning district standards.
Failure to comply with this notice by 27 July 2016 will result in further enforcement action
required to ensure compliance. That enforcement action will include forwarding this matter to
the Borough Attorney for possible legal action that may subject the property owner to
penalties and remedies as prescribed by Title 17 KIBC:
1 7.21 0.030 Penalties and remedies.
A. A person who violates any provision of this title, an order issued under KIBC
17.210.010(A) or any term or condition of a conditional use, variance or other entitlement
issued under this title, is guilty of a misdemeanor and upon conviction is punishable by a
fine of not more than $300.00, in addition to the surcharge required to be imposed under AS
12.55.039.
B. Notwithstanding the availability of any other remedy, the borough or any aggrieved
person may bring a civil action to enjoin any violation of this title, any order issued under
KIBC 17.210.010(A), or any term or condition of a conditional use, variance or other

entitlement issued under this chapter; or to obtain damages for any injury the plaintiff
suffered as a result of a violation. An action for injunction under this section may be brought
notwithstanding the availability of any other remedy. Upon application for injunctive relief
and the finding of an existing or threatened violation, the superior court shall enjoin the
violation.
C. Each act or condition violating this title, any order issued under KIBC 17.210.010(A), or
any term or condition of a conditional use, variance, or other entitlement issued under this
title, and each day during which the act or condition exists, continues or is repeated shall be
a separate and distinct violation.
D. The penalties provided for violation of this chapter are in addition to and not in lieu of any
other penalty provided for in state law or any civil remedy available to the borough.
ln the event that you disagree with this determination, you have certain rights of appeal as
prescribed by the following KIB Title 17 Code:
17.220.020 Commencement of appeal - Stav.
A. A decision of the community development department director is final unless appealed to
the commission within 10 working days of receipt of notification of the decision.
B. An appeal is commenced by filing with the community development department a written
notice of appeal, specifically stating the reason for the appeal and the relief sought, and
payment of the appropriate fee. Upon commencement of an appeal, the decision appealed
from is stayed untilthe decision on appeal becomes final.
