Further review of the title report which is coming your way shows that Alaska's DOT owns a significant portion
of Lot 19. Does the borough have the resources to do something like an as-built? I'm thinking that it would be
good to identify what is on state land and what is on Ferris land. From the photos, it looks like a significant
portion of the junk is on state land.
I did some legal research - there is not a lot of Alaska law on this point but Alaska RR Corp v. Native Village of
Eklutna, 43 P.2d 588 (Alaska2002) holds that unless the state is making use of its land for state government
purposes, it is subject to municipal zoning ordinances.
So, if we can get the as-built (maybe "as-trashed"), the next step would be to send to DOT (the commissioner
and the attomey general) an administrative decision similar to the 10122102 one to Mr. Ferris. Actually, it may
be appropriate to list both on one decision and then to send it to both. This will make greater sense if there are
items straddling the line.

Initial complaint re: junkyard was filed with the Community Development Department
March 20tn,2001 and included Lots 18 & l8A. Additional complaints filed with the
department June 16tn, 2003 & Septemb er 26thr 2003. Subsequent sale & cleanup of Lots 18

square feet or more of any lot or parcel of land used for the storage, keeping or abandonment of
junk or waste material including scrap metals or other scrap materials, or for the dismantling,
demolition, or abandonment of automobiles, other vehicles, machinery or any parts thereof.
The definition of 'Junk" is found in KIBC 10.10.005 [Definitions.] For the purpose of
this chapter the following definitions shall apply:
A. "JL nk" means any worn out, cast-off or discarded article or material which is
ready for destruction or has been coliected or stored for conversion or salvage to some other use
B. "Abandoned vehicles," means any motorized or towed vehicle, wheeled or
tracked, which has been left unattended for a length of time, which has resulted in the vehicles
deterioration or destruction.
The long-term nature of the storage of the item(s) of personal property, identified below,
has resulted in the establishment of a junkyard, and is therefore a prohibited use of the property
described above.

Naturc of Complaint: This location is located directly behind the I(EA headquarters
building - which is the employee entrance. The Ferris Property Junkyard is currently
being utilized by vagrants. On September 25, 2003 KEA reported to the Police
Departrnent a vagrant sleeping in one of the junk vehicles. This same vagrant harassed
one of KEA's female employees shortly therealter lvhen she was present outsidc our
building. We request the Borough put the sal'ety of our cmployees lirst and please
prioritize cleaning up this propcrty.
Other safcty concerns due to the Ferris property junkyard has to do rvith the rodent
population at the location.
PLEASE have the abandoned vehicles and junk removed from this lot.

Dear Chief Camai,
I would like to register a tbrmal complaint concerning the proliferation of abandoned cars
and trucks on Marine Way and under the bridge adjacent to KEA. I have called Martin
Lydick with the borough planning and zoning, and he suggested that my first step would
be to lodge a formal complaint with the Kodiak Police Department. Mr. Lydick
expressed his own frustration with the problern He suggested I take pictures of the
vehicles and get license numbers. Enclosed you will find that information.
This problem has been frustrating me for years. When people visit our community, they
are charmed with its natural beauty and shocked by the trash. I agree with their
assessment. If we want to develop our tourism, we must get our city cleaned up. It is
frustrating to participate in the Kodiak clean up year after year for 22 years and then see
the same large junk not moving. I have spoken to other communities about how they
handle the problern, and they all talk about strict rules for property owners.
The problem is more than one of aesthetics. When trash is allowed to accumulate, it
attracts more of the same. Years ago we had a graffiti problem in this town. One of the
ways we were able to slow it down was to immediately remove it or covcr it. The same
applies to trash and abandoned vehicles. This is also a health hazard. Rats breed in areas
of trash. I noted several of the vehicles were full of alcohol bottles. There is broken
glass around the vehicles, and I notice several have recently had their windshields broken
out. This is known as an attractive nuisance. I also found new toys around the wrecked
vehicles indicating that children play there. It is very unsafe. Even walking around
taking pictures was dangerous because of the hidden trash and glass. I keep my own
property clear ofjunk and trash, and I expect other property owners to do the same. It is
the responsibility of ownership.
If there is anything more I can do to assist with this problem, please don't hesitate to call.
I would like to be kept inlbrmed of how this problem is being rectified.

Department a vagrant sleeping in one of the junk vehicles. This same vagrant harassed
one of KEA's female employees shortly thereafter when she was present outside our
building. We request the Borough put the safety of our employees lirst and please
prioritize cleaning up this property.
Other safety concerns due to the Ferris property junkyard has to do with the rodent
population at the location.
PLEASE have the abandoned vehicles and junk removed from this lot.

facility. The Kodiak Police Department will supervise the clean-up operation.
Kodiak Island Borough would be responsible for absorbing the disposal costs.
My role would be to lean on Mr. Ferris & get some form of written agreement / release of any right &
or interest in the junk.

Dear Chief Camai,
I would like to register a formal complaint concerning the proliferation of abandoned cars
and trucks on Marine Way and under the bridge adjacent to KEA. I have called Martin
Lydick with the borough planning and zoning, and he suggested that my first step would
be to lodge a formal complaint with the Kodiak Police Department. Mr. Lydick
expressed his own frustration with the problem. He suggested I take pictures of the
vehicles and get license numbers. Enclosed you will find that information.
This problem has been frustrating me for years. When people visit our community, they
are charmed with its natural beauty and shocked by the trash. I agree with their
assessment. If we want to develop our tourisn; we must get our city cleaned up. It is
frustrating to participate in the Kodiak clean up year after year for 22 years and then see
the same large junk not moving. I have spoken to other communities about how they
handle the problenl and they all talk about strict rules for property owners.
The problem is more than one of aesthetics. When trash is allowed to accumulate, it
attracts more of the same. Years ago we had a graffiti problem in this town. One of the
ways we were able to slow it down was to immediately remove it or cover it. The same
applies to trash and abandoned vehicles. This is also a health haz:rrd. Rats breed in areas
of trash. I noted several of the vehicles were full of alcohol bottles. There is broken
glass around the vehicles, and I notice several have recently had their windshields broken
out. This is known as an attractive nuisance. I also found new toys around the wrecked
vehicles indicating that children play there. It is very unsafe. Even walking around
taking pictures was dangerous because of the hidden trash and glass. I keep my own
property clear ofjunk and trash, and I expect other property owners to do the same. It is
the responsibility of ownership.
If there is anything more I can do to assist with this problerq please don't hesitate to call.
I would like to be kept informed of how this problem is being rectified.

Dear Mr. Ferris,
The property described above is zoned B-Business Disfrict. The establish$tent and
maintenance of a junkyard, is not a permitted use within the B-Business District zone. Per KIBC
17.03.080 [Uses prohibited unless authorized.l Land uses not listed as a permitted use in a
district are prohibited.
Per KIBC 17.06.340 [Junkyard.] "Junkyard" means any space one hundred (100)
square feet or more of any lot or parcel of land used for the storage, keeping or abandonment of
junk or waste material including scrap metals or other scrap materials, or for the dismantling,
demolition, or abandonment of automobiles, other vehicles, machinery or any parts thereof.
The definition of 'Junk" is found in KIBC 10.10.005 [Definitions.] For the purpose of
this chapter the following definitions shall apply:
A. "Junk" means any worn out, cast-off, or discarded article or material which is
ready tbr destruction or has been coliected or stored for conversion or salvage to some other use.
B. "Abandoned vehicles," means any motorized or towed vehicle, wheeled or
tracked, which has been left unattended for a length of time, which has resulted in the vehicles
deterioration or destruction.
The long-term nature of the storage of the item(s) of personal property, identified below,
has resulted in the establishment of a junkyard, and is therefore a prohibited use of the property
described above.

Therefore, according to standard policy, a thirty (30) day deadline is now established by
administrative decisionfor you to abate this violation (JunlEard). ln the event that you
disagree with this determination, you have certain rights of appeal.
17.90.020 [Commencement of appeal - Stay.l
A. A decision of the community development department director is final unless
appealed to the Planning and Zoning Commissio,n within ten (10) working days of
receipt of notification of the decision.
B. An appeal is commenced by filing with the community development department a
written notice of appeal, specifically stating the reason for the appeal, the relief
sought, and payment of the appropriate fee ($150.00). Upon commencement of
an appeal, the decision appealed from is stayed until the decision on appeal
becomes final.
Per KIBC 17.75.030 [Penalties and remedies.l
A. A person who violates any provision of this title, an order issued under
subsection 17.75.010(A) of this chapter or any term or condition of a conditional use,
variance or other entitlement issued under this title, is guilty of a misdemeanor and upon
conviction is punishable by a fine of not more than three hundred (300) dollars, in addition
to the surcharge required to be imposed under AS 12.55.039.
B.C. Each act or condition violating this title, any order issued under subsection
17.75.010(A) of this chapter, or any term or condition of a conditional use, variance, or
other entitlement issued under this title, and each day duringwhich the act or condition
exists, continues, or is repeated, shall be a separate and distinct violation.

This correspondence is directed to you as a courtesy notice and advisory
A Notice of Violation: Determination of Junkyard, (Certified Mail Item Number 7099
3220 0008 8899 5128) on the properties referenced above, was transmitted to you on the l gtl' of
November 2001. You did not file an appeal of the Administrative Determination, nor have you
complied with the directive to abate the violation.
Regardless of the circumstances, which resulted in the accumulation of the junk in past
years, you, as the current property owner are responsible for the situation, as it exists today.
While it is the policy of the Kodiak Island Borough to strive for voluntary compliance
with regards to such matters, you have failed to provide this department with any proposal,
verbal or written, for achieving the required cleanup.
Failure to provide this department with an acceptable plan for abatement, or to move
expeditiously towards abatement, within seven (7) days of the date of this letter will result in the
forwarding of this matter to legal counsel for further proceedings.
