AN ORDINANCE OF THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH ACCEPTING 4
AND APPROPRIATING FUNDS FROM THE 2021 CHIGNIK SALMON FEDERAL FISHERY 5
DISASTER RELIEF DISTRIBUTION 6

WHEREAS, On May 9, 2023, the U.S. Secretary of Commerce made a disaster determination 8
for the 2021 Alaska Chignik Salmon Fishery under the Magnuson-Stevens Fishery Conservation 9
and Management Act in response to a November 15, 2021, request from Governor Dunleavy; 10
and 11

WHEREAS, on May 6, 2022, National Oceanic and Atmospheric Administration (NOAA) 13
Fisheries allocated $4,989,902 to address losses to the affected management areas in response 14
to the disaster declaration; and 15

WHEREAS, the State of Alaska, in consultation with stakeholders and NOAA's National Marine 17
Fisheries Service, drafted a spend plan and forwarded the plan to Pacific States Marine Fisheries 18
Commission (PSMFC), who is the administrator of the federal grant for the disaster funds; and 19

WHEREAS, the PSMFC has provided notification that the Kodiak Island Borough is eligible to 21
receive a one-time payment of forty-one thousand, five hundred fifty-seven dollars and eighty-one 22
cents ($41,557.81) to compensate for the borough’s lost income due to this fishery disaster; and 23

WHEREAS, Kodiak Island Borough Code 3.25.040(C) requires that grant funds, which are 25
unlimited as to use or subject only to general limitations, be appropriated by ordinance and include 26
an appropriate budget amendment. 27

NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND 29
BOROUGH that: 30

Section 1: This ordinance is not of a general and permanent nature and shall not become a part 32
of the Kodiak Island Borough Code of Ordinances. 33

Section 2: The Kodiak Island Borough accepts the funds granted through the Pacific States 35
Marine Fisheries Commission for the 2021 Chignik Salmon Federal Fishery Disaster 36
Relief Distribution. 37

Section 3: The Fisheries Economic Development Capital Fund budget shall be amended to 39
account for this $41,557.81 one-time payment. 40

Effective Date: This ordinance takes effect upon adoption. 43
