AN ORDINANCE OF THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH ACCEPTING 4
AND APPROPRIATING FUNDS FROM THE 2020 ALASKA PACIFIC COD FEDERAL 5
FISHERY DISASTER RELIEF DISTRIBUTION 6

WHEREAS, on January 21, 2022, the U.S. Secretary of Commerce made a disaster 8
determination for the 2020 Alaska Gulf of Alaska Pacific Cod Fishery under the Magnuson-9
Stevens Fishery Conservation and Management Act in response to a March 8, 2021, request 10
from Governor Dunleavy; and 11

WHEREAS, on May 6, 2022, National Oceanic and Atmospheric Administration (NOAA) 13
Fisheries allocated $17,772,540 to address losses to the affected management areas in response 14
to the disaster declaration; and 15

WHEREAS, the State of Alaska, in consultation with stakeholders and NOAA's National Marine 17
Fisheries Service, drafted a spend plan and forwarded the plan to Pacific States Marine Fisheries 18
Commission (PSMFC), who is the administrator of the federal grant for the disaster funds; and 19

WHEREAS, the PSMFC has provided notification that the Kodiak Island Borough is eligible to 21
receive a one-time payment of one hundred fifty-six thousand, one hundred fifty-eight dollars and 22
forty cents ($156,158.40) to compensate for the borough’s lost income due to this fishery disaster; 23
and 24

WHEREAS, Kodiak Island Borough Code 3.25.040(C) requires that grant funds, which are 26
unlimited as to use or subject only to general limitations, be appropriated by ordinance and include 27
an appropriate budget amendment. 28

NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND 30
BOROUGH that: 31

Section 1: This ordinance is not of a general and permanent nature and shall not become a part 33
of the Kodiak Island Borough Code of Ordinances. 34

Section 2: The Kodiak Island Borough accepts the funds granted through the Pacific States 36
Marine Fisheries Commission for the 2020 Gulf of Alaska Pacific Cod Disaster Relief 37
Distribution. 38

Section 3: The Fisheries Economic Development Capital Fund budget shall be amended to 40
account for this $156,158.40 one-time payment. 41

Effective Date: This ordinance takes effect upon adoption. 45
