FY2026-06 A RESOLUTION OF THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH AUTHORIZING DISPOSAL BY LEASE OF A PORTION OF USS 2539 LT 1 REMAINDER WOMENS BAY WHEREAS, Kodiak Island Borough Code (KIBC) 18.20.030 requires review of each disposal of borough land by the planning and zoning commission before submission to the assembly; and WHEREAS, the code requires that the planning and zoning commission, by resolution, shall make a recommendation to the assembly regarding the proposed land disposal referenced; and WHEREAS, the planning and zoning commission has reviewed and recommended approval of this disposal via their resolution number 2026-07; and WHEREAS, the code states that borough land disposal not subject to approval by ordinance are subject to approval by resolution; and WHEREAS, the Kodiak Island Borough assumed management of USS 2539 LT 1 REMAINDER WOMENS BAY and a long-term lease of a tract of the land consisting of approximately 73 acres within this parcel from the State of Alaska; and WHEREAS, the tract of leased land is commonly known as the Kodiak Fairgrounds; and WHEREAS, the 55 -year lease assumed by the Kodiak Island Borough expires on November 3, 2025; and WHEREAS, the lessee, Kodiak Rodeo and State Fair, Inc., has requested continued occupation of this tract of land; and WHEREAS, the code allows for the disposal by lease for up to twenty-five (25) years to a nonprofit corporation at a reasonable rental rate, taking into account the purpose for which the real property is to be used. NOW, THEREFORE, BE IT RESOLVED BY THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH that disposal by lease of a portion of USS 2539 LT 1 REMAINDER WOMENS BAY, commonly known as the Kodak Fairgrounds is authorized; and BE IT FURTHER RESOLVED that the Borough Manager or her designee is directed to enter into lease negotiations with Kodiak Rodeo and State Fair, Inc., a nonprofit corporation, for a term not to exceed 25 years, at a reasonable rental rate taking into consideration the purpose for which the real property is to be used (KIBC 28.40.020(B)).
