4 AN ORDINANCE OF THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH AMENDING
5 KODIAK ISLAND BOROUGH CODE TITLE 3 REVENUE AND FINANCE, CHAPTER 3.35
6 REAL PROPERTY TAX, SECTION 3.35.040 METHOD OF ASSESSMENT REGARDING
7 CORRECTION OF THE ASSESSMENT ROLL

9 WHEREAS, Senate Bill 179 was adopted by the State of Alaska in 2024 amending certain
10 procedures for Corrections to the Assessment roll; and
11
12 WHEREAS, the Assembly finds that amendments to the current procedures in the Kodiak
13 Island Borough Code are required to comply with the new State adopted procedures; and,
14
15 WHEREAS, the Assembly desires to harmonize the provisions of the Kodiak Island Borough
16 Code with the new State Statutory changes.

18 NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND
19 BOROUGH that:

21 Section 1: This ordinance is of a general and permanent nature and shall become a part of the
22 Kodiak Island Borough Code of Ordinances.

24 Section 2: That Section 3.35.040 of the Kodiak Island Borough Code of Ordinances is amended
25 to read as follows:

27 KIBC 3.35.040 Method of Assessment.

29 A. All taxable property must be assessed at its full and true value as of the first day of
30 January of the assessment year. The full and true value is the estimated price that the
31 property would bring in an open market sale between a willing seller and a willing buyer
32 both conversant with the property, under the then -prevailing market conditions and with
33 prevailing general price levels. The assessor shall strive to make all assessments fair and
34 equitable. Taxable interests in otherwise non-taxable property, both real and personal,
35 shall be taxed based on the lessee's possessory interest in the property. The Assessor
36 shall apply the standards for assessing full and true value approved by the State
37 unless specific standards are adopted by ordinance.

41 3. Corrections of the assessment roll.

43 The assessor may correct an error or supply an omission in the assessment
44 roll at any time before the sitting of the board of equalization.

assessment roll. A person receiving an assessment notice shall advise the
assessor of errors or omissions in the assessment of the person's property.
If requested by the person, the assessor or a person designated by the
assessor, shall meet with the person and answer reasonable questions
relating to the methods used to assess the person's property. The meeting
required under this subsection may be virtual or telephonic. A meeting under
this subsection shall not extend the period of review or the deadline for
appeals under subsection (C)(4) of this section.
Effective Date: This ordinance takes effect upon adoption.
