A regular meeting of the Kodiak Island Borough Assembly was held on August 7, 2025, in the
Assembly Chambers. The meeting was called to order at 6:30 p.m. Staff present were Borough
Manager Aimee Williams, Assessing Director Seema Garoutte, Community Development
Director Chris French, Interim Projects Manager Patricia Valerio, Borough Clerk Nova M.
Javier, and Deputy Clerk Lina Cruz.

Captain Diane Shatto of the Salvation Army gave the invocation.

16. ASSEMBLY MEMBERS' COMMENTS
Assembly Member Sharratt shared that he recently learned about the electric
fence issue at the landfill, which he had previously been unaware of. He hopes
it will be prioritized at both the employee and Assembly level, with whatever
actions are needed to restore the long-standing electric fence. He expressed
that he is anxious and still awaiting discussions on the Hospital, Kodiak Island
lands disposal, foreclosure list, and Uniform Minor Offenses Table (UMOT). He
requested more information and clarification on UMOT. He also expressed
appreciation for staff applying for the Alaska Housing Finance Corporation
(AHFC) $700,000 grant. Lastly, he asked about the disposition of the front desk
position and allowing access to the building, he stated he would like to have that
discussion either publicly or privately.
Assembly Member Smiley expressed concerns about the Assembly's decision
to fully fund nonprofits this year, stating that it may create the expectation to do
the same next year, which is worrisome to him.
Assembly Member LeDoux thanked the Manager for attending the recent
Womens Bay Service Area Board meeting. He congratulated the Assembly on
what he felt was the best discussion on nonprofit funding he has seen during his
time on the Assembly —describing it as collegial, open, positive, and productive.
He requested that the list of nonprofits funded by the Borough, along with the
amounts allocated, be posted on the Borough website, along with a statement
such as: "If you would like to personally donate, here is the phone number to do

so." He also suggested that the Manager and Mayor sit down with Nate Svoboda
to possibly host a call -in show where people can ask questions about bear
safety. He noted that the Borough's current waste contractor manages all the
transfer sites in Fairbanks and encouraged interested Assembly Members to
visit those sites to see how they operate. He also thanked Captain Diane Shatto
for an outstanding invocation.
Assembly Member Ames commented on the need to repair the electric fence at
the landfill. He emphasized that contractors should understand that, moving
forward, standards and rules will be expected to be followed during bidding
processes, even if they may have been overlooked in the past.
Assembly Member Johnson also expressed surprise at the status of the electric
fence and stated he considers it as a critical infrastructure. He hopes to hear a
plan soon to have it fully operational. He echoed public testimony regarding the
lack of code enforcement, noting that a rule is only meaningful if it is enforced.
He stated that UMOT should either be revoked or enforced. He is also looking
forward to an update on software, discussed four months ago, for monitoring
short-term rentals in the community.
Assembly Member Griffin shared his son's experience with electric fences in
Karluk, noting that bears there have figured out how to turn them off. He
commented on the governor's recent Administrative Orders 359 and 360, saying
they are effectively circumventing state regulations and grant funding processes.
He warned this could lead to rapid changes and increased pressure on staff, and
that next year may be even more challenging financially for nonprofits if these
orders are implemented.
Assembly Member Whiteside commented on the bear issues, thanked the
Manager and the Engineering & Facilities Director for their work, and
encouraged them to continue requesting support from the Assembly as needed
to find solutions. He encouraged the public to report bear sightings to the Alaska
State Troopers in addition to posting on social media.

ASSEMBLY REGULAR MEETING
SUBJECT: Ordinance No. FY2026-04, Amending Various Sections Of Kodiak Island
Borough Code Title 17 Zoning, Related To Assisted Living Residences

RECOMMENDATION:
Move to adopt Ordinance No. FY2026-04.
DISCUSSION:
The Kodiak Island Borough Planning & Zoning Commission held a public hearing on July 16,
2025, regarding a code amendment to various section of Title 17, Zoning, related to assisted
living residences. The Commission voted 5 to 0 with 2 members absent to recommend
approval of the code amendment to the Assembly. The Commission approved this
recommendation through Resolution No. FY2026-01, which is attached to this agenda
statement.
The Community Development Department staff has received several inquires from the public
on where assisted living residential uses are allowed within the zoning regulations. Currently,
assisted living residential uses are not listed within the zoning regulations. Staff brought this
issue to the attention of the Planning & Zoning Commission at its work session on November
13, 2024. The Commission directed staff to research and develop a draft code amendment for
assisted living residential uses. The first review of a draft ordinance was on January 8, 2025.
The Commission conducted additional work sessions on the amendment on May 14, 2025,
and June 11, 2025.
Assisted living residences are uses that provide services to residents that need assistance
because of physical or mental disability caused by age, disease, or genetic disorder.
The State of Alaska licenses assisted living homes, with 3 or more residents. Staff has
included a list of current license holders within the borough attached to this agenda item. The
code amendment before you would define two uses: assisted living homes with up to 5
residents in a dwelling unit and assisted living facility with more than 5 residents in a dwelling
unit and includes facilities with multiple dwelling units. The code amendment also provides for
location of these uses by zoning district and by approval type; either as permitted uses or
permitted uses that require a conditional use permit. Attached to this agenda item is a list of
state licensed assisted living homes/facilities.
Most of the current licensed properties are located within the R2 and R3 districts. The
proposed code amendment would allow assisted living homes in the RR2, RR, RR1, R1, R2,
and R3 districts. Assisted living facilities would be allowed within the R3, B, UNC and RB
districts, and by a conditional use permit within the RR1, R1, and R2 districts.
The code amendment includes a parking requirement of 3 off-street spaces for an assisted
living home and 3 off-street spaces or 1 off-street space per employee on maximum shift, plus
one visitor per 5 residents, whichever is greater for an assisted living facility.

AN ORDINANCE OF THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH AMENDING
VARIOUS SECTIONS OF KODIAK ISLAND BOROUGH CODE TITLE 17 ZONING, RELATED
TO ASSISTED LIVING RESIDENCES
WHEREAS, as a second-class borough, the Kodiak Island Borough exercises planning,
platting, and land use regulations on an area -wide basis pursuant to A.S. Chapter 29.40; and
WHEREAS, in accordance with A.S. Chapter 29.40, the borough adopted by ordinance an
update to the KIB comprehensive plan on December 6, 2007 (the 2008 Comprehensive Plan);
and
WHEREAS, Title 17 of the Kodiak Island Borough Code of Ordinances is the land use regulation
for the borough; and
WHEREAS, KIBC Section 17.205.010 provides that "Whenever the public necessity,
convenience, general welfare or good zoning practice requires, the assembly may, by ordinance
and after report thereon by the commission and public hearing as required by law, amend,
supplement, modify, repeal or otherwise change these regulations and the boundaries of the
districts"; and
WHEREAS, Community Development Department staff received inquiries from residents of the
borough on where assisted living residences may be permitted within the borough; and
WHEREAS, KIBC does not define assisted living homes or facilities within Title 17; and
WHEREAS, the State of Alaska licenses Assisted Living Homes for up to 5 individuals and
more than 5 individuals; and
WHEREAS, the Planning and Zoning Commission discussed the options for regulating assisted
living uses and directed staff to create assisted living home use for up to 5 individuals and assisted
living facility use for more than 5 individuals; and
WHEREAS, a 2008 comprehensive plan goal states "continue to update and improve the
effectiveness of Borough policies, plans, regulations, and procedures."; and
WHEREAS, the Planning and Zoning Commission finds that this amendment is in conformance
with the 2008 comprehensive plan and best planning practices.
NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND

Section 1: This ordinance is of a general and permanent nature and shall become a part of the
Kodiak Island Borough Code of Ordinances.
Section 2: Title 17 Zoning of the Kodiak Island Borough Code of Ordinances is amended to read
as follows:
17.25.020 A definitions.
"Approach surface" means an approach surface longitudinally centered on the extended runway
centerline and extending outward and upward from each end of a runway. The inner edge of the
approach surface is the same width as the runway and it expands uniformly to a width of 1,500
feet of each end of the runway. The approach surface extends for a horizontal distance of 5,000
feet at a slope of 20:1. No building or structure may be constructed or erected nor may any other
object be stored or placed in such a manner as to protrude into the approach surfaces.
A. The approach surfaces for the municipal airport extend upward and outward from the south
end of the existing lake surface (towards Larch Street) and the north end of the gravel runway
(Von Scheele Way) only.
Assisted living facility — means a residential facility, currently and duly licensed by the
state of Alaska as an assisted living home, which combines housing, food service, general
protective oversight and personalized assistance with the activities of daily living tasks
such as eating, bathing, dispensing of medicines, housekeeping and other tasks and is
compatible with a residential zoning district for more than 5 residents unrelated by blood
or marriage.
Assisted living home — means a single-family dwelling unit designed, used, or intended for
use in whole or in part as an assisted living home, that is licensed and regulated by the
State of Alaska and includes no more than 5 residents unrelated by blood or marriaae.

A RESOLUTION OF THE KODIAK ISLAND BOROUGH PLANNING & ZONING COMMISSION
RECOMMENDING APPROVAL OF AN AMENDMENT TO VARIOUS SECTIONS OF KODIAK
ISLAND BOROUGH CODE TITLE 17 ZONING, RELATED TO ASSISTED LIVING
RESIDENCES TO THE BOROUGH ASSEMBLY
WHEREAS, as a second-class borough, the Kodiak Island Borough exercises planning,
platting, and land use regulations on an area -wide basis pursuant to A.S. Chapter 29.40; and
WHEREAS, in accordance with A.S. Chapter 29.40, the borough adopted by ordinance an
update to the KIB comprehensive plan on December 6, 2007 (the 2008 Comprehensive Plan);
and
WHEREAS, Title 17 of the Kodiak Island Borough Code of Ordinances is the land use regulation
for the borough; and
WHEREAS, KIBC Section 17.205.010 provides that "Whenever the public necessity,
convenience, general welfare or good zoning practice requires, the assembly may, by ordinance
and after report thereon by the commission and public hearing as required by law, amend,
supplement, modify, repeal or otherwise change these regulations and the boundaries of the
districts"; and
WHEREAS, Community Development Department staff received inquiries from residents of the
borough on where assisted living residences may be permitted within the borough; and
WHEREAS, KIBC does not define assisted living homes or facilities within Title 17; and
WHEREAS, the State of Alaska licenses Assisted Living Homes for up to 5 individuals and
more than 5 individuals; and
WHEREAS, the Planning and Zoning Commission discussed the options for regulating assisted
living uses and directed staff to create assisted living home use for up to 5 individuals and assisted
living facility use for more than 5 individuals; and
WHEREAS, a 2008 comprehensive plan goal states "continue to update and improve the
effectiveness of Borough policies, plans, regulations, and procedures."; and
WHEREAS, the Planning and Zoning Commission finds that this amendment is in conformance
with the 2008 comprehensive plan and best planning practices.

WHEREAS, at an advertised public hearing, consistent with KIBC 17.205.040, the Commission
considered the merits of the code amendment on July 16, 2025, and recommends approval of
the code amendment to Title 17 based upon findings listed within this resolution, satisfying the
requirements for Commission review in KIBC Chapter 17.205 before sending the proposed code
amendment to the Assembly for consideration.
NOW, THEREFORE, IN CONSIDERATION OF THE ABOVE FINDINGS, IT IS RESOLVED BY
THE PLANNING & ZONING COMMISSION OF THE KODIAK ISLAND BOROUGH AS
FOLLOWS:
Section 1: The Kodiak Island Borough Planning and Zoning Commission hereby recommends
approval of the code amendment as listed in Section 2 of this resolution to the Borough
Assembly for consideration.
Section 2: Title 17 Zoning of the Kodiak Island Borough Code of Ordinances is amended to read
as follows:
17.25.020 A definitions.
"Approach surface" means an approach surface longitudinally centered on the extended runway
centerline and extending outward and upward from each end of a runway. The inner edge of the
approach surface is the same width as the runway and it expands uniformly to a width of 1,500
feet of each end of the runway. The approach surface extends for a horizontal distance of 5,000
feet at a slope of 20:1. No building or structure may be constructed or erected nor may any
other object be stored or placed in such a manner as to protrude into the approach surfaces.
A. The approach surfaces for the municipal airport extend upward and outward from the south
end of the existing lake surface (towards Larch Street) and the north end of the gravel runway
(Von Scheele Way) only.
Assisted living facility — means a residential facility, currently and duly licensed by the
state of Alaska as an assisted living home as defined in AS 47.32.900(2), which combines
housing, food service, general protective oversight, and personalized assistance with the
activities of daily living tasks such as eating, bathing, dispensing of medicines,
housekeeping and other tasks and is compatible with a residential zoning district for
more than 5 residents unrelated by blood or marriage.
Assisted living home — means a single-family dwelling unit designed, used, or intended
for use in whole or in part as an assisted living home as defined in AS 47.32.900(2), that
is licensed and regulated by the State of Alaska as an assisted living home and includes
no more than 5 residents unrelated by blood or marriage.

RECOMMENDATION:
Move to adopt Ordinance No. FY2026-06.
DISCUSSION:
KIBC 3.35.030 states that a "Primary residence and permanent place of abode" shall mean a
dwelling which is owned by and in which the person resides at least 185 days in the year prior
to the exemption year and, when absent, the dwelling is not leased or rented to another." The
Alaska Department of Revenue, permanent fund dividend division office states that in order to
be eligible for the PFD, you must reside in Alaska for 180 days. Since the PFD is relied upon
as a source for eligibility for Senior and Disabled Veteran exemption, Assessing staff believes
that the Kodiak Island Borough should use the same number of days to determine
qualification. This would benefit staff by eliminating the need to develop additional resources
and letters to determine eligibility for the difference of 5 days.

FROM TAXATION REGARDING DEFINITIONS
WHEREAS, the Kodiak Island Borough Code uses the Alaska Permanent Fund Dividend
eligibility as a measure of residency for purposes of the senior real property tax exemption; and
WHEREAS, the number of days of physical presence in the State of Alaska required for
purposes of residency eligibility for the Alaska Permanent Fund Dividend is stated as 180 days
while the current provisions in the Kodiak Island Borough Code require 185 days presence; and
WHEREAS, the Assembly desires to harmonize the provisions of the Kodiak Island Borough
Code with the number of days required by the State of Alaska for Alaska Permanent Fund
Dividend eligibility.
NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND
BOROUGH that:
Section 1: This ordinance is of a general and permanent nature and shall become a part of the
Kodiak Island Borough Code of Ordinances.
Section 2: That section 3.35.030 of the Kodiak Island Borough Code of Ordinances is amended
to read as follows:
3.35.030 Real and property exempted from taxation
(A) 7. Definitions. For purposes of subsection (A)(6) of this section only, the following
words are defined as:
"Disabled veteran" shall mean a disabled person separated from the military service of
the United States under a condition that is not dishonorable who is a resident of the state,
whose disability was incurred or aggravated in the line of duty in the military service of
the United States, and whose disability has been rated as 50 percent or more by the
branch of service in which that person served or by the United States Department of
Veterans Affairs.
"Primary residence and permanent place of abode" shall mean a dwelling which is owned
by and in which the person resides at least 4-&5180 days in the year prior to the exemption
year and, when absent, the dwelling is not leased or rented to another.
"Resident" shall mean a person who has a fixed habitation in the Kodiak Island Borough
for at least 485 180 days per calendar year, and when absent, intends to return to the

borough and does not claim residency outside the borough or claim a resident exemption
in another state or country, or other borough of Alaska or take action or is absent under
circumstances inconsistent with the intent to remain and make a home indefinitely in the
borough.
"Widow or widower" shall mean the surviving un-remarried spouse.
Effective Date: This ordinance takes effect upon adoption.

Community Development
Planning & Zoning Commission — August 20, 2025, Regular Meeting
The Commission held a regular meeting on August 20, 2025. The Commission found
that the two land disposal items for the Island Lake Road property and two tax
foreclosed properties do not have a public purpose and recommended to the Assembly
that the land disposals be approved, a similar use determination for daycare services for
North Star Elementary School building within the Public Use Lands (PL) District was
approved by the Commission, the capital improvement program list was continued to
the September 17 regular meeting, and proposed amendments to the Commission's
Bylaws were approved and will be forwarded to the Assembly for review.

PLAN 2045 — Ouzinkie Visit
Community Development staff met via Zoom with members of the city, tribal
organization, and native corporation to discuss the comprehensive plan. The visit to
Ouzinkie has been rescheduled to Thursday, August 20, 2025, to continue the
discussion on the comprehensive plan and to tour the city.
Russian River and Sargent Creek Hydrology and Hydraulics Study Presentation
A presentation from River Focus, Inc, is scheduled for the September 11 Assembly
Work Session. The final findings report has been completed and the presentation to the
Assembly is the final task needed to complete the project contract and grant award.
Multi -Jurisdiction Multi -Hazard Mitigation Plan Update
The plan update document was approved by FEMA on August 15, 2025. The plan is
now in effect for the Borough, the City of Larsen Bay, and the City of Port Lions. The
remaining cities in the borough can still approve a resolution within one year of the plan
approval. Approved resolutions should be submitted to the Alaska Division of Homeland
Security and Emergency Management before transmittal to FEMA. Community
Development staff is working with the other cities to assist them in the approval process.
Finance Department
2025 Property Taxes
The next payment deadline for those wishing to make full payments, or paid their first
half payment after August 15tn, is Wednesday, October 15tn
Property Assessment and Taxation Implementation Project
Staff is starting to schedule training sessions to review tables and processes. Data is
still being cleaned/reviewed, and entry screens and forms are still in development with
Tyler. Go -live date is currently planned for September 2025.
Temporary Receptionist
We are advertising for a temporary employee to fill the gap so that all finance staff can
be present for training on the new Tyler software.

Senior Citizen (SC) / Disabled Veteran (DV) Exemptions
• Outstanding applications: 20 (18 SC and 2 DV) remain undetermined.
• SC/DV Village trips with KANA for application filings have been scheduled for the

IT is working on responding to questions regarding our State and Local Cybersecurity
Grant Program (SLCGP) RFP.
Network and Connectivity
IT is working with Engineering on upgrading the landfill network.
Hardware and Infrastructure
IT is configuring a new server for the Landfill, which will complement their networking
upgrade.

Staff Updates
A new temporary laborer was hired this week and a maintenance coordinator was
interviewed this week.
Fuel Spill Assistance
Comprehensive gap analysis and site investigation work plan to advance towards the
closure of the spill at the long term care center is under contract with NWFF.
Collaboration with Community Partners
This week, the KIBSD Director of Maintenance, Fire Chief, Deputy Fire Marshall, and
E&F Director met to discuss a path forward for open communication and collaboration
on City of Kodiak Fire Department Inspection Reports. Collectively, they will be working
on a path forward to optimize the maintenance and repair of the identified
discrepancies.
MaintainX [Work Order] Request Portal Implementation Update
The EF Staff, with a big help from IT, has moved forward with implementing MaintainX
Request Portal, an electronic system for managing employee and tenant work order
requests. Previously, employees or tenants submitted requests primarily through staff or
by email, which were then logged manually. With the new system, those requests are
now electronically submitted, reviewed, and generated directly into MaintainX, allowing
staff to track and manage them systematically from start to finish. This process ensures
requests are not overlooked, provides clearer timelines for completion, and creates a
transparent record of work being requested and performed. By shifting to a digital
platform, we are improving efficiency, strengthening accountability, and providing a
better experience for employees and tenants.
KANA & Koniag Elder Clean -Up Event
Following the presentation from last week the finance staff were able to provide the
event delivery information. The event volunteers made 12 deliveries that totaled 4.16
tons. KIB provided cost savings for the event in the amount of $1,688.00. A heartfelt
thank -you goes out to all who participated —your time and commitment made a
meaningful difference for the Elder Support Event and for the community as a whole.
Together, we turned teamwork into tangible impact!
Regional Solid Waste Management Plan Update
The Regional Solid Waste Management Plan Update is underway, and the surveys are
now live on the KIB website as a Newsflash and has been shared with the public
through Facebook, email, and posted flyers around town (more advertisement avenues
to come - newspaper and radio). There are four surveys available for folks to partake in:
Road System Residents Survey, Native Village Residents Survey, Kodiak Business
Survey, and a Waste/Recycling Service Provider Survey. Participants have the
opportunity to enter their contact information to be entered into a drawing for $100 of

produce from the Kodiak Harvest Food Cooperative. A flyer for the survey is attached to
the Manager's Report.
Chiniak School Painting
The pre -construction meeting for this project was held on August 11 th. Staff are eager to
move forward and are coordinating closely with the contractor to ensure a smooth start.
With the School District's assistance in providing access to water and power at the
facility, the team is well -prepared to begin. Efforts will be made to complete the majority
of the "noisy" work before the start of the school year to minimize disruption for students
and staff. Prep work is scheduled to start August 22nd.
Multi -Facility Elevator Modernization
On August 13th, TKE was servicing the Middle School elevator when an electrical fire
occurred in the mechanical room. Fortunately, the fire was quickly contained thanks to
the prompt response of the KIBSD Maintenance team, and the area was declared safe
by the City of Kodiak Fire Department.
Unfortunately, this incident has resulted in a complete shutdown of the Middle School
elevator, which will remain out of service until the planned modernization takes place.
E&F staff are working closely with the contractor to expedite the shipment of materials
and are collaborating with all relevant stakeholders to reprioritize the modernization
timeline.
As of today, the timelines are as follows:
• The Middle School elevator system has an estimated ship date mid -October and
is estimated to take a minimum of three weeks to arrive in Kodiak. So, we are
anticipating parts to begin arriving mid -November.
• The PKIMC elevator systems had to be reviewed by the TK Elevator mechanical
and electrical engineering team and have been realigned to meet the same
delivery date.
KFRC
Industrial Pump Alaska order is moving forward. The delivery schedule was
updated to include a contractor site visit to the manufacturing facility to conduct
the QA/QC of the pump test prior to shipment. The new shipment date is
December 18th.
KFRC Ozonator (Decontamination) project has been reviewed and is ready to be
advertised for bid. Discussions with the State of Alaska are occurring regarding
the current requirements, and we will be requesting an extension in September
for the 2026 construction season.
No movement on these GSA items:
GSA has had a reduction in force, we are awaiting response of who will be our
new GSA contact.

• Staff continues to wait for a request for additional electrical circuits have been
priced for GSA consideration to accommodate additional chillers for NOAA.
Project to be funded on the next fiscal year's budget. This project will be
postponed due to the lack of funding. The bidder has been notified.
Landfill
• Regional Solid Waste Management Plan
Both KIB and KANA staff have been actively coordinating with the contractor to
gather data for the report and collaborating on distribution of the surveys to the
public. KIB Staff have also received a preliminary draft of the updated plan.
Kodiak Landfill Waste Characterization has concluded. The contractor
team's goal was 15 samples; they were able to sort 23!
Village Waste Characterization: Port Lions is completed. Old Harbor is
underway.
Community Surveys are being dispersed via social media, newspaper,
email, and flyers posted around town.

SUBJECT: Contract No. FY2026-03, Surface Water Monitoring Plan Sampling And
Reporting With Shannon & Wilson, Inc.

RECOMMENDATION:
Move to authorize the Borough Manager to execute Contract No. FY2026-03 for the Surface
Water Monitoring Plan Sampling and Reporting with Shannon & Wilson, Inc.
DISCUSSION:
The Kodiak Island Borough maintains a Solid Waste Disposal Permit the Landfill and
Leachate Treatment Plant, which requires bi-annual surface water sampling and reporting to
the State of Alaska in accordance with the approved Surface Water Monitoring Plan. In the
past, this work was coordinated and executed by the Borough's Environmental Specialist and
Leachate Treatment Staff. To align with best practices used by other municipalities across the
state, the Borough has chosen to advertise this work through a formal Request for Proposals
(RFP) process. Hiring a third -party contractor to perform the sampling and prepare the
required reports for submission to the Alaska Department of Environmental Conservation
ensures consistency, objectivity, and compliance with permit requirements, while also
allowing the Borough staff to focus on operational responsibilities.
A Request for Proposals (RFP) was issued on July 1, 2025, with a due date of August 4,
2025. Four (4) proposals were received from the following firms (listed alphabetically):
• BEM Systems, Inc.
• ChemTrack Alaska, Inc.
• Jacobs Project Management Co.
• Shannon & Wilson, Inc.
The evaluation committee consisted of the Kodiak Island Borough Landfill Supervisor,
Leachate Treatment Plant Lead & Trainee, one Assembly Member, and the Chairman of the
Architectual Review Board. All proposals along with a blank rubric sheet were provided to all
evaluators electronically by email and a OneDrive link was provided with a copy of all
proposals to be evaluated. All evaluators submitted their scores to the Engineering and
Facilities Department, which were compiled and averaged on a excel spreadsheet. Based on
these scores, Shannon & Wilson, Inc. had the highest cumulative average score.
ALTERNATIVES:
1. Take no action.
2. Reject all proposals.

This addendum forms part of and modifies the contract documents as noted below. Bidders must
acknowledge receipt of this addendum in the space provided on the Acknowledgement of Addenda form.
Failure to do so may submit Bidder to disqualification.
This addendum consists of 5 pages total including 3 pages with questions and answers and one attachment
with 2 pages (cost spreadsheet). The cost spreadsheet will be provided to all registered bidders and posted
online as an excel version for ease of use.
RESPONSES TO BIDDER QUESTIONS:
QUESTION 1: Will there be any additional effort required for the option years?
RESPONSE 1: Not that we are aware of at the moment. If an additional year is awarded, it will include
the same scope of work outlined in this RFP.
QUESTION 2: Will pricing for the optional years be requested with this proposal, or will those years be
negotiated later at the time of the option?
RESPONSE 2: The optional years will be negotiated at the time of the option.
QUESTION 3: The workplan includes a specific list of water quality monitoring equipment; is this equipment
that Kodiak owns and will provide on -site, or will we include costs to bring our own equipment?
RESPONSE 3: Firms intending to bid should include cost to bring their own equipment.
QUESTION 4: Is this firm -fixed price or time and materials/not to exceed contract/ If it is firm -fixed price,
will the request for rates be dropped?
RESPONSE 4: This will be a lump sum per occurrence contract. Please provide the lump sum cost for
each sampling event to include all elements required to complete the scope of work. Please use the
attached worksheet to submit your cost proposals. In the event that additional sampling is required by
ADEC and is not the fault of the successful firm, the additional sampling will be negotiated based on
the time and materials required to satisfy the ADEC requirements.
The fee schedule on page 7 of the RFP is excluded from the proposal documentation requirements.
QUESTION 5: Will the proposing firm be required to use the current laboratory or will they be allowed to
choose their own?
RESPONSE 5: No, the successful firm will not be required to use Kodiak Island Borough's current
laboratory. However, they are required to have the samples analyzed at a laboratory that is certified by
ADEC or an approved NELAP certified laboratory as outlined in the KIB SWMP (2023), Section 4.16,
Laboratory Quality Assurance.

QUESTION 6: What will be the review process for the drafts of the report?
RESPONSE 6: Please see the proposed schedules for drafts, reviews, and submissions.
The Exceedance Report drafts: if an exceedance is present in the sampling, are required to be provided
to the Borough within seven (7) days after receiving the analytical data from the laboratory and the
Borough will be required to return the document with comments within three (3) days. Final submission
to the ADEC will be completed by the successful firm within fourteen (14) days of the identification of
the exceedance, and the Borough will be copied on the submittal.
The Surface Water Monitoring Report: will be provided to the Borough sixty (60) days after the sampling
event for review and comments. The Borough will return the draft with comments within fourteen (14)
days. Final submission to the ADEC will be completed by the successful firm within ninety (90) days of
the sampling event, and the Borough will be copied on the submittal.
Please Note: Any updates issued by the ADEC to the report submission method (email, web portal, or
mail), that may not be updated yet in the SWMP, should be observed to ensure ADEC receipt.
QUESTION 6: Have the parameters of testing changed at all throughout the years?
RESPONSE 6: Not, that we remember. If there are changes, it would be due to a regulation change.
If any regulations changes occur during the time of this contract, it will be addressed at that time.
QUESTION 7: Are we correct in assuming the period of this contact covers sampling beginning April 2026
or rather starting in October 2025?
RESPONSE 7: The term of this contract is anticipated to start in the fall of 2025, for the sampling
event in October 2025. Following the fall -spring schedule, allows the contract to follow our fiscal year
cycle.
QUESTION 8: Are the sampling locations accessible by truck or would the field sampling team need to
travel by foot to some of the sample locations?
RESPONSE 8: Some are accessible by road/vehicle. Others would require some hiking, travel by
foot (longest walk would be approximately 300 yards).
QUESTION 9: If the field sampling team would need to hike to some of the sample locations, would KIB
landfill staff be able to assist with bear watch? Or should that be included in the cost?
RESPONSE 9: During April and October, the risk of bears is lower due to the hibernation habits of
the bears but please include that bear watch duties within your costs. KIB Staff may not be available
during the sampling event dates or times.

which is decontaminated between samples be allowed?
RESPONSE 10:
The well heads are 2" (two inch) pipe and we do not think a submersible pump would fit inside
The KIB SWMP (2023), Section 4 Sampling Plan and Quality Assurance Program, states the
paragraph below, and is also referenced in section 4.6 Decontamination of Sampling Equipment,
section 4.10 Surface Well Sampling, and on the KIB Landfill Monitoring Procedures form:
"Surface well samples will be taken using a peristaltic pump with dedicated tubing; stream
surface water samples will be collected as grab samples directly from the stream..."
The verbiage of "will be" in the section referenced above and the multiple references throughout the
SWMP solidifies that the use of the peristaltic pump is a requirement per KIB's SWMP (2023).

The Kodiak Island Borough (Borough) is requesting proposals from qualified contractors for the
execution of all activities associated with the Landfill Surface Water Monitoring Sampling Event as
outlined in the Kodiak Island Borough (KIB) Landfill Surface Water Monitoring Plan

SCOPE OF WORK
A. Introduction.
The Borough desires to contract with a responsible contractor or firm to execute of all activities
associated with the Landfill Surface Water Monitoring Sampling Events as outlined in the Kodiak
Island Borough (KIB) Landfill Surface Water Monitoring Plan [Exhibit A].
B. Background.
The Borough is experiencing a change in staffing and is in need of a contractor or firm to assist in
providing services and support to continue compliance with the regulatory requirements of the
Landfill Surface Water Monitoring Sampling Plan. For more information, please see Section 2
Project Background in the KIB Landfill Surface Water Monitoring Plan [Exhibit A].

C. Scope of the Project.
The Borough is seeking a qualified and experienced individual or firm to:
Execute of all activities associated with the Landfill Surface Water Monitoring Sampling Event as
outlined in the Kodiak Island Borough (KIB) Landfill Surface Water Monitoring Plan. Work is to
be completed once in April and October with a 1-month variance allowed.
The scope of work includes the planning, coordination, field sampling, quality assurance/quality
control (QA/QC), data analysis, and reporting tasks necessary to ensure compliance with the
requirements established in the Monitoring Plan.
All tasks will be completed in accordance with the procedures and timelines detailed in the KIB
Landfill Surface Water Monitoring Plan. This includes, but is not limited to:
Pre -sampling coordination and site preparation
o Identifying laboratory accreditation
o Bottle ordering
o Verifying equipment type and calibration requirements
o Coordinating with KIB staff for sampling dates
• Collection of water samples at designated monitoring locations
o Adherence to approved sampling methodologies and safety protocols

o Appropriate duplicates and MS/MSD samples
o Completing infield documentation (field forms/field notebook)
• Proper handling, labeling, and shipment of samples to a certified laboratory

within 14 days of receiving the analytical data from the laboratory. See Section SC 04
Documentation for additional timeline requirements.
• Final report following the Alaska DEC Surface Water Monitoring Report Checklist document
o Report will be submitted to ADEC within 90 days of the monitoring event and will
include data from the initial and any resampling events electronically. See Section SC
04 Documentation for additional timeline requirements.
Exceedance report drafts will be provided to the Borough 7 days after receiving the analytical data
from the laboratory. KIB will return document with comments within 3 days. Final submission to
the ADEC will be completed by the contractor and the KIB will be copied on submittal.

sampling event for review and comments. KIB will return document within 14 days. Final
submission to the ADEC will be completed by the contractor and the KIB will be copied on
submittal.
This work is critical to ensuring the Borough's continued compliance with regulatory requirements
and to provide a clear understanding of surface water conditions at the site.
The consultant may propose additional tasks deemed appropriate to complete the project.

Respondents should allow adequate time for mailing or special delivery of proposals. Kodiak is
considered a remote location and, as such, mail and special deliveries by couriers such as UPS or
FedEx are commonly delayed beyond the advertised guaranteed arrival of carriers and couriers due
to local weather and flight schedules.
C. Submittal Amendment and Withdrawal.
After depositing a proposal, a Proposer may withdraw, modify, or correct that proposal providing
that the designated representative of the Borough receives the request for such withdrawal,

modified by such written communication, will be considered as the proposal. No changes may be
submitted after the deadline unless specifically requested by the Borough. Any proposal not so timely
withdrawn shall constitute an irrevocable offer, for a period of 90 days to sell to the Kodiak Island
Borough the services described in the attached specifications, or until one or more of the proposals
have been approved by the Kodiak Island Borough, whichever occurs first.
PROPOSALS OR MODIFICATIONS THAT DO NOT ADHERE TO THE ABOVE
INSTRUCTIONS WILL NOT BE ACCEPTED OR OPENED FOR EVALUATION.
EVALUATION AND SELECTION
Selection of a proposal and execution of any agreement for services will be accomplished in accordance
with the Kodiak Island Borough policies and procedures. Proposal contents will remain confidential
until a contract is awarded, subject to subsection F of this section permitting limited release of the
successful proposal after a Notice of Intent to Award. The Borough will select an individual or firm to
provide the services requested according to the following:
A. Minimum Qualifications.
To be considered for selection, Proposers must meet at least the following minimum
qualifications:
• The contractor or firm shall obtain all licenses and permits that are required to do the work.
• All key personnel shall be credentialed for sampling by Alaska Dept. of Environmental
Conservation.
A Proposer's failure to meet these minimum requirements shall cause their proposal to be
considered non -responsive and their proposal eliminated from further consideration.

D. Preliminary Selection.
Based upon an evaluation of the above criteria, the Borough may select a short list of up to three
(3) individuals or firms for a more in-depth evaluation, reference checks and possible interviews.
The Borough reserves the right to use interviews for negotiations to clarify and assure full
understanding of the requirements of the request for proposals and to obtain last and best offers

as permitted in KIBC 3.30.110(E)
E. Final Selection.
The Borough will select the preferred individual or firm by considering any factors it deems
necessary and proper for best value, including price, quality of service, responsiveness to this
Request for Proposals, and the general reputation and experience of the respondents. The
Borough reserves the right to cancel the procurement without liability to any proposer, other
than return of any proposal security, at any time before the Agreement has been signed by all
parties, including the Borough.
F. Notice of Intent to Award.
A notice of intent to award will be sent to each Proposer, notifying them of the recommended
selection. After a notice of intent to award has been made a Proposer may receive, on written
request, the summary rating for their proposal. The proposal recommended for award, and the
summary rating for that proposal, will be made available to the public on the Assembly Meeting
Agenda for the date it is to be awarded (www.kodiakak.us). may be made available on written
request after a contract has been entered into. Information identified in a proposal as confidential
proprietary information will be redacted prior to release of that proposal and will not be released.
G. Protest.
Any Proposer may protest the selection by filing a written protest with the Borough Manager
within ten (10) calendar days of the issuance of the notice of intent to award. A protest must
identify a material defect in the procurement process. Disagreement with the ratings is not a
sufficient basis for a protest. Failure to file a timely protest waives the opportunity to protest an
award. If a timely protest is filed, the administrative review process will begin, and a final
administrative decision will occur within thirty (30) working days of the receipt of protest.
CONTRACT
The contract shall be awarded by the Manager or Assembly, as applicable under the Borough
Code, based upon the Borough's standard professional services contract form (Attachment B),
to the individual or firm which, in the Borough's sole judgment, is best suited to perform the
services required. If a protest has been filed, the contract award may be postponed until the
protest is resolved. If the time for protest has not yet expired, the contract may be awarded
conditioned on either no timely protests or resolution of any protests in a manner which allows
the award to stand.
Before execution of a contract, the successful bidder or Proposer must have a current State of
Alaska business license; and must be in good standing in terms of all taxes, fees, and monies due
to the Borough.
INSURANCE REQUREMENTS
Throughout the term of the Contract, the selected respondent and/or any and all subcontractors
retained by the respondent shall maintain in force at their own expense, and provide to the
Borough evidence of insurance as follows:

Workers' Compensation: As required by AS 23.30.045, for all employees of the Consultant
engaged in work under this Contract. The Consultant shall be responsible for Worker's
Compensation Insurance for any subconsultant who performs work under this Contract. The
coverage shall include:
1. Employer's Liability Protection at $1,000,000 each accident/each employee and
a $1,000,000 policy limit.
Commercial General Liability: On an occurrence policy form covering all operations with
combined single limits not less than:
1. $2,000,000 Each Occurrence;

to do so. KIB shall not be responsible for costs incurred by proposers for proposal

E. Right to Reject Proposals
The Kodiak Island Borough reserves the right to reject any or all proposals and to waive any
informality or technicality in the interest of the Borough.
a. The Kodiak Island Borough reserves the right to request clarification of information
submitted, and to request additional information on any proposal.
b. The Kodiak Island Borough may award a contract on the basis only of written proposals
received, without requesting clarification, discussions, or a best and final offer.
Therefore, each proposal shall contain the Proposer's best terms from cost/price and
technical standpoints.
F. Disqualification
Factors such as, but not limited to, the following may disqualify a proposal without further
consideration:
a. Evidence of collusion among respondents.
b. Any attempt to improperly influence any member of staff or Assembly.
c. A respondent's default under any type of agreement, which resulted in the termination
of that agreement.
d. Existence of any unresolved litigation between the respondent and the KIB.
G. Proposal Withdrawal and Correction
A proposal may be corrected or withdrawn by a written request received prior to the deadline for
receipt of proposals.
H. Retention of Proposals
All proposals and other material submitted become KIB property and may be returned only at KIB's
option.
I. Cost of Proposal Preparation
The Borough shall not be responsible for proposal preparation costs, nor for costs including attorney
fees associated with any (administrative, judicial, or otherwise) challenge to or protest of the award
of contract and/or rejection of proposal. By submitting a proposal each Proposer agrees to be bound
in this respect and waives all claims to such costs and fees.
J. Delivery of Proposals
KIB assumes no responsibility or liability for the transmission, delay, or delivery of proposals by
either public or private carriers.
K. Compliance with Laws
The proposer shall observe and abide by all applicable laws, regulations, ordinances and other rules
of the State of Alaska and/or any political subdivisions thereof, or any other duly constituted public
authority wherein work is done, or services performed, and further agrees to indemnify and save the
Borough harmless from any and all liability or penalty which may be imposed or asserted by reason
of the Contractor's failure or alleged failure to observe and abide thereby.
L. Media Announcements
Any and all media announcements pertaining to this solicitation require prior written approval by
the Borough Manager.

M. Acceptance of Conditions
Submission of a proposal indicates acceptance by the individual or firm of the conditions contained
in this Request for Proposals unless clearly and specifically noted in the proposal submitted and
confirmed in the contract between the Kodiak Island Borough and the individual or firm selected.
N. Binding Contract
This solicitation does not obligate KIB or the selected proposer until a contract is signed and
approved by all parties.
O. Disposition of Proposals
All materials submitted in response to this RFP become the property of the Borough. One copy shall
of the submitted material shall be retained for the official files and will become public record after
award of the contract. Should a Proposer claim that a Proposal contains confidential proprietary
information the proposer shall identify any such information at submission of Proposal and request
that it be held as confidential or returned. The Borough is not responsible for release of proprietary
information not identified by the Proposer.

water sampling and reporting. The overall purpose of the KIB Landfill Surface Water Monitoring Plan (LSWMP) is to monitor water quality at
the active KIB Landfill for compliance with permit and regulatory conditions and to identify impacts to surface water associated with the site.
The LSWMP is comprised of semi-annual leachate, surface well water, and stream surface water quality monitoring.

DAN P. MCMAHON, PMP Responsibilities: Dan will serve as Contract Manager for this contract, responsible for senior contract oversight,

Principal in Charge Sampling and Reporting objectives and requirements, and providing officer documents review prior to submittal to

Qualifications/Past Relevant Experience: As the Manager of Shannon & Wilson's Anchorage Environmental Group

experienced in all aspects of water quality monitoring, having performed field sampling, reporting, and management

JUDY HEPNER Responsibilities: As the Project Manager, Judy will be responsible for implementing the LSWMP, providing hands-on
Project Manager services as well as delegation of tasks to key project staff, coordinating with subcontract analytical laboratories; and
technical review of all elements of field work, data assessment and interpretation, and reports prior to submittal to KIB
Iand the Alaska Department of Environmental Conservation (DEC). Judy will conduct day-to-day oversight of contract
needs including direct communication with the KIB Contract Administrator. Through her institutional knowledge of
landfill water quality monitoring programs, Judy will ensure conformance during sampling events and reporting efforts.
She will prepare status reports, track the project schedule such that sampling is conducted and deliverables submitted
on time, and conduct a monthly budget analysis. Specifically, Judy will be responsible for environmental support; surface
water and leachate; data management and evaluation; statistical evaluation; and technical reports.
Education: BS, Civil Engineering with Bio-Resources Emphasis, Montana State University, Bozeman, 2003. Qualifications/Past Relevant Experience:
Judy brings extensive landfill water quality monitoring program experience to this contract. Through her project management of the MOA, MSB, KPB,
and City of Unalaska landfill monitoring programs, Judy is experienced in each aspect of landfill water quality management and field monitoring,
including gas, surface water, groundwater, and leachate sampling, report preparation, statistical analyses, data validation and interpretation,
and database management. She has developed problem -solving skills from her vast field experience, providing her with the capability to tackle
problems on the spot without shutting down sampling efforts. Her technical writing skills include consolidating analytical data, applying statistical
methods, and interpreting results. Judy is experienced with a variety of statistical methods, as required by 18 Alaksa Administrative Code (AAC)
60.830. In addition, she manages multiple landfill databases and inputs EDDs of validated lab analytical results into several database platforms.
She is an active member of the Solid Waste Association of North America (SWANA) and earned certification as a SWANA Certified Manager
of Landfill Operations (MOLO) in 2025. Judy regularly interacts with other SWANA members including representatives from state and federal
agencies, landfill operators, and other environmental professionals sharing the common goal of responsible management of solid waste as a
resource. Judy keeps current with industry trends and issues, local and statewide standards of practice, and regulatory compliance. Years of

• Provide the labor, equipment, supplies, and instrumentation needed to successfully complete the semi-annual sampling activities following the
monitoring procedures outlined in the LSWMP.

The semi-annual monitoring events will typically be conducted in April and October. Prior to each monitoring event, field staff will review the
LSWMP, check whether equipment is functioning correctly and calibrate the instruments according to the manufacturer's instructions, coordinate
with landfill staff and the project laboratories, and check the bottles provided by the laboratory. Surface water, leachate, MS/MSD, and duplicate
samples will be analyzed for the parameters listed in Tables 3 and 4 and Appendix B-1 of the LSWMP. It is anticipated that all samples will be
collected in one day. If sampling occurs over 2 days, stream surface water and leachate samples will be collected on the first day of sampling and
the surface water well samples will be collected on the second day. Field water quality monitoring equipment will be calibrated at the beginning of
each day in the field. Samples will be shipped via Alaska Airline's Goldstreak to the contract laboratory for analysis.
SURFACE WATER WELL SAMPLING
Static water level and total well depth will be measured prior to sampling. A peristaltic pump and disposable or dedicated tubing will be used to
collect three surface water well samples and one duplicate sample. Field parameters will be collected prior to collecting samples. Due to the low -
recharge rate of wells, stabilization of the field parameters is not required prior to collecting the samples.
STREAM SURFACE WATER SAMPLING
Three stream surface water samples and an MS/MSD sample will be collected within 1-foot upgradient of piezometers marking the pre -established
sampling locations. First field parameters will be measured by holding the field probes in the stream flow at the sample location for a minimum of
two minutes or until the readings have stabilized. The samples will then be collected by slowly lowering sample containers directly into the stream.
LEACHATE SAMPLING
A primary and duplicate leachate sample will be collected by lowering a bucket attached to a rope into Manhole C. All rinse water associated with
leachate sampling will be disposed of into the Manhole C at the completion of sample collection. To prevent cross -contamination, the leachate
samples will be packaged and shipped in a separate cooler than the surface water samples.
REPORTING
Shannon & Wilson will prepare a surface water monitoring report following each monitoring event. We understand the importance of timely
submittal to meet permit requirements; therefore, we will strive to review the results within three days of receipt of the analytical sample results.
Analytical detections in well and stream surface water will be compared to the most recent Alaska Water Quality Standards (WQS) as listed in
Technical Memorandum Surface Water Standards Table. If any of the parameters are found to exceed the WQS, a draft exceedance report will be
submitted to the KIB within seven days of receiving the laboratory reports. Upon receiving KIB's comments, Shannon & Wilson will submit the final
report to KIB and DEC within 14 days of receiving the laboratory reports.
Shannon & Wilson will also submit a draft Surface Water Monitoring Report to KIB within 60 days of the sampling event. Upon receiving KIB's
comments, Shannon & Wilson will submit the final report to KIB and DEC within 90 days of completing the sampling event. Each monitoring event
report will include the following:
• Narrative of field activities and notable anomalies.
• Field note forms.
• Tabulated analytical results and copies of the laboratory reports including chain -of -custodies.
• Quality assurance documentation.
• A site plan showing sample locations.
In cases where WQS do not exist, a trend analysis will be conducted to evaluate whether concentration trends indicate that the landfill is causing
an increase in the parameter, as required in the LSWMP.
We also understand that it may be necessary to interact with the DEC or other agencies to respond to concerns or inquiries regarding reports,
regulatory interpretation and compliance, and leachate disposal. We will be available, as needed, to support KIB with interactions with the
regulatory agencies.

In addition to water quality monitoring, Shannon & Wilson is available to assist KIB with your permitting, stormwater, groundwater, and landfill
gas requirements, as well as updating the existing LSWMP Manual. We are also available to provide additional site monitoring, installation and
decommissioning of wells, and other professional environmental services that may arise.
3. SUBCONTRACTORS
Shannon & Wilson will contract two DEC -approved and/or National Environmental Laboratory Accreditation Program (NELAP) certified analytical
laboratories for the analysis of the samples. The laboratory certifications will be maintained throughout the duration of the contract. Our primary
laboratory will be Eurofins Environment Testing (Eurofins) of Tacoma, Washington and SGS North America, Inc. (SGS) of Anchorage will be
responsible for analyses of samples with short hold times.

Our ongoing landfill monitoring projects exhibit a wide range of physical characteristics, monitoring and data evaluation requirements, and
technical access and sample collection challenges, which have necessitated a thorough understanding of applicable solid waste regulations. For
over 30 years, we have been providing a multitude of environmental, permitting, and geotechnical services to support landfills throughout Alaska.
QUALIFICATIONS
As the current consultant providing landfill monitoring services for multiple active Alaska Class I Landfills and other smaller active and closed
landfills, we are confident that we can provide the KIB with numerous unique benefits. Several of our firm's most tangible qualifications are listed
below and described in detail throughout this proposal.

Shannon & Wilson was initially contracted by the City of Unalaska in 2006 to provide statistical analysis and reporting services for the Unalaska
Landfill (UNL), a Class I landfill. Shannon & Wilson's UNL water quality monitoring contract has been renewed each year since based on the client's
favorable review of work performed to date.
Based on a detailed assessment of the historical site data and hydrogeologic site conditions, Shannon & Wilson successfully petitioned the
DEC to replace the groundwater detection monitoring program with a surface water monitoring program. This change eliminated the need for
implementing an expensive groundwater assessment monitoring program. Shannon & Wilson manages and implements the semi-annual surface
water monitoring program, which includes water quality monitoring, sampling, and analysis; statistical evaluation; database management data;
and reporting.
Other value-added services we have provided for the City of Unalaska include:
• Prepared a Quality Assurance Project Plan (QAPP) which incorporated leachate, gas, surface water, and stormwater sampling procedures into
a single document.

Shannon & Wilson has conducted the landfill monitoring program for MOAfrom 2000 to 2005 and from 2017 to present. Under our current contract,
we perform water quality and leachate sampling, reporting, and other related services for the Anchorage Regional Landfill (ARL), International
Airport Landfill (IAL), Merrill Field Landfill (MFL), Peters Creek Landfill (PCL), and the Central Transfer Station (CTS). The base landfill monitoring
tasks consist of water monitoring at over 40 locations distributed among the four landfill sites. In addition, we collect leachate samples monthly
at the ARL and MFL.
Water quality data are summarized in sampling reports following each monitoring event. Data reports include statistical analyses of ARL data,
which is comprised of approximately 20,000 sample results. In addition, leachate letter reports are prepared following each sampling event to
meet the Anchorage Water and Wastewater Utility (AWWU) Permit monitoring requirements..
In addition to the base landfill monitoring tasks, Shannon & Wilson has performed the following landfill -related services for MOA SWS:
• Statistically evaluated long-term trends and seasonal variability to successfully petition the DEC for monitoring frequency reduction from
quarterly to semi-annual at ARL.
• Prepared an updated LWQMP manual to reflect the DEC -approved semi-annual ARL monitoring program.
• Evaluated ARL stormwater discharge system resulting in termination of need for permit coverage and elimination of annual stormwater sampling.
• Updated the SWPPP for CTS.
• Updated the SPCC Plans for ARL and CTS.
• Conducted site characterization, including advancing soil borings and installing groundwater monitoring wells at CTS to evaluate a release from
an underground storage tank (UST).
• Conducted sludge sampling from a leachate lagoon at ARL.
Shannon & Wilson has been conducting the landfill monitoring program for the MSB since 1999. The current MSB landfill monitoring program
entails quarterly groundwater monitoring at the closed Smith Ballfield (SBF) and semi-annual groundwater monitoring at the active Central Landfill
(CLF) and the closed Butte (BLF) and Big Lake (BLLF) Landfills. In addition, methane gas monitoring is conducted at BLF and SBF, and drinking
water wells are sampled at BLF and SBF. The base MSB landfill monitoring tasks include water monitoring at over 30 locations distributed among
the four landfill sites. Sampling reports are prepared for each landfill monitoring event. The reports include trend evaluations, time series plots,
data validation, and statistical analyses of CLF and SBF data.
In addition to the base landfill monitoring tasks, Shannon & Wilson has provided the following landfill -related services for MSB:
• Prepared QAPPs for each of the four landfills to reflect the current monitoring programs.

Shannon & Wilson has provided KPB with landfill water monitoring and related services at eight landfills, including Central Peninsula Landfill (CPL),
Homer Solid Waste Facility (HSWF), Rocky Ridge Landfill (RRL), Seward Monofill (SMF), Sterling Special Waste Site (SSWS), Seldovia Landfill (SLF),
Seward Landfill (SwdLF), and Kenai Landfill (KLF), since 1994. The KPB landfill contract includes permitting assistance, developing site -specific
QAPPs, monitoring groundwater elevations, collecting water samples from wells and surface water bodies, leachate sampling, coordinating
analytical testing, data validation and compilation, statistical analyses, database management, and reporting. The current KPB landfill monitoring
sampling tasks consist of water monitoring at 28 locations distributed among CPL, HSWF, RRL, and SMF.
This contract also entails tasks beyond the base scope to streamline the monitoring programs and ensure regulatory compliance. Shannon &
Wilson's staff conducted regular communication with the DEC and KPB to establish a common vision of programmatic objectives and to create the
framework for evaluating the individual site programs. Examples of these services include:
• Prepared project -specific QAPPs for the landfills to reflect the current monitoring programs.
• Developed statistical algorithms and coordinated with the DEC to select the methods most appropriate for the individual sites.

Chris joined Shannon & Wilson's Anchorage office Environmental Services group in 2020. He has eight
years of experience conducting a variety of environmental services including Phase I Environmental
Assessments (ESAs), Phase II ESAs, soil sampling, groundwater sampling, soil borings, incremental
sampling methodology, soil vapor sampling, preparing proposals and work plans, and reporting. His
projects have been located throughout Alaska.

MOA LANDFILL WATER QUALITY MONITORING PROGRAM I ANCHORAGE, AK
Environmental Staff. Chris has been providing sampling services for this ongoing term contract, monitoring
water quality at the MOA's Anchorage Regional Landfill (ARL), Peters Creek Landfill (PCL), Merrill Field
Landfill (MFL), and the International Airport Road Landfill (IAL). He has also collected monthly leachate
samples from AFL and MFL leachate pump stations.
MSB LANDFILL WATER QUALITY MONITORING PROGRAM I MATANUSKA-SUSITNA BOROUGH, AK
Environmental Staff. Chris has been providing sampling services for this ongoing term contract to monitor
groundwater quality at the MSB's Central Landfill (CLF), Big Lake Landfill (BLLF), Butte Landfill (BLF),
and Smith Ballfields (SBF). Sampling and reporting are conducted in accordance with Environmental
Protection Agency (EPA) and Alaska Department of Environmental Conservation (ADEC) regulations
governing solid waste facilities.

Zach joined Shannon & Wilson in 2020 and is a Geologist Professional II. His responsibilities include field
activities, data management and evaluation, database research, technical writing, and final preparation of
reports for a variety of environmental projects located throughout Alaska. Specific tasks included in field
activities include multi -phase site investigations, differential leveling site surveys, database research,
photoionization detection (PID) field screening, nuclear densometer field screening, gas monitoring on
hazardous sites, groundwater/soil sampling and groundwater monitoring well installation/development
and decommissioning in accordance with the Alaska Department of Environmental Conservation (ADEC)
regulations and guidance documents. Priorto joining Shannon & Wilson, Zach worked for Alaskan mining
companies as a resource development geologist proficient in logging hard rock cores and utilizing 3D
modeling software to interpret data.

PROFESSIONAL SERVICES AGREEMENT

for Landfill Surface Water Monitoring Plan Sampling and Reporting
This AGREEMENT, made and entered into this (Date) by and between the
KODIAK ISLAND BOROUGH, organized under the laws of the State of Alaska, hereinafter referred
to as the 'Borough" and Shannon & Wilson, Inc. a corporation authorized to do business in Alaska,
with offices located at 5430 Fairbanks Street, Suite 3, Anchorage, AK 99518, hereinafter referred to as
the "Consultant."
WITNESSETH
WHEREAS, the Borough wishes to enter into an agreement with an independent consultant to
Landfill Surface Water Monitoring Plan Sampling and Reporting; and
WHEREAS, Shannon & Wilson, Inc. submitted a proposal asserting it is qualified to perform
these services and able to do so in a timely manner.
NOW, THEREFORE, in consideration of the mutual promises and covenants contained herein,
the parties agree as follows:
1.0 DEFINITIONS
1.1 "Agreement" shall mean this Professional Services Agreement, including:
Attachment A — Shannon & Wilson, Inc. proposal dated August 4, 2025.
1.2 "Change Order" is an addition to, or reduction of, or other revision approved by the
Borough in the scope, complexity, character, or duration of the services or other
provisions of this Agreement.
1.3 'Borough" shall all mean the Kodiak Island Borough, Alaska.
1.4 "Contracting Officer" shall mean the KIB Borough Manager and include any successor
or authorized representative.
1.5 "Project" shall mean the Landfill Surface Water Monitoring Plan Sampling and
Reporting;
2.0 TERM OF AGREEMENT. This Agreement shall take effect upon execution. This Agreement
shall remain in full force and effect until the Project has been completed and further, until all
claims and disputes have been concluded. The work is considered complete when the Borough
has received and found acceptable the finished product of all work described in 4.0 Scope of
Services or changes thereto. This date is not necessarily the Completion Date as described in 5.0
Completion Date. This Agreement may be amended only in writing and upon compliance with
all applicable statutes, ordinances, and regulations.

3.0 FEES. For Landfill Surface Water Monitoring Plan Sampling and Reporting; as described
in 4.0 Scope of Services, the Borough will compensate the Contractor an amount not to exceed
$74,120.00
4.0 SCOPE OF SERVICES. The Borough and Consultant have agreed upon a scope of
work described in the Consultant's proposal, Attachment A, to provide professional
services based on approved standards and instructions, as specifically described in Exhibit A.
This Scope of Services can only be changed in writing pursuant to Section 26.0 of this
Agreement.
5.0 SCHEDULE FOR COMPLETION. Reserved.
6.0 PERSONNEL/ORGANIZATION
6.1 Key Personnel. Work and services provided by the Consultant will be performed by:
As specified in Attachment A.
6.2 Changes in Key Personnel. The Consultant shall give the Borough reasonable advance
notice of any necessary substitution or change of key personnel and shall submit
justification therefore in sufficient detail to permit the Borough to evaluate the impact
of such substitution on this Agreement. No substitutions or other changes shall be made
without the written consent of the Borough.
7.0 STANDARD OF PERFORMANCE. The Consultant agrees to provide all required
professional services to complete the project and any additions or changes thereto. The
Consultant accepts the relationship of trust and confidence established between it and the
Borough by this Agreement. The Consultant covenants with the Borough to furnish its best skill
and judgment, and to further the interest of the Borough at all times through efficient business
administration and management. The Consultant shall provide all services in a competent
manner. It is understood that some of the services to be rendered hereunder required professional
judgment and skill. In those cases, the Consultant agrees to adhere to the standards of the
applicable profession.
8.0 TIMELINESS OF PERFORMANCE. Time is of the essence in this Agreement. Consultant's
failure to meet any such deadlines or required performance may adversely imperil other
contractual obligations of the Borough.
9.0 COMPLIANCE WITH LAWS. The Consultant shall be familiar with and at all times comply
with and observe all applicable federal, state and local laws, ordinances, rules, regulations, and
executive orders, all applicable safety orders, all orders or decrees of administrative agencies,
courts, or other legally constituted authorities having jurisdiction or authority over the
Consultant, the Borough, or the service which may be in effect now or during performance of
the services.
10.0 INDEMNITY. The Consultant shall indemnify, defend, and hold harmless the Borough from
and against any claim of, or liability for, negligent acts, errors, and omissions of the Consultant
under this agreement, including attorney fees and costs. The consultant is not required to
indemnify, defend, or hold harmless the Borough for a claim of, or liability for, the independent

negligent acts, errors, and omissions of the Borough. If there is a claim of, or liability for, a joint
negligent act, error, or omission of the Consultant and the Borough, the indemnification, defense,
and hold harmless obligation of the Consultant, and liability of the parties, shall be apportioned
on a comparative fault basis. In this provision, "Consultant" and "Borough" include the
employees, agents, and contractors who are directly responsible, respectively, to each. In this
provision, "independent negligent acts, errors, and omissions of the Borough" means negligence
other than in the Borough's selection, administration, monitoring, or controlling of the
Consultant, or in approving or accepting the Consultant's work or the Consultant's
subcontractors.
11.0 INSURANCE. The Consultant understands that no Borough insurance coverage, including
Workers' Compensation, is extended to the Consultant while completing the services described
in this Agreement. The Consultant shall carry adequate (commercially reasonable coverage
levels) insurance covering Workers' Compensation, general public liability, automobile,
professional liability, and property damage including a contractual liability endorsement
covering the liability created or assumed under this Agreement. The Consultant shall not
commence work under this Agreement or any work on any phase of the Project until the
Consultant provides the Borough with certificates of insurance evidencing that all required
insurance has been obtained. These insurance policies and any extension or renewals thereof
must contain the following provisions or endorsements:
a. Borough is an additional insured thereunder as respects to general liability arising
out of or from the work performed by Consultant of Borough.
b. Borough will be given thirty (30) days prior notice of cancellation or material
alteration of any of the insurance policies specified in the certificate.
c. Insurer waives all rights of subrogation against Borough and its employees or
elected officials.
d. The insurance coverage is primary to any comparable liability insurance carried by
the Borough.
Upon request, Consultant shall permit the Borough to examine any of the insurance policies
specified herein. Any deductibles or exclusions in coverage will be assumed by the Consultant,
for account of, and at the sole risk of the Consultant.
The minimum amounts and types of insurance provided by the Consultant shall be as set forth
in this agreement, subject to revision at the Borough's request in order to provide
continuously throughout the term of the Agreement a level of protection consistent with good
business practice and accepted standard of the industry.
12.0 GOVERNING LAW. The laws of Alaska will determine the interpretation, performance and
enforcement of this Agreement.
13.0 OWNERSHIP OF WORK PRODUCTS. Payment to the Consultant for services hereunder
include full compensation for all work products and other materials produced by the Consultant
and its subcontractors pertaining to this Agreement.
The originals of all material prepared or developed by the Consultant or its employees, agents,
or representatives hereunder, including documents, drawings, designs, calculations, maps,

sketches, notes, reports, data, models, computer tapes, and samples shall become the property of
the Borough when prepared, whether delivered or not, and shall, together with any materials
furnished the Consultant and its employees, agents, or representatives by the Borough hereunder,
be delivered to the Borough upon request and, upon termination or completion of this
Agreement. Materials previously created and copyrighted by the Consultant included in this
project will remain property of the Consultant. Copies will be made available to the Borough
upon request. Materials purchased from and copyrighted by third parties are not included in this
provision.
14.0 PATENTS, TRADEMARKS, AND COPYRIGHTS. The Consultant agrees to defend,
indemnify, and save the Borough harmless from and against any and all claims, costs, royalties,
damages and expenses of any kind of nature whatsoever (including attorneys' fees) which may
arise out of or result from or be reasonably incurred in contesting any claim that the methods,
processes, or acts employed by the Consultant or its employees in connection with the
performance of services hereunder infringes or contributes to the infringement of any letter
patent, trademark, or copyright. In case such methods, processes, or acts are in suit held to
constitute infringement and use is enjoined, the Consultant, within reasonable time and at its
own expense, will either secure a suspension of the injunction by procuring for the Borough a
license or otherwise, or replace such method, process, etc., with one of equal efficiency.
15.0 NONWAIVER. No failure of the Borough or Consultant to insist upon the strict performance
by the other of any of the terms of this Agreement or to exercise any right or remedy herein
conferred, shall constitute a waiver or relinquishment to any extent of its rights to rely upon such
terms or rights on any future occasion. Each and every term, right, or remedy of this Agreement
shall continue in full force and effect.
16.0 SAFETY/PERFORMANCE. The Consultant shall perform the work in a safe and
workmanlike manner. The Consultant shall comply with all federal and state statues, ordinances,
orders, rules, and regulations pertaining to the protection of workers and the public from injury
or damage and shall take all other reasonable precautions to protect workers and the public from
injury or damage.
17.0 SUSPENSION OR TERMINATION.
17.1 Fault Termination or Suspension. This Agreement may be terminated by either party
upon ten (10) days written notice if the other parry fails substantially to perform in
accordance with its terms. If the Borough terminates this Agreement, it will pay the
Consultant a sum equal to the percentage of work completed and accepted by the
Borough that can be substantiated by the Consultant and the Borough, offset by any
amounts owed to the Borough. However, within the ten (10) day Notice of Intent to
terminate the party in default shall be given an opportunity to present a plan to correct
its failure.
17.2 Convenience Suspension or Termination. The Borough may at any time terminate or
suspend this Agreement for any reason including its own needs or convenience. In the
event of a convenience termination or suspension for more than six (6) months, the
Consultant will be compensated for authorized services and authorized expenditures
performed to the date of receipt of written notice of termination or suspension. No fee
or other compensation for the uncompleted portion of the services will be paid, except
for already incurred indirect costs which the Consultant can establish, and which would
have been compensated but because of the termination or suspension would have to be

absorbed by the Consultant without further compensation.
17.3 Activities Subsequent to Receipt of Notice of Termination or Suspension. Immediately
upon receipt of a Notice of Termination or suspension and except as otherwise directed
by the Borough or its Representative, the Consultant shall:
a. stop work performed under this Agreement on the date and to the extent specified
in the Notice; and
b. transfer title to the Borough (to the extent that title has not already been transferred)
and deliver in the manner, at the times, and to the extent directed by the Borough's
representative, work in progress, completed work, supplies, and other material
produced as a part of, or acquired in respect of the performance of the work
terminated or suspended by the Notice.
18.0 EQUAL EMPLOYMENT OPPORTUNITY. The Consultant shall not discriminate against
any employee or applicant for employment because of race, religion, color, national origin, or
because of age, physical handicap, sex, marital status, change in marital status, pregnancy, or
parenthood when the reasonable demands of the position do not require distinction on the basis
of age, physical handicap, sex, marital status, changes in marital status, pregnancy, or
parenthood. The Consultant shall take affirmative action required by law to ensure that
applicants are employed and that employees are treated during employment without regard to
their race, color, religion, national origin, ancestry, age, or marital status.
19.0 NO ASSIGNMENT OR DELEGATION. The Consultant may not assign, subcontract or
delegate this Agreement, or any part of it, or any right to any of the money to be paid under it
without written consent of the Contracting Officer.
20.0 INDEPENDENT CONSULTANT. The Consultant shall be an independent Consultant in the
performance of the work under this Agreement and shall not be an employee or agent of the
Borough.
21.0 PAYMENT OF TAXES. As a condition of performance of this Agreement, the Consultant
shall pay all federal, state and local taxes incurred by the Consultant and shall require their
payment by any other persons in the performance of this Agreement.
22.0 PRECEDENCE AND DIVISIBILITY. The provisions of this Agreement shall fully govern
the services performed by the Consultant. If any term, condition, or provision of this Agreement
is declared void or unenforceable, or limited in its application or effect, such event shall not
affect any other provisions hereof and all other provisions shall remain fully enforceable.
23.0 ENTIRE AGREEMENT. This Agreement contains the entire agreement between the parties
as to the services to be rendered by the Consultant. All previous or concurrent agreements,
representations, warranties, promises, and conditions relating to the subject matter of this
Agreement are superseded by this Agreement.
24.0 COMPLETION OF WORK, TERM OF AGREEMENT. The Consultant shall perform all
work in a timely fashion, and in accordance with the schedules included in this Agreement and
Exhibits.
25.0 CLAIMS AND DISPUTES. Venue for all claims and disputes under this Agreement, if not

otherwise resolved by the parties, shall be in the appropriate Alaska State court in Anchorage or
Kodiak, Alaska.
26.0 CHANGES IN SCOPE OF WORK.
26.1 General. No claim for additional services not specifically provided in this Agreement
will be allowed, nor may the Consultant do any work or furnish any materials not
covered by the Agreement unless the work or material is ordered in writing by the
Contracting Officer. Preparation of Change Orders and design changes, due to errors
and/or omissions by the Consultant, will be done at the sole expense of the Consultant.
26.2 Changes in Scope of Work. The Borough or its representative may, at any time, by a
written Change Order delivered to the Consultant, make changes to the scope of work,
or authorize additional work outside the scope of work.
26.3 Compensation to the Consultant. If any Change Order for which compensation is
allowed under this Article causes an increase or decrease in the estimated cost of, or
time required for, the performance of any part of the work under this Agreement, or if
such change otherwise affects other provisions of this Agreement, an equitable
adjustment will be negotiated. Such an adjustment may be:
a. in the estimated cost or completion schedule, or both;
b. in the amount of fee to be paid; and
c. in such other provisions of the Agreement as may be affected, and the Agreement
shall be modified in writing accordingly.
26.4 Any claim by the Consultant for adjustment under this section must be asserted within
fifteen (15) days from the day of receipt by the Consultant of the notification of change;
provided, however, that the Borough or its representative, deciding that the facts justify
such action, may receive and act upon any such claim asserted at any time prior to final
payment under this Agreement. Failure to agree to any adjustment shall be a dispute
within the meaning of Section 25.0 of this Agreement.
27.0 LIMITATION OF FUNDS.
27.1 At no time will any provision of this Agreement make the Borough or its representative
liable for payment for performance of work under this Agreement in excess of the
amount that has been appropriated by the Borough Assembly and obligated for
expenditure for purposes of this Agreement.
27.2 Change orders issued pursuant to Section 26 of this Agreement shall not be considered
an authorization to the Consultant to exceed the amount allotted in the absence of a
statement in the change order, or other modification increasing the amount allotted.
27.3 Nothing in this Section shall affect the right of the Borough under Section 17 to
terminate this Agreement.
28.0 PRIOR WORK. For the purposes of this Agreement, work done at the request of the Borough
or its representative before execution of this Agreement shall be deemed to be work done after

DESTINATION MARKETING & TOURISM
DEVELOPMENT PROGRAM AGREEMENT
THIS AGREEMENT is entered into by and between the Kodiak Island
Borough (Borough) and Discover Kodiak (contractor) for the purpose of setting
forth the terms and conditions pursuant to which the contractor shall be contracted
to provide destination marketing and tourism development activities for the Kodiak
Island Borough.
Section 1. INTENT OF AGREEMENT. The contractor is hereby contracted
to provide destination marketing and tourism development in the Kodiak Island
Borough.
Section 2. SCOPE OF WORK. The contractor will work with the Discover
Kodiak Board of Directors to accomplish the following tasks:
a. Produce collateral marketing materials, including the Discover Kodiak
Visitor Guide
b. Maintain and staff the Kodiak Visitor Center
c. Work with the Alaska Travel Industry Association to ensure Kodiak is
represented in their ongoing national and international marketing
programs
d. Continue work with the communities in the Kodiak Island Borough to
determine the role tourism does and can play in the community
economies
e. Work with the Kodiak Chamber of Commerce to transform the visitor
industry into a significant component of the Kodiak region's economy
f. Continue development of the kodiak.org website to improve its usability
and visibility to visitors, potential businesses, and residents
g. Work with Kodiak College, the Kodiak Island Borough School District,
Kodiak Area Native organizations, and other organizations to encourage
entrepreneurship and assist small business development in the visitor
industry
h. Continue work with the airline industry and the Alaska Marine Highway
System to maintain and improve access to the Kodiak region
A minimum of four Board of Director meetings will be scheduled during the
term of this Agreement for the purpose of maintaining board input and
guiding the efforts of the contractor. A written summary of Discover
Kodiak activities will be submitted to the Borough Manager's Office and an

Section 3. TERM. This agreement will remain in effect July 1, 2025
through June 30, 2026, unless earlier terminated. Either party shall have the right
to terminate the agreement without penalty upon one month's written notice to the
other.
Section 4. COMPENSATION. As compensation for all services rendered
under this agreement, contractor shall be paid $75,000.00 by the Kodiak Island
Borough. Said compensation shall be paid in equal installments of $18,750.00 on
the second Friday of July (or upon execution of this contract), and October 2025,
and January and April 2026.

RECOMMENDATION:

DISCUSSION:
This resolution modifies the retention series for the Manager's Office and Human Resources
to ensure adherence to current laws and regulations while addressing the operational needs
of the Departments.
A significant alteration in this revision pertains to the Clerk's Office, which involves
transitioning the storage of ordinances, resolutions, and minutes, from physical storage to a
fully electronic format. This transition will enhance searchability, eliminate redundancy, and
reduce costs by removing the necessity to purchase fire -safe cabinets, acid -free paper, and
specialized binders. We have conducted the necessary due diligence in reaching this
decision. We consulted with the IT Director, who confirmed that we possess backup systems
capable of fully restoring Laserfiche files and servers. Additionally, there are several copies of
backups stored both on -site at the Borough building and off -site at KFRC.
This resolution suggests a change in the retention of "legal opinions," which have been
rebranded as "attorney subject files." This change provides the Departments with the flexibility
to identify legal information that may possess potential archival value. Furthermore, a new
series, "Litigation Case Files," has been added to enhance the efficiency of record handling.
Currently, all litigation files are required to be stored in the Manager's Office, a practice
deemed inefficient, as Departments should have the authority to retain these records within
their own offices if a litigation is still active and transfer them directly to archives once they
become inactive, rather than routing them through the Manager's Office first.
These changes have been reviewed by the Borough Attorney and are detailed in the attached
Exhibits A, B, and C.

WHEREAS, Kodiak Island Borough Code 2.40.120 provides for a records management
program creation and administration and approval of the records retention schedule by resolution;
and
WHEREAS, staff determined the need to revise the current retention schedule to comply with
and consider recent and existing laws and regulations, reflect industry best practices, and to meet
the present needs of the Borough; and
WHEREAS, the Borough Deputy Clerk, serving as the records administrator, consulted with the
Borough Manager, Borough Manager's Special Projects Support Representative, Borough Clerk,
and the Borough Attorney to finalize the proposed amendments to various department records
series; and
WHEREAS, the Clerk's Office have recognized further types of records that may be preserved
solely in electronic format; thereby, improving searchability, accessibility, and usefulness, while
also removing the redundancy, expenses, and inefficiencies associated with the maintenance and
storage of paper copies; and
WHEREAS, the Assembly recognizes the importance and value of attorney's opinions as a
resource for the Borough, but finds the term "legal opinions" to be unnecessarily restrictive; and
WHEREAS, the revision replaces the term "legal opinions" with "Borough Attorney Subject
Files" and "Litigation Case Files," allowing department directors to determine the value of such
documents, conduct annual reviews for archival worth, and ensure appropriate preservation in
Laserfiche to prevent loss due to staff transitions or electronic file deletions; and
WHEREAS, the Assembly finds that it is in the best interest of the Kodiak Island Borough to
amend the Record Retention Schedule to reflect changes in the Borough Clerk, Manager's Office,
and Personnel Management records series.
NOW, THEREFORE, BE IT RESOLVED BY THE ASSEMBLY OF THE KODIAK ISLAND
BOROUGH that the Borough Assembly adopts and incorporates Exhibits "A, B, and C" which
reflect revisions to the Borough Clerk's Office, Manager's Office, and Personnel Management
records series. The remainder of the Borough Records Retention Schedule remains unchanged.

KODIAK ISLAND BOROUGH CODE TITLE 3 REVENUE AND FINANCE, CHAPTER 3.35
REAL PROPERTY TAX, SECTION 3.35.050 BOARD OF EQUALIZATION
WHEREAS, Senate Bill 179 was adopted by State of Alaska amending certain procedures for
municipal boards of equalization; and
WHEREAS, the Assembly finds that amendments to the current Board of Equalization
procedures in the Kodiak Island Borough Code are required to comply with the new State adopted
procedures; and
WHEREAS, the Assembly desires to harmonize the provisions of the Kodiak Island Borough
Code with the new State Statutory changes.
NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND
BOROUGH that:
Section 1: This ordinance is of a general and permanent nature and shall become a part of the
Kodiak Island Borough Code of Ordinances.
Section 2: That Section 3.35.050(E)(4) and (E)(8)(c) of the Kodiak Island Borough Code of
Ordinances is amended to read as follows:
Section 3.35.050 Board of Equalization.
(E)(4). Burden of Proof. The burden of proof rests with the appellant, who must convince the
board by a preponderance of evidence that the valuation appealed from is unequal, excessive,
improper, or undervalued based on the facts stated in a written appeal or proven at the appeal
hearing in accordance with subsections (E)(5) and (E)(7) of this section. if the valuation is found

the assessment in the current year unless requested to do so by the appellant. If the
appellant provides a long form fee appraisal to support the appellant's valuation and the
board of equalization does not find in favor of the appellant, the board shall make specific
findings on the record to support its decision. The borough shall make available to the
appellant all reasonably pertinent documents requested for presentation of the appeal, including
but not limited to documents presented or requested by the board of equalization for presentation
of the appeal in accordance with subsection (C)(5) of this section.
(E)(8)(c) Decisions The board may decide the appeal after the presentations, or it may defer a
decision no later than 30 days after the hearing date. Final board action shall be taken by motions

rescinded by the board. Only one motion may be on the floor at a time, and the board shall vote
on the motions until its findings are established. The vote must be taken and entered in the
permanent record of the proceedings. The motions available for the board are:

THE MUNICIPALITY BEFORE JANUARY 1, 2017, A MUNICIPALITY THAT IS
A SCHOOL DISTRICT MAY ONLY EXEMPT ALL OR A PORTION OF THE
AMOUNT OF TAXES THAT EXCEEDS THE AMOUNT LEVIED ON OTHER
PROPERTY FOR THE SCHOOL DISTRICT'S REQUIRED LOCAL
CONTRIBUTION UNDER AS 14.17.410(b)(2).] A municipality may by ordinance
permit deferral of payment of taxes on all or some types of economic development
property for a designated period. A municipality may apply an exemption or deferral
under this subsection to taxes levied for special services in a service area that is
supervised by an elected service area board under AS 29.35.460 unless the elected
service area board objects to the exemption or deferral by resolution adopted not later
than 60 days after the effective date of the municipal ordinance enacting the tax
exemption or deferral. A municipality may adopt an ordinance under this subsection
only if, before it is adopted, copies of the proposed ordinance made available at a
public hearing on it contain written notice that the ordinance, if adopted, may be
repealed by the voters through referendum. An ordinance adopted under this
subsection must include specific eligibility requirements and require a written
application for each exemption or deferral.

* Sec. 5. AS 29.45.050(y) is amended to read:
(y) In this section, "farming activity" means raising and harvesting crops;
feeding, breeding, and managing livestock; dairying; propagating, farming, or
cultivating an aquatic farm product as defined in AS 16.40.199; or any
combination of those activities.
* Sec. 6. AS 29.45.050 is amended by adding a new subsection to read:
(z) In the event that an owner or lessee of farm use land does not sell $2,500
of agricultural products produced from the land during a tax year because of
circumstances beyond the control of the owner or lessee, the owner may secure the
exemption under (t) of this section if the farm use land qualified for the exemption
under (t) of this section for the three preceding tax years. In this subsection,
"circumstances beyond the control of the owner or lessee" includes crop failure or
physical injury that prevents the owner or lessee from conducting farming activity.
* Sec. 7. AS 29.45.060(a) is amended to read:
(a) Farm use land, and structures on farm use land that are used for farm
operations, included in a farm unit and not dedicated or being used for nonfarm
purposes shall be assessed on the basis of full and true value for farm use and may not
be assessed as if subdivided or used for some other nonfarm purpose. The assessor
shall maintain records valuing the land for both full and true value and farm use value.
If the land is sold, leased, or otherwise disposed of for uses incompatible with farm
use or converted to a use incompatible with farm use by the owner, the owner is liable

1 to pay an amount equal to the additional tax at the current mill levy together with eight
2 percent interest for the preceding seven years, as though the land had not been
3 assessed for farm use purposes. Payment by the owner shall be made to the state to the
4 extent of its reimbursement for revenue loss under (d) of this section for the preceding
5 seven years. The balance of the payment shall be made to the municipality.
6 * Sec. 8. AS 29.45.060(b) is amended to read:
7 (b) An owner of farm use land shall, to secure the assessment under this
8 section, apply to the assessor on or before May 15 of each year in which the
9 assessment is desired. The application shall be made on [UPON] forms prescribed by
10 the state assessor for the use of the local assessor, and must include information that
11 may reasonably be required to determine the entitlement of the applicant. If the land is
12 leased for farm use purposes, the applicant shall furnish to the assessor a copy of the
13 lease bearing the signatures of both lessee and lessor along with the completed
14 application. The applicant shall furnish the assessor a copy of the lease covering the
15 period for which the exemption is requested. This subsection does not apply to a
16 person with an interest in land that is classified by the state for agricultural use or that
17 is restricted by the state for agricultural purposes.
18 * Sec. 9. AS 29.45.060(c) is amended to read:
19 (c) In the event that an owner or lessee of farm use land does not sell

3 a declaration of intent at the time of filing the application with the assessor setting out

5 an Internal Revenue Service Schedule F (Form 1040) with the United States
6 Internal Revenue Service for the current tax year [THE ANTICIPATED
7 PERCENTAGE OF INCOME]. An applicant using this procedure shall file with the
8 assessor on or before April 15 [FEBRUARY 1] of the following year a copy of the
9 Schedule F (Form 1040) the applicant files with the Internal Revenue Service
10 [NOTARIZED STATEMENT OF THE PERCENTAGE OF GROSS INCOME
11 ATTRIBUTABLE TO THE LAND]. Failure to make a [THE] filing required in this
12 subsection forfeits the exemption.
13 * Sec. 11. AS 29.45.060(g) is amended to read:
14 (g) In this section,
15 M "farm use" means the use of land for the production of crops,
16 fruits, or other agricultural products for human or animal consumption or for
17 the sustenance or grazing of livestock if the owner or lessee sells at least $2,500 of
18 agricultural products produced from the land during the tax year and files an

27 ACTIVELY ENGAGED IN FARMING THE LAND, AND DERIVE AT LEAST 10

4 prevailing general price levels. The assessor shall determine the full and true value
5 as provided in standards adopted by the department under (e) of this section or
6 another set of standards provided by ordinance.
7 * Sec. 13. AS 29.45.110 is amended by adding a new subsection to read:
8 (e) The department shall adopt standards for assessing the full and true value
9 of property under (a) of this section that are not inconsistent with standards adopted by
10 the International Association of Assessing Officers and update the standards when
11 necessary.
12 * Sec. 14. AS 29.45 is amended by adding a new section to read:
13 Sec. 29.45.115. Assessor certification. A municipality may not employ an
14 assessor, including a private contractor, unless the assessor has a level 3 certification
15 from the Alaska Association of Assessing Officers or works under the supervision of
16 an individual with a level 3 certification from the Alaska Association of Assessing
17 Officers.
18 * Sec. 15. AS 29.45.180(a) is amended to read:
19 (a) A person receiving an assessment notice shall advise the assessor of errors
20 or omissions in the assessment of the person's property. If requested by the person,
21 the assessor_ or a_person designated by the assessor shall meet with the person and
22 answer reasonable questions relating to the methods used to assess the person's
23 property. The meeting required under this subsection may be virtual or
24 telephonic. The assessor may correct errors or omissions in the roll before the board
25 of equalization hearing.
26 * Sec. 16. AS 29.45.200(a) is amended to read:
27 (a) The governing body shall appoint one or more boards [SITS AS A
28 BOARD] of equalization for the purpose of hearing an appeal from a determination of
29 the assessor [, OR IT MAY DELEGATE THIS AUTHORITY TO ONE OR MORE
30 BOARDS APPOINTED BY 1T]. An appointed board shall [MAY] be composed of

2 governing body shall by ordinance establish the qualifications for membership. The
3 governing body may by ordinance appoint itself to sit as a board of equalization.
4 * Sec. 17. AS 29.45.210(b) is amended to read:
5 (b) The appellant bears the burden of proof. The only grounds for adjustment
6 of assessment are proof of unequal, excessive, improper, or under valuation based on
7 facts that are stated in a valid written appeal or proven at the appeal hearing. The [IF
8 A VALUATION IS FOUND TO BE TOO LOW, THE] board of equalization may not
9 raise the assessment in the current year unless requested to do so by the appellant.
10 If the appellant provides a long form fee appraisal to support the appellant's
11 valuation and the board of equalization does not find in favor of the appellant,
12 the board shall make specific findings on the record to support its decision.
13 * Sec. 18. AS 29.45.650(a) is amended to read:
14 (a) Except as provided in AS O4.21.010(c), AS 29.45.750, and in (0, (h), (i),
15 [AND] 0), (k), and (1) of this section, a borough may levy and collect a sales tax on
16 sales, rents, and [ON] services provided in the borough. The sales tax may apply to
17 any or all of these sources. Notwithstanding other statutes, exemptions may be granted
18 by ordinance. A borough may wholly or partially exempt a source from a borough
19 sales tax that is taxed by a city in that borough under AS 29.45.700.
20 * Sec. 19. AS 29.45.650 is amended by adding a new subsection to read:
21 (0 A borough may not levy or collect a sales or use tax on the transfer of real
22 property. This subsection applies to home rule and general law municipalities. In this
23 subsection, "transfer" has the meaning given in AS 34.70.200.
24 * Sec. 20. AS 29.45.700(a) is amended to read:
25 (a) A city in a borough that levies and collects areawide sales and use taxes
26 may levy sales and use taxes on all sources taxed by the borough in the manner
27 provided for boroughs. Except as provided in (d), [AND] (e), (g), and (h) of this
28 section, the assembly may by ordinance authorize a city to levy and collect sales and
29 use taxes on other sources.

Sec. 43.98.035. No tax on real property transfers. The state may not levy or
collect a sales or use tax on the transfer of real property. In this section, "transfer" has

* Sec. 24. The uncodified law of the State of Alaska is amended by adding a new section to
read:
APPLICABILITY. AS 29.45.650(o, enacted by sec. 19 of this Act, and
AS 29.45.700(h), enacted by sec. 21 of this Act, do not apply to an ordinance that establishes
a sales or use tax on the transfer of real property adopted by a municipality before the
effective date of secs. 19 and 21 of this Act.
* Sec. 25. The uncodified law of the State of Alaska is amended by adding a new section to
read:
TRANSITION: REGULATIONS. The Department of Commerce, Community, and
Economic Development may adopt regulations necessary to implement the changes made by
secs. 12 - 17 of this Act. The regulations take effect under AS 44.62 (Administrative
Procedure Act), but not before the effective date of the law implemented by the regulation.

RECOMMENDATION:
The Assembly is to assess the GWL application based on the information contained within the
packet, feedback received from staff, and response from local law enforcement. Below are
examples of motions that may be used:
Motion 1: Move to voice non -protest to the State of Alaska Alcohol and Marijuana Control
Office (AMCO) GWL renewal application for Southern Glazer's of AK located at 5152 Tom
Stiles Road Bldg. B - Bay 2, Kodiak, AK 99615 and direct the Clerk to notify AMCO of this
decision.
Motion 2: Move to voice protest to the State of Alaska Alcohol and Marijuana Control Office
(AMCO) GWL renewal application for Southern Glazer's of AK located at 5152 Tom Stiles
Road Bldg. B - Bay 2, Kodiak, AK 99615 and direct the Clerk to notify the applicant of this
intent.
Clerk's note: As required by 3 AAC 305.085(d), the local governing body shall allow the
applicant a reasonable opportunity to defend the application before the local governing body.
The applicant/licensee will be advised if the Assembly decides to protest the GWL application,
and the applicant/licensee will be given an opportunity to defend the GWL application at a
future meeting.
DISCUSSION:
On July 18, 2025, the Clerk's Office received a renewal notice from the Alcoholic Beverage
Control (ABC) Board for License #4860, held by Southern Glazer's of AK. In accordance with
KIBC 5.01.020, the Clerk's Office conducted a review of the application. The review identified
several concerns below regarding the accuracy of the application and the operational status
of the business, which may warrant an official protest by the Kodiak Island Borough
Assembly.
Assessing Department:
• The business has no active business personal property or real property accounts on
record.
• The Assessor's Office confirmed with both Southern Glazer's and Odom that the
listed address, "Bay 2," does not exist.
• Southern Glazer's does not appear to have employees or a physical storefront in
Kodiak and is reportedly billed by Odom for local sales.
• It remains unclear whether Southern Glazer's is actively wholesaling in Kodiak.

Under AS O4.11.480, a local governing body may protest a license renewal by submitting a
clear and concise written statement of the reasons for protest to both the ABC Board director
and the licensee. The protest must be filed within 60 days of receiving the renewal notice.
Accordingly, the Borough's deadline to respond is September 16, 2025.
ALTERNATIVES:
1. Issue a letter of protest.

Jascha Zbitnoff called the regular meeting to order at 3:30 p.m. Board Members
present were Jascha Zbitnoff, Jerrol Friend, Jon Melin, Ty Swanson, Dan Rohrer,
Victor Weaver, and Doug Mathers. A quorum was established. Also present were
Kodiak Island Borough Manager Aimee Williams, Kodiak Island Borough Engineering
& Facilities Director David Conrad, Kodiak Island Borough Projects Manager Codi
Allen, and Kodiak Island Borough Assembly Mayor Scott Arndt.

c. North Star Elementary School Roof & Skylight Replacement
Codi Allen reviewed the project and drawings. Corey Wall answered questions
presented by the Board and expanded on the design plans. There was
discussion of the structure remaining, fire sprinkler locations, and possible cost
savings.
FRIEND MOVED to recommend to the Assembly the North Star Skylight and
Roof Architects to bring in a structural engineer to evaluate the existing structure
to determine if the structure would be sufficient to support a solid framed unit as
described in the drawings; remove glass, enclose to have solid walls, leaving
windows on the ends, and have a metal roof. SWANSON seconded..
ROLL CALL VOTE ON MOTION CARRIED UNANIMOUSLY
d. East Elementary School Roof Replacement
Codi Allen reviewed the project, drawings, and presented that this project would
be on the School Districts Capital Improvement Project List. Corey Wall
answered questions presented by the Board. There was discussion of the
ventilation, code requirements for sprinklers, and asbestos containing materials.
FRIEND MOVED to approve the conceptual design presented with comment to
receive 65% drawings by beginning of July to keep it moving for the Capital
Improvement Project List for the School District. MATHERS seconded. .

ROLL CALL
Jarred Griffin called the regular meeting to order at 2:01 p.m. Board Members present
were Jared Griffin, Larry LeDoux, and Aimee Williams. Codi Allen and Scott Smiley were
absent. A quorum was established. Also present were Kodiak Island Borough Finance
Director Dora Cross, Providence Kodiak Island Medical Center Lori Riddle, Ben Carver,
Victor Weaver, and Karen Stevens.

a. Kodiak Island Borough — Projects Update
1. Elevator Modernization: Patricia Valerio provided an update. The parts
have been ordered, expecting arrival during the winter and work to begin
the following spring.
b. Providence Kodiak — Projects Update
1. Spreadsheet for Projects: Lori Riddle and Victor Weaver from PKIMC
reviewed the list of projects. There was discussion among the board
regarding prioritizing the project list; the discussion included, the RO
System, RTU system, SPD system, AHU system, Chiller, and OR System.
PKIMC would prioritize the projects as follows: RO, Steam Generator,
Chiller, and DP6. The board asked PKIMC to provide a summary of what
those items would cost. The board also asked if they could get an
engineer's opinion on what the priority list should be.
C. Sterilization System Status
This discussion was included in item (b.) discussion.
d. Retaining Wall Safety Issue
Victor reported that there have been kids up on the wall in the cement
gutter and would like to discuss fencing options to deter people going up on
top.

e. Elder House Lease
The current lease is a Construction Lease and there is currently no R&R
payments being set aside. There are many issues that need to be addressed
such as: doors that face the ocean side leak, shower floor issues, places
where there is rot.
f. Reimbursement Process:
Ben Carver provided a summary of what his current understanding of the
process is and asked the board for input on what the steps are for requesting
reimbursements from the Borough. Dora Cross and Aimee Williams reviewed
what the process currently is; present to the Assembly, gain Assembly
approval, send invoice to the Borough, once Assembly newsletter is released
confirming approval then the invoice is processed for payment.
BOARD MEMBERS COMMENTS
Larry LeDoux — This is a good process. And having the manager working closely with
schools and hospitals is very important to our community. Its extremely important that
we take care of our hospitals.
Aimee Williams — None.
Jared Griffin — I think its great that we are gaining traction on items and meeting again.
