KODIAK ISLAND BOROUGH Assembly Regular Meeting July 3, 2025 A regular meeting of the Kodiak Island Borough Assembly was held on July 3, 2025, in the Assembly Chambers. The meeting was called to order at 6:30 p.m. Staff present were Administrative Official Seema Garoutte, Borough Clerk Nova M. Javier, and Deputy Clerk Lina Cruz. CITIZENS' COMMENTS Brian Himelbloom spoke under citizen's comments. 16. ASSEMBLY MEMBERS' COMMENTS Assembly Member Whiteside echoed the Mayor's sentiment to be safe and wished everyone a happy Fourth of July. He also expressed gratitude to all those who attend meetings, whether in person or by phone, noting that public input is appreciated. Assembly Member Griffin shared his sentiments regarding the declaration of independence and his views on the meaning of patriotism. Assembly Member Ames addressed recent public comments about meetings being rushed, explaining that much of the work is completed during work sessions. He also encouraged everyone to have fun and enjoy fireworks where allowed. Assembly Member LeDoux expressed appreciation for the Kodiak Salvation Army and their years of service to the community. He also thanked Sandra West for her consistent participation in meetings and for her efforts supporting Island Trails Network to improve quality of life in Kodiak. Assembly Member Smiley shared that he was glad to be back in Kodiak's cooler climate after experiencing 100-degree temperatures during a trip to New York City. Assembly Member Sharratt stated his interest in continuing discussions about upcoming hospital projects and the lease. He also addressed public testimony related to nonprofits and emphasized the importance of keeping mental health awareness at the forefront. He offered his personal cell phone number to the public and encouraged everyone to avoid drinking and driving over the Fourth of July holiday. 17. KODIAK ISLAND BOROUGH STAFF REPORT J U LY 17, 2025 ASSEMBLY REGULAR MEETING SUBJECT: Ordinance No. FY2026-03, Amending Various Sections of Kodiak Island Borough Code Title 17 Zoning To Define Pet -Related Uses And To Locate These Uses In Specific Zoning Districts As Either Permitted Uses Or Conditional Uses ORIGINATOR: Chris French, CDD Director RECOMMENDATION: Move to adopt Ordinance No. FY2026-03. DISCUSSION: The Planning & Zoning Commission held a public hearing on the proposed code amendment on May 21, 2025. The Commission voted 5 to 0, with two members absent, to recommend approval of the code amendment to the Assembly. The Commission's recommendation with findings was organized into Planning & Zoning Commission Resolution No. FY2025-011. The signed resolutions is attached to this agenda item. The Community Development Department received an email from Summer Blain with Blue Berry Hill Pet Hotel requesting that the Commission consider an amendment to Title 17 Zoning to allow dog kennels as a permitted use in the Business District. The Commission, at its work session on November 13, 2025, reviewed the email request from Summer Blain. The Commission directed staff to research the issue and return with recommendations for consideration. The Commission conducted its first work session review of a draft code amendment ordinance on December 11, 2024. The Commission reviewed the recommendations and research that staff conducted. The Commission gave feedback to the staff for further research and amendments to the draft ordinance. The Commission conducted additional work session reviews of the ordinance on January 8, 2025, and March 12, 2025. At the March 12, 2025, work session, the Commission directed staff to place the code amendment on for public hearing at the May 21, 2025, regular meeting. Title 17 currently permits pet boarding facilities in the Rural Neighborhood Commercial District and as a conditional use in the Urban Neighborhood Commercial District. Staff researched the issue and determined that the code was lacking definitions to define pet -related uses and that the current districts where uses were allowed were both inadequate and not in conformance with best planning practices. Staff reviewed other jurisdictions in Alaska and created the comparison table that is attached to this agenda item. Staff determined that definitions were needed for pet boarding facility, veterinary clinic/animal hospital, pet services, and animal shelters. In addition, staff recommended that the Commission require a conditional use permit for a pet boarding facility in the Business District, Urban Neighborhood Commercial District, Rural Neighborhood Commercial District, the Rural Residential 1 District, and the Rural Residential 2 District. The residential districts were included because there are two pet boarding facilities within these districts today, and in other jurisdictions, larger residential lot districts allowed pet boarding facilities with a conditional use permit. KODIAK ISLAND BOROUGH STAFF REPORT J U LY 17, 2025 ASSEMBLY REGULAR MEETING In addition to the pet boarding facility, a veterinary clinic/animal hospital was defined and proposed to be allowed as a permitted use in the Urban Neighborhood Commercial District, the Business District, and the Rural Neighborhood Commercial District. Pet Services was defined and includes uses such as pet grooming and pet training. Pet services was proposed to be permitted within the R2 District, R3 District, Business District, Urban Neighborhood Commercial District, and the Rural Neighborhood Commercial District. The R2 and R3 districts were included because these districts allow uses such as beauty shops and professional offices. The animal shelter use was also defined and proposed to be permitted within the Light Industrial District (current location of animal shelter) and the public use lands district. Lastly, the parking requirements in KIBC Chapter 17.175 were revised to create parking requirements for the newly defined uses. The requirement for pet boarding facilities was left to the Commission to decide during the conditional use permit review process based on the characteristics of the individual pet boarding facility. FY2026-03 AN ORDINANCE OF THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH AMENDING VARIOUS SECTIONS OF THE KODIAK ISLAND BOROUGH CODE TITLE 17 ZONING TO DEFINE PET -RELATED USES AND TO LOCATE THESE USES IN SPECIFIC ZONING DISTRICTS AS EITHER PERMITTED USES OR CONDITIONAL USES WHEREAS, KIBC 17.95.020 permits animal hospitals, veterinary clinics, and boarding kennels as permitted uses in the Rural Neighborhood Commercial (RNC) Zone; and WHEREAS, KIBC 17.100.040 allows animal hospitals, veterinary clinics, and boarding kennels in the Urban Neighborhood Commercial (UNC) Zone with a conditional use permit; and WHEREAS, KIBC Title 17 does not define animal hospitals, veterinary clinic, and boarding kennels/pet boarding facility; and WHEREAS, KIBC Title 17 does not define pet services; and WHEREAS, KIBC Title 17 does not define animal shelter and does not list the use as permitted or conditional use in any zoning district; and WHEREAS, KIBC 17.205.010 provides that "Whenever the public necessity, convenience, general welfare or good zoning practice requires, the assembly may, by ordinance and after report thereon by the commission and public hearing as required by law, amend, supplement, modify, repeal or otherwise change these regulations and the boundaries of the districts"; and WHEREAS, the public necessity and general welfare of the community may be better served by defining veterinary clinic, animal hospital, pet boarding facility, pet services, and animal shelter; and WHEREAS, the public necessity and general welfare of the community may be better served by locating pet -related uses such as veterinary clinics, animal hospitals, pet boarding facilities, animal shelters, and pet services in appropriate zoning districts as either permitted uses or conditional uses; and WHEREAS, the amendments to KIBC 17.25.230, 17.25.030, 17.25.010, 17.60.030, 17.70.030, 17.80.020, 17.85.020, 17.90.020, 17.90.030, 17.95.020, 17.95.030, 17.95.040, 17.100.020, 17.100.040, and 17.175.040 will accomplish the stated public need; and WHEREAS, the Planning and Zoning Commission approved Resolution No. FY2025-05, which recommended approval of this code amendment to the Borough Assembly. NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH that: Section 1: This ordinance is of a general and permanent nature and shall become a part of the Kodiak Island Borough Code of Ordinances. "Alteration" means any change, addition, or modification in the construction, location, or use classification. "Animal shelters" means a facility used to house or contain stray, homeless, abandoned, or unwanted animals and that is owned, operated, or maintained by a government entity, an established humane society, animal welfare society, society for the prevention of _cruelty to animals, or other nonprofit organization devoted to the welfare, protection, and humane treatment of animals. 17.25.170 P Definitions "Personal wireless service facility" means any tower, structure, or other equipment intended for a primary use of providing commercial or public wireless, radio, microwave, or other communication services and functionality. "Pet Boarding Facility" means any animal boarding facility where more than three pet animals owned by another person are temporarily boarded for pay, trade, barter, commission, or remuneration of any sort; provided, however, this definition shall not apply to zoos and veterinary clinics/animal hospitals. "Pet services" means a business that provides services to pets such as grooming and training for compensation. This use does not include pet boarding. 17.25.230 V definitions. "Vehicle impound lot" means a secured, screened lot provided for the collection and storage of vehicles for a period not to exceed six months which have been impounded and authorized for storage by a law enforcement agency. "Vehicle impound lot" does not mean the processing or dismantling of vehicles for scrap metal or the sale of their parts. "Veterinary Clinics/Animal Hospitals" means any facility maintained by or for the use of a licensed veterinarian in the diagnosis, treatment, or prevention of animal diseases wherein the animals are limited to dogs, cats, or other comparable household pets and wherein the overnight care of said animals is prohibited, except when necessary, in the medical treatment of the animal. 17.60.030 (RR2 District) Conditional uses. Fences — A continuous fence at least 6 feet in height shall be erected around the portion of the site used for the boarding operation, excluding parking areas. d. Noise — The design of the structures used for boarding shall include features that acoustically shield any animals noises from surrounding property. e. The applicant shall demonstrate adequate provisions to prevent surface water quality impacts due to animal wastes. Effective Date: This ordinance takes effect upon adoption. The Commission voted 6 to 0 with one member absent to forward a recommendation of approval to the Assembly. Multi -Jurisdiction Multi -Hazard Mitigation Plan Update Community Development staff met with Alaska Division of Homeland Security and Emergency Management staff and a community planner from FEMA Region X on July 11 to discuss the comments submitted to the borough by FEMA. This meeting provided staff sufficient guidance to complete minor revisions to the plan to address FEMA comments. PLAN 2045 Comprehensive Plan — Open House on Transportation and Community Facilities/Services The open house is scheduled for July 22, 2025, from 10 AM to 2 PM in the Assembly Chambers. Borough Parks and Recreation Committee Meeting The Parks and Recreation Committee met on July 15, 2025, at 11 AM in the borough conference room. The primary discussion of the meeting was PLAN 2045 and the upcoming public engagement process related to the parks, open space, and trails element of the plan. The committee directed staff to work on a trails survey for the plan and to conduct a open house similar to the one scheduled in July for Transportation and Community Facilities. Russian River and Sargent Creek Hydrology and Hydraulics Study River Focus notified borough staff that the final findings report will be submitted before the end of July. Once submitted, staff will begin the process of scheduling a public meeting and scheduling the review of the report at a future Assembly work session. Finance Department Delinquent 2023 Property Taxes The seven properties with 2023 delinquent taxes have been submitted to the court for issuance of a Clerk's Deed. Property Assessment and Taxation Implementation Project Staff is starting to schedule training sessions to review tables and processes. Chiniak School Painting Design and specifications for this project have been completed. Staff advertised the project on June 30, 2025. Pre -Bid Conference was held on July 15th, there were two contractors in attendance. Facilities Contract — Parking and Road Maintenance There was a bid opening today for this contract today. Bids are being tabulated. KFRC Industrial Pump Alaska order is moving forward. The pumps have been ordered and are in production. Approximately 14 weeks out. Network and Connectivity IT is working on physically locating the best position for Starlink internet for the Landfill. Community Corner: Renewed Kodiak Connections July 2, 2025 by Contributing Author By Maia Draper -Reich Outreach Coordinator In April, Project Manager Danielle Verna and I were able to fly out to visit Ouzinkie, Alaska, thanks to clear weather and Council Board member Elijah Jackson. Jackson, who is the Kodiak Island communitys Mayor and Village Public Safety Officer, hosted us for a day connecting with community members of all ages. First. we stopped by the Ouzinkie School, which has two small mixed - age classroom groups: Kindergarten -5th grade and 6th-12th grade. We spent time with each class teaching our Critter Clean Up lesson, a n-!a a D ap°r•QP rh hands on activity that allows students to learn about wildlife clean up during an oil spill. We discussed the Exxon Valdez oil spill, why the Council exists, and the work that we do. Then the students experimented with different cleaning solutions using a faux bird feather to learn about the challenges of caring for oiled wildlife. The students had excellent questions and drew connections to their coastal community and the wildlife that live there. Midday, the Council co hosted a community reception at the Tribal Cultural Center with the City of Ouzinkie through Mayor Jackson and his staff. We shared some of the Council s written materials and publications. Over lunch, which was provided by the Council for those who stopped by, Danielle and I chatted with community members sharing specific Council projects, hearing experiences from the Exxon Valdez spill, and learning their concerns about community preparedness for future spills. Community members were particularly curious about the spill equipment staged in Ouzinkie and logistics for using it during a spill. We also had time to walk along the waterfront boardwalk, and visit with Mayor Jackson and his staff at the city5 office building. One of the city employees is a cat - in charge of pest control for the office. In addition to our day in Ouzinkie, while in Kodiak, the Council hosted a booth at ComFish Alaska 2025, a commercial fishing trade show held every year. The event also features a series of forums and presentations including discussions with Alaska's federal and state legislators. At the booth, Board members Aimee Williams, who represents the Kodiak Island Borough, and Wayne Donaldson, who represents the City of Kodiak, connected with Kodiak community members sharing the Council's work. We heard stories from community members involved in aftermath of the Exxon Valdez oil spill and the formation of the regional citizens advisory councils in Prince William Sound and Cook Inlet. I am grateful to be able to connect with our downstream community members, to share information and to hear their perspectives, including with the next generation of stewards of these lands and waters. 0 Page 30 of 77 AGENDA ITEM #14.A.1. DISCUSSION: The Engineering and Facilities Department (EF) is tasked with maintaining all of the Borough facilities. Our previous annual electrical contractor was offered a second extension as allowed in the contract; however, it was declined due to increased labor costs. Although, the current contract does include terms for rate adjustments due to the steep increase, the Manager directed Staff to initiate a new competitive bid process for these services. EF staff prepared an updated invitation to bid and published it on June 11, 2025. The bid opening occurred on July 2, 2025. Staff received and reviewed two (2) bid submissions and determined that both contractors were responsible bidders. Nodak Electric & Construction, Inc. was deemed the lowest cost responsible bidder. ALTERNATIVES: 1. Take no action. 2. Reject all bids. Page 21 of 27 a Kodiak Island Borough Special Conditions SC 01 General Statement The Special conditions set forth conditions and requirements unique to this Project and are supplemental to, and supersede, the Kodiak Island Borough "General Conditions." SC 02 Scope of Work The Scope of Work of the Base Bid of this Contract shall include providing all labor, materials, tools, equipment, transportation, supervision and facilities necessary to: Base Bid Kodiak Island Borough is responsible for operating and maintaining several facilities and from time to time need repairs or maintenance of varying nature for electrical and lighting systems. Bidder shall provide hourly rates for each item noted in the bid schedule, including regular hourly rate(s), overtime hourly rate(s), on -call rate, and a mark-up percentage for parts required. SC 03 Time of Completion The Term of the contact is for an initial eleven (11)-month period from August 1, 2025, until June 30, 2026. The Borough reserves the option to renew a contract resulting from this solicitation upon written agreement of both Parties for two (2) additional one -month periods. All renewals are to be for a period of one -month at the same terms, conditions, and price set forth herein. All renewals must reflect the correct Prevailing Wage Pamphlet rates, for more information please refer to Minimum Prevailing Wage Rates section. However, the Contractor, at least 90 days prior to the contract anniversary date, may request, in writing, changes to the terms, conditions, and pricing, other than those based upon the change in CPI. Approved changes do not constitute substantial changes to the contract and must be supported with appropriate written documentation. The approval of any change(s) is at the sole determination of the Borough, the contract administrator. If the contract is renewed, the yearly contract renewal period unit prices will be adjusted to the percentage change of the U.S. Department of Labor Consumer Price Index (CPI), Urban Kodiak, for the twelve- month period preceding the contract renewal date of July 1. However, if the CPI is negative, unit prices from the current contract period will prevail. SC 03.1 Contract Extension If additional extensions are needed outside the renewals outlined in the section above, the Kodiak Island Borough and the successful bidder agree: 1. That the Borough may extend the term of the contract on a month -to -month basis at the same rates specified in the contract at the end of the initial performance period, or the end of any exercised renewal; 2. Any such extension shall not exceed 6 months; 3. All other terms and conditions shall remain in full force and effect; and 4. To provide written notice to the other party of the intent to cancel such month -to -month extension at least 30 days before the desired date of cancellation. If the Borough provides a notice of extension, the Contractor shall accept or reject the extension within thirty (30) days of the date the notice is sent by the Borough. Page 22 of 27 a services after expiration of the final term on a month -to -month basis on the same rates until a new contract can be awarded or 6 months, whichever comes first. SC 03.2 Work Response Time The Contractor is responsible for responding to all Borough initiated maintenance calls within three (3) business days. If the Borough agrees, the work may be scheduled for a later time. A. Maintenance: The Contractor shall begin corrective work no later than 8:00 am. of the second day following receipt of directive for correction on non -emergency problems and two hours after notification for emergency problems. B. Repairs: The Borough, through the Borough Manager or designee, may request repairs in accordance with a written Work Order to be dated and signed by both parties. The work order system may also be implemented upon request through the Borough Manager or the Contractor to help settle disputes between the two parties. C. Emergency Work: All contractors shall supply contact numbers for 24-hour service (cell, pager) that will allow the Borough, or Borough Manager or designee, to contact the Contractor or their designee any time during the contract period. D. Non-exclusive Work: If the Contractor does not respond to a non -emergency work order in a timely manner, the Borough, or Borough Manager or designee may utilize another Contractor to respond to the work order. In an emergency, or if there is a reasonable possibility that Contractor may not be able to timely or adequately perform, the Borough, or Borough Manager or designee may contract with the second bidder on the bidding list for the purposes of a backup contractor. SC 04 Termination Both parties may agree in writing to terminate this agreement at any time. Either party may terminate the contract if the other party fails to perform in the manner called for in the contract. The Borough may terminate the contract for its own convenience on thirty (30) days written notice; the agreement will terminate if the Borough Assembly fails to appropriate necessary funds or repeals all or substantially all of the appropriations which fund this agreement. In case of default by the Contractor, for any reason whatsoever, the Borough may procure the goods or services from another source and hold the Contractor responsible for any resulting excess cost or other remedies under law or equity. If this contract is terminated, the Contractor has no further duty to perform other than that work reasonably necessary to stop work in a safe and workmanlike manner. Likewise, if this contract is terminated, the Borough has no further duty to pay the Contractor except for the work satisfactorily completed or goods delivered and accepted, as of the date of termination, and the additional work completed as being reasonably necessary to stop work in a safe and workmanlike manner. SC 05 Disputes Any dispute arising out of a contract resulting from this ITB shall be considered by the Borough Manager. The Borough Manager retains the right to consult with the Borough Attorney to obtain legal advice about the issue that arises. Once a decision by the Borough Manager has been made, the Manager will issue a memorandum of their decision in writing to all the concerned parties. Any dispute arising out of a contract resulting from this ITB shall be resolved under the laws of Alaska. SC 06 Continuing Obligation of Contractor Notwithstanding the expiration date of a contract resulting from this ITB, the Contractor is obligated to fulfill its responsibilities until warranty, guarantee, maintenance, and parts availability requirements have completely expired. SC 07 Insurance Requirements During the entire period of the project or work, the Contractor shall provide the following types of insurance. The Borough shall be insured as additional insured on all insurance policies except professional liability contracts. All policies shall have a thirty (30) day cancellation clause. 1. Comprehensive automobile liability, bodily injury, and property damage, including all owned, hired and non -owned, automobile - $1,000,000 per each accident 2. Workers' compensation as required by law and employer's liability coverage at a minimum of $1,000,000. 3. Commercial general liability insurance - $1,000,000 per occurrence and$2,000,000 aggregate. Each policy of insurance required by this Section shall provide for no less than thirty (30) days' advance notice to the Borough prior to cancellation. Insurance certificates will be required to be submitted for review by the Borough Manager before the Borough will issue a notice to proceed. Failure to maintain coverage is a material breach and grounds for termination of the contract. Should the Contractor fail to comply with the insurance requirements of this Agreement, the Kodiak Island Borough may terminate the Agreement on ten (10) days written notice. Proposal as Accepted SC 09 Suitable Materials Unless otherwise specified, all materials, supplies, or equipment offered by a bidder shall be new, unused, of recent manufacture, and suitable for the manufacturer's intended purpose. For all Borough approved materials actually used in the work, the Contractor shall be reimbursed at rates set forth in the Bid Schedules. The bidder warrants all articles, materials, and equipment supplied under a contract resulting from this bid conform to the specifications of this contract, to be fit and sufficient for the use specified, to be of merchantable quality, and to be free from defect of materials or workmanship. Equipment, articles, and/or materials received which do not conform to the above warranties may be held at the bidder's risk of loss or damages or returned at the bidder's expense at the discretion of the KIB. SC 10 Hazardous Waste Generation Every effort to minimize or eliminate the generations of hazardous waste shall be used by the Contractor in the performance of the work of this Contract. Unless there is no substitute, no hazardous material shall be used in the performance of the work of this Contract. SC 11 Site Preservation, Restoration, Cleanup and Environmental Reporting The Contractor shall be solely responsible for damage to public or private property caused by their operations. The Contractor shall take all precautions necessary to control dust. The Contractor shall notify the Kodiak Island Borough of any claims of damage and shall clean and restore any property so damaged at the sole expense of the Contractor. All spills or releases of any hazardous substance shall be reported to the appropriate governmental agency as well as notice to the Kodiak Island Borough. Contractor shall be responsible for all associated cleanup costs and fines. At all times during the work, keep the premises clean and orderly. Upon completion of the work, repair all damage caused by equipment and leave the Project free of rubbish and excess materials of any kind. SC 12 Permits The Contractor shall obtain all licenses and permits that are required to do the work. ROLL CALL Jarred Griffin called the regular meeting to order at 9:01 a.m. Board Members present were Jared Griffin, James Turner, Scoff Smiley, Aimee Williams, and David Conrad. A quorum was established. Also present were Kodiak Island Borough Mayor Scoff Arndt, Kodiak Island Borough Projects Manager Codi Allen, Providence Kodiak Island Medical Center Director Karl Hurtz, and Jensen Yorba Wall Corey Wall. APPROVAL OF MINUTES No Minutes to Approve. CITIZENS COMMENTS (Limited To Three Minutes Per Speaker) None. AGENDA ITEMS a. PKIMC Space Planning Options Draft Report Discussion David Conrad introduced Corey Wall from Jensen Yorba Wall and the goal of the overall project and the meeting. Corey wall reviewed the drawings, ages of the sections of the buildings and provided an overview of the draft report. The Board discussed the previous evaluation of the buildings and estimates that were provided previously: in 2020 renovations of the current building were estimated by JYW to be $30 million and a new tower was estimated to be $60 million. The consensus in 2020 of the Assembly was to build a new tower and forego the renovations. After the meetings that were held in the fall of 2023, the next step was to develop 1-3 specific concept plan options and obtain cost estimates. Corey also added verbally that he would like to propose a plan zero, meaning that they would provide a cost estimate to renovate what is currently in place. Corey's goal is to have a final report by the end of September with options and estimates. During the most recent meetings that Corey held with PKIMC and KCHC, and the general discussions with Assembly members during the current meeting. The PKIMC number one priority is to create an "Empty Chair" shell on the 2nd floor/with expansion options in the future. KCHC's number one priority is to expand their space. And the assumed number one priority of the Assembly is to demolish and replace the aging West Wing with a multi -story new addition and relocate/reconstruct all departments within. There were discussions among the board regarding the possible options. Off - site locations were discussed. Options to be off the table and options to be "must -haves" were discussed but none were concretely decided upon.
