Back Side of Dark Lake and Island Lake

A public meeting, in conjunction with the Service District #1 Advisory Board
meeting, was held at 7:30 p.m. on August 16, 1983 for the sewer and water line
extensions on the back side of Dark and Island Lakes. Service District #1
Advisory Board members present were: Scott Arndt, Norm Wooten, Jim Poulos and
Carolyn Brisco; thereby establishing a quorum. Also present were some of the
property owners (see attached list) to voice their particular concerns regarding
their lots. Scott Arndt, Chairman, opened the meeting explaining the purpose of
the public meeting and introduced Jack Leet of URS. Mr. Leet gave a brief
overview of the proposed project, explaining that the limitations of pump
cability and cost should be considered in any request for changes. The follow-
ing is a compilation of those concerns with responses by URS Engineers and
Kodiak Island Borough staff.
PAT SZABO What does the construction road look like and how does it
LOT 4, USS 3464 affect our property?
Scott Arndt. It will be a one -lane temporary driveway used to haul material
an equipment to the construction sites.
URS. After construction, all construction roadways will be restored to their
original state of condition.
RICHARD RAY Why are the sewer and water lines separated on my lot? What
LOT 13, USS 3104 kind of future construction, i.e. easements/right-of-ways,
is anticipated? Any need for a right-of-way on Lot 13?
URS. The lines were separated to allow for a fire access to hydrants along the
roadway. At this time there are no definite plans for construction, nor are
there plans for a right-of-way on Lot 13.
ROBERT WEST What will the road look like - will there be any damage to
LOT 10, USS 3103 logs in the fill area?
URS. There will be minimal damage to the road.
LOU SCHNEIDER In 1966 there was a 60 -foot right-of-way dedicated. This
LOT 8B/8C, affects the junction of Lots 8C and 8B. Why are you cutting
USS 3103 into the existing road, instead of this right-of-way? What
about drainage? Will my lawns be restored? What is the
property value based on for the utility easements?
URS. The rational on the right-of-way was to stay with the traveled right-of-
way, but it could be changed to use the dedicated right-of-way. Any improve-
ments on your property, such as your lawn, will be restored.
Dave Crowe. The value of the permanent easement was based on 10% of the proper-
ty vie of the lot.

Why is the temporary easement two-thirds across the back of
the lot and not on an existing easement? Will future roads
require 50 more feet off of my lot?
URS. Due to a steep incline, the temporary easement was placed there. Any
other route would probably affect an adjacent property owner. The fifty -foot
easement was platted years ago by the federal government and did not take into
consideration the steep incline on the lot.
Dave Crowe. There are no current plans for additional fifty -foot easements in
your area.
DON FIELDS The planned easements take too much out of the pie -shaped
LOT 10, USS 3466 property that I am considering purchasing - could you
adjust the easements? I'm also concerned about a total of
forty -foot easements and tree removal.
URS. That particular lot is already under reconsideration for adjustments.
w my feet of the easement is temporary and construction will try to remain
within that 20 feet. Tree are removed minimally due to cost, and we try to work
this out with the property owners ( Carolyn Brisco concurred with URS).
Dave Crowe. Pump units will be installed, as part of the project, on lots that
curry have dwellings. It will be the owner's responsibility to connect from
the dwelling to the pump; the Borough will connect from the pump to the main
line.
DUNCAN FIELDS Way aren't existing fifty -foot easement being used for
LOTS 8,9, & 10 construction? What will future lots have for easements?
USS 3466 Fifty feet? The existing lots would wind up with 100 foot
easements? I also don't feel the natural ground cover could
ever be restored (sited example of an old driveway that is
still barren). KEA lines are currently strung through the
trees; in the future, if they are laid, will it require a
new easement?
Dave Crowe. The current Borough Code will not allow selling land without
constructing the roadways. Your grass could be restored with hydro -seed.
Regarding KEA lines - if KEA can coincide laying their lines with the Borough
project, it will be put in the fifty -foot easement; but the Borough will not
hold up construction waiting on KEA.
FRED BRECHAN Do you propose to go across the existing road with water and
LOT 1, USS 3104 sewer? There is a problem with tree under the road - three
90 -foot trees are there now. Should be rerouted nearer to
Island Lake.
Dave Crowe. The line has been designed for future sites also, so may not be
pract� io do so.

How much will a lot be allowed to be divided into after LOT
sewer and water is installed?
Scott Arndt. This decision will be left up to the Planning and Zoning Commis-
sion and will depend on the lot size and capability of the water and sewer
system, i.e. how many dwellings could hook into one pump.
BRIGETTE OSKOLOKOF Will the Borough provide the line from the pump to the main
LOT 9, USS 3103 line? I'm also concerned about how many trees will come
down on my lot.
Dave Crowe. Yes the Borough will provide that line.
URS. Only the trees that have to will come down and that is discussed with the
owner.
RICHARD RAY Will there be a moratorium on construction (until these
LOT 13, USS 3464 lines are laid)? How are the projects being funded?
Scott Arndt. Yes, because there is no more capacity in the existing lines for
new users.
Dave Crowe. The projects are being funded by State grants; there will be no
assessments.
PAT SZABO Is there any possibility of moving the sewer line back?
LOT 4, USS 3464
URS. No problem, unless adjacent owners object. The line could be dug deeper
to accommodate for a different location.
ILSE REIMNITZ I would like to find out if the line could be changed on my
LOTS 9 & 10 lots.
USS 3464
URS. It could maybe move five feet; but the steep side hill causes problems.
FRED BRECHAN Who currently has control over the existing lines? I've had
LOT 1, USS 3104 no water since Saturday. My line was blown off the main.
Dave Crowe. The Borough has control of the lines. Any problems should be
directed to Borough staff. The contractor requires eight hours notice, but often
Borough staff will try to correct problems.
JIM CURRY. Would variances be a possibility for a change in setbacks
for building sites?
Dave Crowe. That decision would have to be made by the Planning and Zoning

After encouraging the property owners to contact the Borough or URS with any
requests within the next few days, the public discussion ended at 9:00 p.m.
An extended discussion on the merits of constructing the permanent waterline
from Mill Bay Road to Naughton's on Mill Bay then took place. Dave Crowe ex-
plained the litigation which has been filed by Naughton and suggested that this
line be installed to satisfy Naughton's request and stay out of court if
possible.
Scott Arndt stated he was against this approach because it would provide water
to a new area before sewer is provided to areas which already have water and he
didn't like being blackmailed.
Dave Crowe explained that this waterline was included in the original scope of
work for the Island Lake water and sewer improvements and completion of the
entire project was the basis for obtaining the most recent $2.125 million grant
from the Legislature.
After further discussion, Carolyn Brisco, Jim Poulos and Norm Wooten indicated
they were in favor of installing this permanent waterline and Scott Arndt was
opposed.
A proposal for installing this permanent water line will be placed on the
Assembly agenda for the September meeting.
There being no further business, the meeting adjourned at 10:30 p.m.
