MINUTES OF PREVIOUS MEETINGS COMMISSIONER STEWART MOVED TO ACCEPT the minutes of the May 19, 1999, and minutes of the April 21, 1999 Planning and Zoning Commission regular meeting, as submitted. The motion was seconded by COMMISSIONER BELL, and CARRIED by unanimous voice vote. V. AUDIENCE COMMENTS AND APPEARANCE REQUESTS There were no audience comments or appearance requests. Request for preliminary approval of the creation of Tract A, Kiliuda Bay (ADL #223574) including twenty-five (25) foot access easements along each side lot line, located within Section 17, T33S, R24W, Seward Meridian. Kiliuda Bay, Kodiak Island. BOB SCHOLZE indicated seven (7) public hearing notices were mailed for this case, and none were returned. Staff recommended approval of this request subject to three (3) conditions. COMMISSIONER SELIG MOVED TO GRANT preliminary approval of the creation of Tract A, Kiliuda Bay (ADL #223574) including twenty-five (25) foot access easements on each side lot lines located within Section 17, T33S, R24W, Seward Meridian, subject to the conditions of approval contained in the staff report dated May 25, 1999 and to adopt the findings in that staff report as "Findings of Fact" for this case. CONDITIONS OF APPROVAL 1. Plat a twenty-five (25) foot wide public access and utility easement around the interior of the parcel along the lot lines and a fifty (50) foot wide public access easement upland along the mean high water mark of Kiliuda Bay, as required by State DNR. 2. On the final plat, designate the lot being created as Tract A, Kiliuda Bay. 3. On the final plat, delete the phrase "more or less" referring to lot area. FINDINGS OF FACT 1. This plat meets the minimum standards of survey accuracy and proper preparation of plats required in Title 16 of the Borough Code. 2. Request for preliminary approval of the subdivision of Lot 17, Block 14, Kodiak Townsite, and of a portion of the Hillcrest St. East right-of-way, creating Lots 17A &17B, Block 14, Kodiak Townsite. 115 Hillcrest St. East. BOB SCHOLZE indicated twenty-eight (28) public hearing notices were mailed for this case, and one was returned expressing concern of right-of-way road access which crosses over the Cannon's property to Lot 17. Staff fiirther reported that the Cannons expressed a desire to resolve the road encroachment issue before properties dependent on the road for access are subdivided, since that potentially can result in greater density and increased traffic across their private property. Staff recommended postponement of request until next month's meeting to allow the Cannons and the City of Kodiak to resolve the road encroachment issue, and since there had been no concurrence from applicant. Request for preliminary approval of the subdivision of portions of Lots 1 & 2, Block 2, Southeast Addition #2, U.S. Survey 3066AB, creating Lots 113 & 1C, Block 2, Southeast Addition #2, U.S. Survey 3066AB, and a waiver, according to KIBC 16.110.010, from the requirements of KIBC 16.40.050.B.3.a.i, to allow a single flag stem of twenty-four (24) feet instead of a minimum thirty (30) feet. 1841 Mission Road. BOB SCHOLZE indicated forty-three (43) public hearing notices were mailed for this case, and none were returned. A letter of support was submitted by an adjacent property owner in favor of request. Staff recommended that the P & Z Minutes: June 16, 1999 Page 3 of 16 Commission grant first the waiver request, and then approve the request for preliminary plat approval subject to five (5) conditions. COMMISSIONER STEWART MOVED TO GRANT a waiver, in accordance with KIBC Section 16.110.010 (Waiver from Requirements) of the Borough Code, to permit the subdivision of portions of Lots 1 and 2, Block 2, Southeast Addition #2, U. S. Survey 3066AB into two lots, with the flagstem of proposed Lot 111 twenty-four (24) feet in width instead of thirty (30) feet in width as required by KIBC 16.40.050.B.3.a.i, and to adopt the findings contained in the staff report dated May 25, 1999 as "Findings of Fact' for this case. FINDINGS OF FACT (WAIVER) 1. There is no appreciable advantage gained in this case by requiring a thirty (30) foot wide flagstem. Twenty-four (24) feet satisfies the minimum width requirement for two-way traffic in Chapter 17.57 of Borough Code addressing parking. It also exceeds the twenty (20) foot width that would be required for a flagstem were it adjacent to another flagstem. Since the developable area of the flag lot is almost entirely occupied with the existing warehouse, the intensity of use and level of parking required have been established with little likelihood that it will change. Twenty-four (24) foot flagstem width should be adequate to meet these needs. This provides for simultaneous ingress/egress, if necessary. The three (3) parking spaces required for the use on Lot I can be provided on the east side of the warehouse at the rear of the stem of the flag if the access component of the fifteen (15) foot wide on that side of the lot is vacated. 2. Because of established development and conditions on the property, strict application of the requirement for a thirty (30) foot wide flagstem would result in real difficulties and/or substantial hardship. The applicant would like to isolate the business use and the residential use on separate lots. He has indicated that he feels this would be a more practical use of the property. It will also facilitate sale of the house, allowing him continued use of the warehouse for commercial fishing gear storage for which it was designed. Without a waiver, the applicant faces real difficulties utilizing the property in this way as well as substantial financial hardship. The waiver will allow the applicant to develop his property in a reasonable manner. Since conditions of approval will require that all building and fire codes for adjacent uses be met, the public welfare and interests of the borough and surrounding areas will be protected. This will satisfy the general intent and spirit of the regulations. The motion was SECONDED by COMMISSIONER SELIG. P & Z Minutes: June 16, 1999 Page 4 of 16 Regular session closed. CONDITIONS OF APPROVAL Prior to final plat approval, the deck and steps on the east side of the house encroaching into the flagstem of proposed Lot 1B, as well as encroaching portions of the fence, will be removed. 2. Prior to final plat approval, portions of existing structures near property lines being created will be modified and/or removed as may be required to comply with the Uniform Building Code. 3. Designate on the final plat the entire flagstem of proposed Lot 113 as a utility easement, since exact location of water and sewer lines to the house are unknown and as requested by KEA. 4. As required by the City of Kodiak Public Works Department, prior to final plat approval existing water and sewer lines running between structures and crossing lot lines need to be properly removed and capped. 5. Prior to final plat approval, the three (3) parking spaces required by code for the warehouse use on proposed Lot 113 shall be made available on the lot in an area clear of outdoor storage, unencumbered by access easement and otherwise meeting the applicable parking development standards of KIBC 17.57. With grant of a waiver and required conditions of approval, this plat meets the minimum standards of survey accuracy and proper preparation of plats required in Title 16 of the Borough Code. 2. Request for preliminary approval of the subdivision of Lot 12, U.S. Survey 3100, creating Lots 12A, 12B, and 12C, U.S. Survey 3100. 3337 Spruce Cape Road. BOB SCHOLZE indicated forty-four (44) public hearing notices were mailed for this case, and none were returned. Staff further reported that a condition of approval, standard with creation of residential lots containing structures but no residence, was overlooked during discussion of this case at the worksession held the previous Wednesday, therefore staff recommended that it be included as condition #4 with approval of request subject to four (4) conditions. COMMISSIONER STEWART MOVED TO GRANT preliminary approval of the subdivision of Lot 12, U.S. Survey 3100, creating Lots 12A, 12B, and 12C, U.S. Survey 3100, subject to the conditions of approval contained in the supplemental memorandum dated June 15, 1999, and to adopt the findings in the staff report dated May 25, 1999 as "Findings of Fact" for this case. CONDITIONS OF APPROVAL 1. As required by the City of Kodiak Public Works Department, prior to final plat approval existing structures to be served by sewer and water must P & Z Minutes: June 16, 1999 Page 6 of 16 have individual services installed with appropriate permits and inspections. Existing water and sewer lines running between structures and crossing lot lines need to be properly removed and capped. 2. Place a note on the final plat stating: "Driveway improvements along the flagstem of Lot 12c will require a culvert to ensure that continuous, uninterrupted southerly flow of the small stream is maintained." 3. Designate the flagstem of proposed Lot 12C as a utility easement, as requested by KEA. 4. Since accessory buildings are not permitted in a residential zoning district without a main dwelling, the trailer and frame structure on proposed Lot 12A, presently unoccupied, must be removed from the property. In the alternative, zoning compliance and building permits and a certificate of occupancy, if building codes can be met, must be issued within six (6) months after final plat approval for conversion of the frame structure into a legal dwelling unit. Absent one or the other, zoning enforcement action will have to be initiated. FINDINGS OF FACT 1. Staff recommended approval of this request subject to two (2) conditions. COMMISSIONER SELIG MOVED TO GRANT preliminary approval of the vacation of an eighteen (18) inch by eighty (80) foot portion of the Marine Way right-of-way adjacent to Lot 7, Block 5, New Kodiak Subdivision, subject to the conditions of approval contained in the staff report dated May 25, 1999, and to adopt the findings in that staff report as "Findings of Fact" for this case. CONDITIONS OF APPROVAL Approval of City Council as outlined in KIBC 16.60.060.A. 2. Replat incorporating the vacated portion of R.O.W. into Lot 7, Block 5, New Kodiak Subdivision. FINDINGS OF FACT 1. The eighteen inch wide by eighty foot long (18" x 80') portion of the Marine Way ROW proposed for vacation has previously been determined to be surplus to the public need as evidence by the Right -of Way Encroachment Permit dated May 4, 1999 issued by the City of Kodiak to the property owner. 2. This vacation and subsequent replat will remedy an existing encroachment, facilitating reasonable expansion of the adjoining business resulting in increased property values and tax revenues. 3. This plat meets all the requirements of Title 16 (Subdivisions) and Title 17 (Zoning) of the Borough Code. The motion was SECONDED by COMMISSIONER STEWART. Regular session closed. Request for preliminary approval of the vacation of Lots 7A-1 and 6B, Woodland Acres Subdivision, V Addition (Plat 98-21), creating Lots 613-1, 7A-IA, and Lot 7B, Woodland Acres Subdivision, 1" Addition. 3851 and 3941 Woodland Drive. BOB SCHOLZE indicated thirty-eight (38) public hearing notices were mailed for this case, and none were returned. Staff further reported that applicant already fulfilled a recommended condition of approval by allocating numbering of lots and a subdivision name. Staff recommended approval of this request. COMMISSIONER STEWART MOVED TO GRANT preliminary approval of the vacation of Lots 7A-1 and 613, Woodland Acres Subdivision, lst Addition, creating Lots 1, 2, and 3, Erwin Estates, and to adopt the findings in the staff report dated May 25, 1999 as "Findings of Fact" for this case. Request for a conditional use permit in accordance with Section 17.16.040.A, Conditional Uses, to permit a temporary firework stand on Lot 18 and Lot 19, Woodland Acres Subdivision, 1" Addition. 3746 and 3788 Sunset Drive. P & Z Minutes: June 16, 1999 Page 9 of 16 BOB SCHOLZE indicated fifty-two (52) public hearing notices were mailed for this case, with two public hearing notices expressing opposition. One public hearing notice requested to be read into the record. Bob further reported that "findings of fact" for approval or denial are available for adoption based upon Commissions final decision. COMMISSIONER BELL MOVED TO GRANT a request for a conditional use permit in accordance with Section 17.16.040. of the Borough Code to permit a temporary firework stand on Lot 18 and Lot 19, Woodland Acres Subdivision, ls` Addition; subject to the conditions of approval contained in the staff report dated May 24, 1999, and to adopt the findings contained in that staff report as "Findings of Fact" for this case. CONDITIONS OF APPROVAL 1. This permit is valid for these two parcels as long as the fireworks sales stand is operated by the agent. Should ownership of one or both parcels transfer to someone other than the current property owner(s)/applicant (Erwin) or the agent (Seaton), this CUP becomes invalid for the transferred parcel(s). 2. The sale of fireworks shall be discontinued by July 11 m each year, with use and structures removed from the lot by that date. 3. The applicant/agent shall provide a copy of the required State of Alaska "Permit for the Sale of Salable Fireworks" to the Community Development Department for each year permitted by the CUP. 4. "No Smoking Within 50 Feet' and "No Fireworks Discharged Within 250 Feet" signs must be place on the premises during the fireworks sale period. 5. A trash receptacle must be provided on site during the fireworks sale period. 6. This conditional use permit is valid from May 20t6 until July 11' of each year permitted. 7. Signage or activity associated with this use within the adjacent road right- of-way requires written permission from the managing authority of the right-of-way. 8. The litter return incentive program outlined by the applicant in the narrative will be implemented for the fireworks sales period. P & Z Minutes: June 16, 1999 Page 10 of 16 FINDINGS OF FACT 17.67.05 A. That the conditional use will preserve the value spirit character and integrity of the surrounding area. This temporary conditional use permit will preserve the value, spirit, character and integrity of the surrounding area not only because it is seasonal in nature (less than 2 months per year), but also because the lots designated are separated from other developed property by road rights -of -way, distance, and wooded areas. Adequate off-street parking is available, and previous fireworks sales at this location have not generated any complaints from surrounding property owners. 17 67 05 B. That the conditional use fulfills all other requirements of this chapter pertaining to the conditional use in question. The temporary fireworks sales stand fulfills all other requirements of the RR - Rural Residential One zoning district. In addition, the applicant must obtain a permit to sell fireworks from the office of the State Fire Marshal. 17 67 05 C. That granting the conditional use permit will not be -harmful to the public health, safety. convenience and comfort. Measures are taken through the conditions of approval prohibiting smoking and discharge of fireworks on site, litter clean-up incentives, trash receptacles in site, and a State permit for sales of fireworks to protect public health, safety, convenience and comfort. Departmental files indicate that previous seasonal fireworks sales on this site, controlled by conditions of approval, have not resulted in complaints or safety violations. In his narrative, the applicant has outlined a litter return incentive program, implementation of which is recommended as a condition of approval. This should help reduce potential negative off -site impacts related to litter. 17.67,05 D. That sufficient setbacks lot area. buffers or other safeguards are being provided to meet the conditions listed in subsections A through C of this section. Additional buffers or other safeguards are not necessary in this case because of the location of the fireworks sales stand, which in previous years has proved to be adequately separated from nearby residences. Vegetation and trees on the vacant lots also serve to buffer potential impacts. The motion was SECONDED by COMMISSIONER HIMES. Regular session closed. P & Z Minutes: June 16, 1999 Page 1 1 of 16 Public hearing opened: ([[ Mr. Les Seaton -Agent: Mr. Seaton agreed with all conditions to be met with request, and wanted to be positive business regarding trash clean-up with program, and traffic control. Mr. Seaton informed the Commission that they have to comply with all State laws at all times and are not allowed to sell to anyone under 18 unless accompanied by an adult. COMMISSIONER SELIG questioned who does the clean up. Mr. Seaton replied that the kids clean up Mill Bay beach/surrounding area, with the stand keeping count of who returns the bags of garbage, and are informed that they can not receive the reward unless accompanied by an adult. COMMISSIONER SELIG questioned how the firework stand complies with the curfew issue. Mr. Seaton explained hours of operation does not exceed beyond 12:00 p.m. COMMISSIONER SELIG recommended hours of operations comply with curfew ordinance. COMMISSIONER BELL questioned why there are two fireworks stand in operation in the past? Mr. Seaton replied that Les `n Dan's is not operating in the Bells Flats area due to construction, and that competitor is not in operation on lot location request is for. COMMISSIONER BELL was concerned with foot traffic across Mill Bay Road. Mr. Seaton was not aware of problem since he had not previously operated the firework stand in that particular lot. COMMISSIONER STEWART questioned if fireworks were ever allowed to be fired around stand. Mr. Seaton replied that State requires 250' setback from firework stand. Further discussion was held. COMMISSIONER HIMES questioned if request if for current year or for next. BOB SCHOLZE clarified request is for year 2000 operation. Bob ftuther reported that this specific stand needs a CUP due to RR -Rural Residential zoning. COMMISSIONER SELIG questioned staff exact year of operations, and if it is a renewal process. Bob clarified it would be for year 2000 operation, then there after would be a renewal request. JENNIFER SMITH read into the record as requested the a public hearing notice from Katherine Simpler, property owner of Lot 113, Tract A, Woodland Acres, lst Addition, dated and received on June 8, 1999 (per attached). This conditional use permit is valid from May 20, 2000 to July 11, 2000. The motion was SECONDED by COMMISSIONER BELL. The question was called and the amended motion CARRIED by unanimous roll call vote. COMMISSIONER SELIG moved to AMEND condition of approval # 2 to read as: 2. The sale of fireworks shall be discontinued by July 11, 2000 with use and structures removed from the lot by that date. The motion was by COMMISSIONER HIMES. The question was called and the amended motion CARRIED by unanimous roll call vote. CHAIR TURNER passed the gavel to VICE CHAIR SELIG at 8:24 p.m. COMMISSIONER TURNER expressed her opposition to the CUP request, due to increased foot and vehicle traffic which could cause potential public safety hazard, and the negative impact on the neighborhood. COMMISSIONER TURNER further expressed that the current permit should expire. VICE CHAIR SELIG returned the gavel back to CHAIR TURNER 8:26 p.m. The question was called and the MAIN MOTION FAILED by unanimous roll call vote. COMMISSIONER HIMES MOVED TO ADOPT the findings for denial contained in the supplemental memorandum dated June 11, 1999, as "Findings of Fact' for this case. FINDINGS OF FACT 17.67.05 A That the conditional use will preserve the value. spirit. character and integrity of the surrounding area. P & Z Minutes: June 16, 1999 Page 13 of 16 This temporary conditional use permit may compromise the value, spirit, character and integrity of the surrounding area as evidenced by public hearing responses submitted in opposition to the request. The commercial use, generating high traffic volume at an already dangerous intersection, is incompatible with nearby residential uses. Noise generated from discharge of fireworks as well as evening sales activities, and the documented potential for litter as a by-product, are not consistent with residential neighborhood character. There are numerous vacant or partially vacant B-Business zoned properties along Rezanof Drive within a few hundred yards that could more appropriately serve for this commercial use, one of which in fact does for this same business enterprise. 17 67.05 B. That the conditional use fulfills all other requirements of this chapter pertaining to the conditional use in question. As indicated in public hearing responses submitted by neighbors, it does not appear that controls and safeguards can assure compatibility of this use with the zoning district's principal permitted use —residential. It has not been demonstrated how negative impacts of noise, litter, traffic and public safety hazards cannot be substantially mitigated. 17,67.05 C. That granting the conditional use permit will not be harmful to the public health, safety. convenience and comfort. Public health and safety may be compromised not only by the dangerous nature of fireworks themselves with potential to cause physical harm if improperly handled by children or others, but also by excessive traffic, much of which may be illegal 4-wheeler traffic, which will exacerbate conditions at an already dangerous intersection. 17 67 05 D. That sufficient setbacks lot area buffers or other safeguards are being provided to meet the conditions listed in subsections A through C of this section. The properties proposed for this use area vacant and wooded. However, traffic attracted to the fireworks stand, whether legal vehicle traffic or illegal ATV traffic, will have the effect of disrupting established traditional residential pursuits and activities on neighboring lots. No buffer can effectively reduce the noise of fireworks to a level acceptable to residential neighborhoods. The motion was SECONDED by COMMISSIONER STEWART. REPORTS BOB SCHOLZE reported on the following: 1) ADOT, HDR Alaska, and Planning & Zoning Commission joint worksession regarding the State Airport Master Plan scheduled on June 23, 1999 at 7:30 p.m. in the KIB conference room. 2) Only packet review worksession and regular meeting for July and August are scheduled, due to staff travel/shortage.
