PUBLIC HEARINGS A) Case 598-012. Request for preliminary approval of the subdivision of Lot 5, Block 7, Bells Flats Alaska Subdivision, creating Lots 5A, 5B, 5C & 5D, Block 7, Bells Flats Alaska Subdivision. 11587 Middle Bay Drive. BOB SCHOLZE indicated 39 public hearing notices were mailed for this case and none were returned. He stated that Island Cable TV had submitted a letter on July 13, withdrawing their earlier request for a utility easement. Staff recommended approval of this request subject to 3 conditions. COMMISSIONER BELL MOVED TO GRANT preliminary approval of the subdivision of Lot 5, Block 7, Bells Flats Alaska Subdivision creating Lots 5A, 513, 5C and 5D, Block 7, Bells Flats Subdivision, subject to the conditions of approval contained in the staff report dated June 30, 1998 and to adopt the findings in that staff report as "Findings of Fact" for this case. CONDITIONS OF APPROVAL 1. Prior to final plat approval, the applicant must provide documentation from a certified engineer demonstrating that each of these proposed lots can meet the wastewater disposal standards of ADEC and have access to an adequate amount of potable water for domestic purposes, as required by KIBC 16.70.020.13 2. The business use of the office space above the garage on proposed Lot 5B must be in conformance with zoning code specifications for a home occupation. 3. Reference Plat # 69-04, not Plat # 78-17, as the previous plat of record in the property legal description block on the final plat. FINDINGS OF FACT 1. This plat meets the minimum standards of survey accuracy and proper preparation of plats required in Title 16 of the Borough Code. 2. This plat meets all the requirements of Title 17 of the Borough Code. 3. This plat provides a subdivision of land that is consistent with adopted Borough plans for this area. The motion was SECONDED. BOB SCHOLZE indicated 24 public hearing notices were mailed for this case and none were returned. Staff recommended approval of this request subject to 3 conditions. COMMISSIONER SELIG MOVED TO GRANT preliminary approval of the subdivision of Tract D, Russian Creek Alaska Subdivision creating Lots D-1, D-2, D-3, and D-4, Russian Creek Alaska Subdivision, subject to the conditions of approval contained in the staff report dated June 30, 1998 and to adopt the findings in that staff report as "Findings of Fact" for this case. The shed (approximately 20 ft. x 20 ft.) on the west side of proposed Lot D-1 near the flagstems will be demolished or moved to a location complying with setbacks being created by the subdivision since it will encroach the required twenty (20) foot side yard setback of proposed Lot D-1.
