CALL TO ORDER The regular meeting of the Planning and Zoning Commission was called to order at 7:35 p.m. by Chair Friend on July 19, 1995 in the Borough Assembly Chambers. II. APPROVAL OF AGENDA Staff reported no additions to the agenda: COMMISSIONER KNAUF MOVED TO ACCEPT the agenda as presented by staff. The motion was seconded and CARRIED by unanimous voice vote. IV. MINUTES OF PREVIOUS MEETING COMMISSIONER GORDON MOVED TO ACCEPT the minutes of the June 21, 1995 Planning and Zoning Commission regular meeting as presented. The motion was seconded and CARRIED by unanimous voice vote. P & Z Minutes: July 19, 1995 Page 1 of 18 V. AUDIENCE COMMENTS AND APPEARANCE REQUESTS There were no audience comments. A) Case S91-020. Request for a two (2) year extension of preliminary approval (until July 19, 1997) of the subdivision of Lot 26, U.S. Survey 3099, creating Lots 26A, 2613, 26C, & 26D, U.S. Survey 3099. 2756 Spruce Cape Road. LINDA FREED reported that this was the second extension request for this case. Staff recommended approval of an extension of preliminary approval, until July 19, 1997, and reconfirmation of the seven conditions of approval. COMMISSIONER GORDON MOVED TO APPROVE an extension until July 19, 1997 of the revised preliminary approval of the subdivision of Lot 26, U.S. Survey 3099, creating Lots 26A, 2613, 26C, and 26D, U.S. Survey 3099 and to confirm the seven (7) conditions of approval referenced in the main and amended motions for a two-year extension and ` approval of a revised preliminary plat approval. (! CONDITIONS OF APPROVAL 1. The warehouse on Lot 26A should be connected to public sewer and water. 2. Place a note on the plat restricting further connections to the 6" sewer service line crossing Lot 26B and 26D from Jackson Mobile Home Park's Lots 27 and 28. It would be in the best interest of the subdivider to have Jackson Trailer Court abandon this line and to tie into the 8" public sewer line that crosses Lot 27. 3. Address off-street parking needs, since existing parking relies on the road right-of-way along Spruce Cape Road. 4. Remove or remodel the lean-to on the mobile home on Lot 4 that encumbers Lot 26C and is within the utility easement. 5. Provide fifteen (15) foot utility easements adjacent to both the westerly boundary of Lot 26C and the easterly P & Z Minutes: July 19, 1995 Page 2 of 18 boundary of Lot 26D. This will allow utility access to the back lots when further development occurs. 6. Reconfigure plat to provide (minimum 20 foot) flagstems for access to Lots 26C and 26D from Spruce Cape Road. 7. Plat must come back to the Planning and Zoning Commission for review, prior to final approval. The motion was seconded and CARRIED by unanimous roll call vote. There were no further audience comments or appearance requests. VI. PUBLIC HEARINGS A) Case 95-013. Planning and Zoning Commission determination that the property line bordering Cedar Street, rather than Willow Street, be designated as the front property line, for the purpose of calculating building set -backs. Lot 4, Block 7, Aleutian Homes Subdivision, 417 Cedar Street. LINDA FREED indicated 47 public hearing notices were mailed for this case and 1 was returned, stating non -objection to this request. Staff recommended approval of this request. COMMISSIONER GORDON MOVED TO DETERMINE that the property line bordering Cedar Street, rather than Willow Street, be designated as the front property line for the purpose of calculating building setbacks, on Lot 4, Block 7, Aleutian Homes Subdivision, and to adopt the findings contained in the staff report dated June 28, 1995 as "Findings of Fact" for this case. FINDINGS OF FACT 1. The actual front of the house is oriented toward Cedar Street. If the applicant is to be able to construct an arctic entry on the front of his house facing Cedar Street as deep (measured in distance out from the front of the existing house) as his immediate neighbors on Lots 7 and 8 could construct by right, he needs a determination that Cedar Street is the front of his property for determining setbacks. When building/zoning permit #4846 was issued to the applicant to expand the porch on the front of his house in 1982, Cedar Street was apparently designated as the front yard by the zoning official at that time and the applicant has made plans for his arctic entry based on that designation. 3. There is nothing to indicate that this determination, which would have the net effect of permitting construction on Lot 4 two feet closer to Cedar Street than would otherwise be permitted, would have a negative impact or detrimental effect on the neighborhood. Request for a conditional use permit, in accordance with Section 17.13.040.8 of the Borough Code, to allow a radionavigation facility, including a 120' tower, an 18 acre ground plane, two reference masts (10' - 35'), a 10' X 16' equipment shelter, and other miscellaneous equipment, to be located in the C--Conservation zoning district. Located within U.S. Survey 5704 (near Miller Field, Cape Chiniak). LINDA FREED indicated 12 public hearing notices were mailed for this case and none were returned. Staff recommended approval of this request, subject to three (3) conditions. COMMISSIONER GORDON MOVED TO GRANT a request for a conditional use permit, to permit a radionavigation facility, including a 120' tower, an 18 acre ground plane, two reference masts (10' - 35'), a 10' X 16' equipment shelter, and other miscellaneous equipment, on approximately twenty (20) acres P & Z Minutes: July 19, 1995 Page 4 of 18 located within U.S. Survey 5704, west of Miller Field; subject to the conditions of approval contained in the staff report dated July 7, 1995; and to adopt the findings in that staff report as "Findings of Fact" for this case. CONDITIONS OF APPROVAL 1. Provide a metes and bounds survey description of the lease (project) area, to which the CUP will apply. 2. Obtain, if required, an Army Corps of Engineers permit for project development. 3. Comply with the notification and review procedures of the Alaska Forestry Practices Act for the project site. FINDINGS OF FACT 17.67.05 A. That the conditional use will preserve the value, spirit, character and integrity of the surrounding area. The conditional use will preserve the value, spirit, character and integrity of the surrounding area to the extent that potential impacts on bird life and wetlands are effectively mitigated. The Environmental Assessment for the project notes that the tower may present a collision hazard to birds, but that its setback 300 feet from the shore and installation of bird flight diverters at five (5) meter intervals on the guy wires mitigates this negative impact. The ground plane wires would end above the high tide line along the shore to minimize impacts on wetland areas from construction activities. In addition, a U.S. Army Corps of Engineers review and permit is required for any proposed fill of wetlands. The proposed clearing of approximately ten (10) acres of trees is subject to review and approval by ADNR under the Alaska Forest Practices Act to control regulated negative impacts from timber harvesting. P & Z Minutes: July 19, 1995 Page 5 of 18 There should be minimal negative impact on nearby residential areas since they are more than 1,000 feet away from the project site. 17.67.05 B. That the conditional use fulfills all other requirements of this chapter pertaining to the conditional use in question. Based on the site plan and other supporting documentation, it appears that the conditional use will fulfill all other requirements of Chapter 17.13 (C--Conservation Zoning District) of the Borough Code. The special district regulations for the C--Conservation zoning district (KIBC 17.13.090) concerning impacts on the natural environment and preservation of natural features specific to vegetation coverage, drainage patterns, erosion, and water quality and flow will be addressed in the Corps of Engineer permit evaluations and the State of Alaska Coastal Management consistency determination, if applicable. In addition, a review will be conducted by ADNR-Division of Forestry for compliance with the State Forest Practices Act (FPA). There is no scientific evidence that development of this project will have a cumulative effect resulting in a major impairment of the environment, as referenced in KIBC 17.13.090.2.b. 17.67.05 C. That granting the conditional use permit will not be harmful to the public health, safety, convenience and comfort. This broadcast facility will be constructed and maintained in accordance with all applicable federal, state and local requirements. The tower and related structures will be constructed to the standards required in the Uniform Building Code as well as whatever additional standards may apply to military construction. The communications equipment will be installed and operated in compliance with all applicable FAA and FCC regulations. A Coast Guard report states that, generally speaking, DGPS broadcasts consist of low power signal transmissions at frequencies already authorized for maritime use (285 to 325 Khz) and that the generation and transmission of these signals does not produce effluents or by-products. Signal P & Z Minutes: July 19, 1995 Page 6 of 18 transmissions in this frequency and power level have not been found to be harmful to the surrounding environment. In fact, installation of this facility should prove beneficial to the public health, safety, convenience and comfort by providing upgraded navigational signals in the Kodiak region. 17.67.05 D. That sufficient setbacks, lot area, buffers or other safeguards are being provided to meet the conditions listed in subsections A through C of this section. Even more that the twenty-five (25) foot setbacks required by C--Conservation zoning district; the vegetation, natural topography of the area and distance from any residential development will serve to provide buffering and safeguards against conflicts arising from potential incompatibilities between the proposed development and the nearest residential uses. 17.67.05 E. If the permit is for a public use or structure, the commission must find that the proposed use or structure is f located in a manner which will maximize public benefits This proposed public use is located in a manner which will maximize public benefits as evidenced by the fact that it was selected from nine potential Kodiak area sites as best meeting the DGPS site criteria established for the project. This DGPS will enhance the accuracy of navigational information covering the Gulf of Alaska Region by increasing it from 100 meter accuracy to 10 meter accuracy. This will make marine and land navigation in the Kodiak area significantly safer. The motion was seconded. Regular Session Closed. Public Hearing Opened: Betty Odell, Chiniak resident, telephoned to express concern that public access to nearby beaches and other recreational areas is not obstructed or restricted by the proposed activities. LT Clement Ketchum, representing the U.S. Coast Guard, appeared before the Commission and expressed support for this request, and clarified that the proposed development would not P & Z Minutes: July 19, 1995 Page 7 of 18 = prohibit or restrict public access to surrounding recreational areas. He stated that the only area that would be fenced was the area immediately surrounding the antenna tower, the equipment shelter and other miscellaneous equipment. Aside from standard warning signs about not disturbing the equipment, and the small fenced area, there would be no other access restrictions as a result of the project. Public Hearing Closed. Regular Session Opened. The question was called and the motion CARRIED by unanimous roll call vote. C) Case 95-015. A rezone in accordance with Section 17.72.030 C of the Borough Code, of portions of the property transferred to the Kodiak Island Borough by the Ouzinkie Native Corporation (thru ANILCA) for watershed purposes, outside the area currently zoned watershed, including Borough -owned land at the end of the road in Monashka Bay from C--Conservation to NU --Natural Use. LINDA FREED indicated 12 public hearing notices were mailed for this case and 5 were returned, in favor of the request, with 3 of those requesting the rezone area be increased to include that portion of Borough land which encompassed the public beach area. Staff concurred with this proposed increase in area, and recommended the rezone request be forwarded to the Borough Assembly with a recommendation of approval. COMMISSIONER BELL MOVED TO RECOMMEND that the Kodiak Island Borough Assembly approve the rezoning of portions of the property transferred to the Kodiak Island Borough by the Ouzinkie Native Corporation (thru ANILCA) for watershed purposes, outside the area currently zoned watershed, including Borough -owned land at the end of the road in Monashka Bay from C--Conservation to NU --Natural Use, and to adopt the findings of fact in the staff report dated July 6, 1995, in support of this recommendation. FINDINGS OF FACT 17.72.020 A. Findings as to the Need and Justification for a Change or Amendment. P & Z Minutes: July 19, 1995 Page 8 of 18 A rezone of property adjacent to the Monashka Creek watershed from C--Conservation to NU -Natural Use Lands is needed and justified because the NU -Natural Use Lands zoning district: A. will serve as a buffer to insure good water quality is maintained by better protecting the municipal watershed, a stated objective of the Monashka Bay Comprehensive Plan; B. will provide, consistent with objectives stated in the Monashka Bay Comprehensive Plan, a greater measure of protection for the environment and preservation of recreational opportunities and natural amenities in this area which is principally used for a range of recreational activities including hiking, camping, fishing, hunting, sightseeing, and beachcombing; C. is consistent with local ordinances developed by the City of Kodiak to further protect its watershed; D. is consistent with the specific reasons contained within ANILCA for which this property was transferred to the Borough; E. will prohibit more intensive land uses permitted in the C- -Conservation zoning district that are not compatible with protection of watershed and enhancement of recreational value. 17.72.020 B. Findings as to the Effect a Change or Amendment would have on the Objectives of the Comprehensive Plan. A change of zoning from C--Conservation to the NU -Natural Use Lands zoning district is consistent with the 1968 Borough Comprehensive Plan which generally designates this area as a watershed reserve. More intensive land uses are available under the C--Conservation zoning district. As a buffer zone, the NU -Natural Use Lands zoning district provides a greater measure of watershed protection. P & Z Minutes: July 19, 1995 Page 9 of 18 - This rezone is also consistent with stated objectives of the Monashka Bay Comprehensive Plan including watershed protection and designation and development of public land for hiking trails, beach/park areas, and other recreational uses. The motion was seconded. Regular Session Closed. Public Hearing Opened: Mary Forbes, representing Kodiak Audobon Society, appeared before the Commission and expressed support for this request, and her agreement with the suggestion to include the beach area in the proposed rezone. COMMISSIONER KNAUF MOVED TO AMEND THE MAIN MOTION to include the area of C--Conservation Borough owned land to the southern border of Section 13, within T27S R20W, in the proposed rezone area, and that the rezone area be specifically identified by a metes and bounds description. The AMENDMENT was seconded and CARRIED by unanimous roll call vote. The question was called and the MAIN MOTION AS AMENDED CARRIED by unanimous roll call vote. D) Case S95-012. Request for preliminary approval of the vacation of Lots 1, 2, and 3, U.S. Survey 9901; Lot 2, U.S. Survey 5699; and Lot 2, U.S. Survey 484, and replat to Natives of Kodiak, Woody Island Reserve, U.S. Surveys, 484, 5699, and 9901. LINDA FREED indicated 17 public hearing notices were mailed for this case and none were returned. At the request of the applicant, staff recommended postponement of this request until the September, 1995 regular meeting. COMMISSIONER TURNER MOVED TO GRANT preliminary approval of the vacation of Lots 1, 2, and 3, U.S. Survey 9901; Lot 2, U.S. Survey 5699; and Lot 2, U.S. Survey 484, and replat P & Z Minutes: July 19, 1995 Page 10 of 18 ( to Natives of Kodiak, Woody Island Reserve, subject to the conditions of approval contained in the staff report dated July 2, 1995, and to adopt the findings contained in that staff report as "Findings of Fact" for this case. 2 CONDITIONS OF APPROVAL 1. Provide a ten (10) foot wide electrical easement on Lot 2, U.S. Survey 5699 for an existing service to the unsubdivided portion of Tract B, U.S. Survey 603. 2. Designate the sixty (60) foot wide 17-B easements on Lot 2, U.S. Survey 484, and Lot 1, U.S. Survey 9901, as 17-B and utility easements. FINDINGS OF FACT 1. This plat meets the minimum standards of survey accuracy and proper preparation of plats required in Title 16 of the Borough Code. 2. This plat meets all the requirements of Title 17 of the Borough Code. 3. This plat provides a subdivision of land that is consistent with adopted Borough plans for this area. The motion was seconded. Staff recommended approval of this request, subject to four (4) conditions. COMMISSIONER KNAUF MOVED TO GRANT preliminary approval of the creation of Lots 1 through 10, within Block 1, Tract C, Ouzinkie Townsite, subject to the conditions of approval contained in the staff report dated July 3, 1995 and to adopt the findings contained in that staff report as "Findings of Fact" for this case. CONDITIONS OF APPROVAL 1. Extend the public water system to the subdivision. 2. Extend or construct a public sanitary sewer collection system as approved by the U.S. Health Service and ADEC. 3. Upgrade, to City of Ouzinkie road standards, the existing unnamed road created by this plat and construct the Spruce Street extension to City of Ouzinkie road standards. 4. Name the sixty (60) foot wide platted road adjacent to proposed Lots 1 and 2. FINDINGS OF FACT 1. Request for preliminary approval of the vacation of Lots 7D and 8A, Block 1, Kadiak Alaska Subdivision, 1st Addition, and replat to Lots 8A-1, 713-1 and 713-2, Block 1, Kadiak Alaska Subdivision, 1st Addition, and the vacation of plat notes prohibiting the further subdivision of Lots 7D and 8A. 3529 and 3547 Sharatin Road. LINDA FREED indicated 52 public hearing notices were mailed for this case and one was returned, stating non -objection to this request. Staff recommended the plat be returned to the applicant for modification and possible reconfiguration to address concerns raised by staff. MS. FREED also indicated that, should the Commission chose to approve the preliminary plat as revised, an alternate motion was provided with suggested conditions of approval and findings of fact. COMMISSIONER KNAUF MOVED TO RETURN the preliminary plat for Case S95-014 to the applicant for modification consistent with the following requirements, and to schedule the case for another public hearing upon resubmittal. 1. Redesign by expanding proposed Lot 713-2 to provide a minimum of 8,000 square feet of contiguous area, exclusive of flagstem, not designated as wetlands on the drainage plan submitted for Case S94-014. 2. A plat note stating that further subdivision of lots with flagstems is prohibited. 3. Retain the plat note stating "In the course of developing individual lots in this subdivision, the naturally occurring pond/wetland areas shall not be filled or excavated." G) Case S95-015. Request for preliminary approval of the subdivision of Lot 7A, Block 1, Kadiak Alaska Subdivision, 1st Addition, creating Lots 7A-1, 7A-2, 7A-3, and 7A-4, Block 1, Kadiak Alaska Subdivision, 1st Addition. LINDA FREED indicated 17 public hearing notices were mailed for this case and none were returned. Staff recommended the plat be returned to the applicant for modification and possible reconfiguration to address concerns raised by staff. MS. OLD BUSINESS B) Case S91-013. Request for final approval of the subdivision of Tract A, Block 2, Perez Estates Subdivision, and replat to Lots 2 through 20, Block 2, Perez Estates Subdivision. 3084, 3181, 3218, & 3319 Sharatin Road. LINDA FREED reported that this case was granted conceptual approval, and was before the Commission now for final review and approval of the revisions which included 3 additional access and utility easements as flagstems for Lots 3, 4, & 5. Staff recommended approval of this request, and confirmation of the original conditions of approval. COMMISSIONER TURNER MOVED TO GRANT FINAL APPROVAL of the subdivision of Tract A, Block 2, Perez Estates Subdivision, U.S. Survey 3512, and replat to Lots 2 through 17 and an unsubdivided portion of Tract A, Block 2 Perez Estates, subject to the conditions of approval in the staff report dated July 7, 1995. CONDITIONS OF APPROVAL P & Z Minutes: July 19, 1995 Page 15 of 18 1 1. Place plat notes stating: "Access to Lots 5 and 6 and Lots 10-13, Block 2 is restricted to Wilton White Way or the sixty (60) foot wide access easement". and "The front yard setback for Lots 5-13, Block 2 will be calculated from Wilton White Way or the sixty (60) foot wide access easement". 2. Provide a private road or access agreement between Lots 3, 4, 5, and 6 detailing maintenance and snow plowing responsibilities and administration for the portion of Wilton White Way that extends into the access easement across these properties. 3. Construct the required roadway and water and sewer lines as required by Title 16.70 and Title 17.20 of Borough code. 4. Provide a revised set of construction drawings based on the changes agreed to at the June 8, 1995 meeting and the plan review comments dated April 24, 1995. 5. Obtain approval of an engineered drainage plan from the Borough Engineering/Facilities Department for those lots affected by wetlands and provide an analysis of the downstream effects of increased runoff. 6. Identify and dedicate areas within the subdivision for the placement of dumpsters and mail boxes subject to review and approval of the Borough Engineering/Facilities Department. 7. Extend over Lots 2 and 3, as indicated, the five (5) foot wide utility easement on Wilton White Way adjacent to and south of the sixty (60) foot wide access/utility easement. The motion was seconded. At the request of the Commission, Tony Perez, applicant, appeared to discuss this case. Mr. Perez was concerned that condition of approval #1 would not allow the property owners to take advantage of the best ocean view from their lot. He was P & Z Minutes: July 19, 1995 Page 16 of 18 also concerned about the plat note restricting access to lots fronting both Sharatin Road and Wilton White Way. Also, it was discussed that the lots mentioned in the original conditions of approval didn't coincide with the current proposed lot arrangement, as the lot configuration had changed several times since preliminary approval. The Commission and Mr. Perez agreed that more discussion needed to take place on this plat before final approval, and that a decision should be postponed until the August, 1995 regular meeting. COMMISSIONER KNAUF MOVED TO POSTPONE action on Case S91-013 until the August, 1995 regular meeting. The motion was seconded and CARRIED by unanimous roll call vote. There was no further old business. VIII. NEW BUSINESS There was no new business. IX. COMMUNICATIONS COMMISSIONER KNAUF MOVED TO ACKNOWLEDGE RECEIPT of item A of communications. The motion was seconded and CARRIED by unanimous voice vote. A) Letter dated July 6, 1995 to Jerome Selby, Borough Mayor, from Ken Gordon, Commissioner, RE: Resignation from the Planning and Zoning Commission. There were no further communications. X. REPORTS LINDA FREED reported that this was COMMISSIONER GORDON'S last meeting, which would leave two vacancies on the Planning and Zoning Commission. She encouraged the public to apply at the Borough Clerk's office to serve on the Commission.
