KODIAK ISLAND BOROUGH PLANNING AND ZONING COMMISSION REGULAR MEETING - JUNE 21, 1995 MINUTES CALL TO ORDER The regular meeting of the Planning and Zoning Commission was called to order at 7:35 p.m. by Chair Friend on June 21, 1995 in the Borough Assembly Chambers. ROLL CALL Commissioners Present: Jerrol Friend, Chair Donna Bell Ken Gordon Jeff Knauf Pat Szabo Commissioners Absent: Darlene Turner - Excused A quorum was established. APPROVAL OF AGENDA Others Present: Linda Freed, Director Community Development Dept. Bob Scholze, Associate Planner Community Development Dept. Eileen Probasco, Secretary Community Development Dept. Staff reported no additions to the agenda. COMMISSIONER KNAUF MOVED TO ACCEPT the agenda as presented by staff. The motion was seconded and CARRIED by unanimous voice vote. MINUTES OF PREVIOUS MEETING COMMISSIONER KNAUF MOVED TO ACCEPT the minutes of the May 17, 1995 Planning and Zoning Commission regular meeting as P & Z Minutes: June 21, 1995 Page 1 of 6 presented. The motion was seconded and CARRIED by unanimous voice vote. V. AUDIENCE COMMENTS AND APPEARANCE REQUESTS There were no audience comments. VI. PUBLIC HEARINGS A) Case 95-009. Request for a similar use determination, in accordance with Section 17.03.90 (Similar Uses) of the Borough Code, that a small scale fish processing facility is similar in character and impact to permitted uses in the B--Business zoning district. Lot 18, Block 3, New Kodiak Subdivision, 330 Shelikof Avenue. BOB SCHOLZE indicated 41 public hearing notices were mailed for this case and 4 were returned, stating non -objection to this request, with one expressing concern about possible noise, adequate parking and waste disposal plans. Staff recommended approval of this request. COMMISSIONER SZABO MOVED TO DETERMINE, in accordance with Section 17.03.090 (Similar Uses) of the Borough Code, that the "retail seafood outlet" including "custom seafood processing" on a "very small scale" on Lot 18, Block 3, New Kodiak Subdivision, described in the application letter dated May 26, 1995, is similar in character and impact to the permitted uses of the B--Business zoning district, and will not be obnoxious or detrimental to the community; and to adopt the findings contained in the summary statement dated June 15, 1995 as "Findings of Fact" for this case. FINDINGS OF FACT 1. The uses proposed by the applicant's letter, dated May 26, 1995, that have been identified as "processing" consist of the filleting, vacuum sealing and freezing of seafood. As described, these uses are small in scale and light in intensity, and are intended to be incidental and subsidiary to the retail use of Lot 18, Block 3, New Kodiak Subdivision. Therefore, as it applies to this business on this property, custom seafood processing is P & Z Minutes: June 21, 1995 Page 2 of 6 similar in character and impact to other land uses specifically permitted in the B--Business zoning district. 2. As described in the application letter dated May 26, 1995, custom seafood processing on a small scale should not be obnoxious or detrimental to the welfare of the community or have an negative impact on neighbors. The motion was seconded. Regular Session Closed. Public Hearing Opened: Susan McClure, 318 W. Rezanof Drive, appeared before the Commission to express concern about the possible development of another "cannery", and to ask for clarification about the applicant's intent. Steve Cole, attorney and agent for the applicants, appeared before the Commission to express support for this request, and to explain the proposed operation of the facility to Ms. McClure. Charlie Johnson, co -applicant, appeared before the Commission to answer any questions and express support for this request. Public Hearing Closed. Regular Session Opened. The question was called and the motion CARRIED by unanimous roll call vote. B) Case 95-010. Request for a rezone, in accordance with Section 17.72.030 C of the Borough Code, of Lot 18, Block 3, New Kodiak Subdivision, from B--Business to LI--Light Industrial, 330 Shelikof Avenue. Attorney Steve Cole appeared before the Commission and stated that the applicants wished to withdraw this request for a rezone. He stated that he would follow-up with a letter to staff, confirming this request. No public hearing was held and no Commission action was necessary. Request for preliminary approval of the vacation of Lots 2A, 213, and 2C, Block 5, Miller Point Alaska Subdivision, 1st Addition, and replat to Lots 2A-1, 213-1 and 2C- 1, Block 5, Miller Point Alaska Subdivision, 1st Addition. 378, 396 & 406 Neva Way. BOB SCHOLZE indicated 39 public hearing notices were mailed for this case and none were returned. Staff recommended approval of this request, subject to conditions. COMMISSIONER KNAUF MOVED TO GRANT preliminary approval of the vacation and replat of Lots 2A, 2B and 2C, Block 5, Miller Point Alaska Subdivision, First Addition, creating Lots 2A-1, 213-1, and 2C-1, Block 5, Miller Point Alaska Subdivision, First Addition; subject to the conditions of approval contained in the staff report dated May 31, 1995, and to adopt the findings contained in the staff report dated May 31, 1995, as "Findings of Fact" for this case. CONDITIONS OF APPROVAL 1. Construction of a driveway to Borough standards to the existing house on proposed Lot 213-1 within the forty (40) wide access easement created by this plat covering the back-to-back flagstems of proposed Lots 213-1 and 2C-1. 2. Designation on the plat that the forty (40) foot wide access easement created in the back-to-back flagstems of proposed Lots 213-1 and 2C-1 specifically applies to Lots 213-1 and 2C-1. 3. Relocation of the existing sewer line servicing the house on proposed Lot 213-1, which currently bisects proposed Lot 2C-1, to the twenty (20) foot wide utility easement being created by this plat along the west lot line of proposed Lot 2C-1. FINDINGS OF FACT 1. This plat meets the minimum standards of survey accuracy and proper preparation of plats required in Title 16 of the Borough Code. P & Z Minutes: June 21, 1995 Page 4 of 6 2. This plat meets all the requirements of Title 17 of the Borough Code. 3. This plat provides a subdivision of land that is consistent with adopted Borough plans for this area. The motion was seconded. Regular Session Closed. Public Hearing Opened: Seeing and hearing none. Public Hearing Closed. Regular Session Opened. The question was called and the motion CARRIED by unanimous roll call vote. VII. COMMUNICATIONS COMMISSIONER KNAUF MOVED TO ACKNOWLEDGE RECEIPT of items A through B of communications. The motion was seconded and CARRIED by unanimous voice vote.
