Mrs. Crowe introduced Mr. Will Walton, Planning Director to the audience and the
Commission. Would like to say for myself and the Commission we are glad to see
him on the staff as part of the Planning Department.
III. MINUTES - February 18, 1981. fir. Hill page 4 when I suggested the last paragraph
in Mr. Beehler's letter dated November 3, 1980 be changed it was only meant for
clarification. Mrs. Crowe easier for people to get money that way it should be
easier for the Assembly to get grants, page 9 I do not know if we said that the
area was added to by 300 feet, if I said 300 feet I was wrong, page 3 impound lot!
as it stands now we have no specific zoning for an impound lot. Mr. Ramaglia move(
to accept the minutes with the above corrections. Seconded by Mr. Hill. Motion
IV. APPEARANCE REQUEST - Linda Larsen, Afternoon Delight.
Mr. Gordon the Afternoon Delight bus was originally on the lot behind the
Orpheum Theatre. The bus in now located on lot 12, block 16, Kodiak Townsite it
is zoned business. On October 13 John Pugh was asked to check into the status
of why the bus was located behind the theathre. The Afternoon Delight was
grandfathered in as of June 5, 1980. On January 15, Sandy Kavanaugh notified me
that the bus was moved. Left them a letter stating that they had to have the
Planning and Zoning Commission approval for several reasons, did not list the
reasons, first of all it has to be a permanent foundation, parking. They have bee
out of town and would like to start working again.
Mr. Ball what would be the parking requirements as it stands now?
Mr. Gordon well they do not have any inside seating so they would probably only
Fe 2 or 3 spaces required. Or you could have one space per employee or the square
footage of the bus. It could be set up as a drive through so then they would not
need parking spaces.
Mr. Hill what is the lot size?
Mr. Gudenau 35,Oi10 square feet.
Mr. Ramaglia do they have permission to be on the lot?
Mr. Hodgins Gary Gilbert has given them permission to be on the lot with the
condition that the Planning and Zoning Commission has no problem with it.
Mr. Gordon the Ordinance states that a business must be on a permanent foundation
Mr. Hill that means to jack it up and put blocks under it.
Mr. Gordon that is up to you folks.

Mr. Gordon stated we went out of town for vacation.7he letter that he said that he
left I did not receive until March 11, 1981, a week and a half ago,aas far as
being aware of getting permission from the board to move the bus and open up I have
never had to get it before when we have gone out to the Rodeo, Coast Guard or to
the Crab Festival. We do have a lease with Gary Gilbert on this other lot and we
have worked with Morris Lee on getting the electricity in. You have a letter there
I believe saying that the bus is built to State standards. I am asking for an
exception to open up.

Mr. Gudenau do we grant temporary permits?
Mrs. Crowe no,not on a temporary basis.
Mr. Ramaglia since this is a mobile operation are we,able to grant exceptions or
variances?
Mrs. Crowe best way to handle this would probably be to remand it to one of our
work sessions then bring it up at the April regular meeting.
Mr. Hill are you going to make it a permanent structure or keep it like it is so
r you can move around?
Mrs. Walser how soon do you plan on opening up?
Mrs. Larsen as soon as possible.
Mrs. Crowe variances must have a public hearing.
Discussion on the procedure for variances.
Mr. Hill how about a temporary usage permit for 30 days?,
Mrs. Crowe if a 30 day permit was issued it would have to be with the understand•
ing that we are not giving permission under this section of the Ordinance to
operate for mbre then 301idaysfand that certain cWiteria haverto be met.
Mr. Hill this is just a temporary permit for 30 days and at the end of 30 days
we can then come up with a decision.
Mr. Ball there is no way of guaranteeing that you will be able to stay there.
Mrs. Larsen that is sort of short notice to tell me that I may lose my business
and a job.
Mr. Hodgins our Ordinances do not address temporary exceptions.-

Mrs. Crowe what
is the wish of the Commission?
Mr. Ball I am not against it. But we did get a letter from the Retailers Assoc.
in regard to where it was located before and then it was moved so it does not
fall under the grandfathering anymore. We should have a public hearing.
Mrs. Crowe are you in favor of not having them operate?
Mr. Ball I would not mind giving them a 30 day temporary permit with the under-
standing that, it be scheduled for a public hearing.
Mrs. Crowe could I retiterate for the Staff what you are saying? It is our
intentions to grant a 30 day temporary permit to Afternoon Delight to do business
on lot 12, block 16, Kodiak Townsite and the final decision (April 15, 1981)
for action after a public hearing.
Mr. Ball it should also be stated that if it is turned down the lot should be
returned to the original condition as we do not want any legalities with this.
Mr. Gordon what do you want for parking on this set up?
Mr. Ball they didn't have any over at the other place.
Mrs. Crowe at that time we will have determined what parking is needed.
Mr. Gordon do you want them to come to a work session?
Mrs. Crowe they will naturally come to the one on April 8, 1981 for packet review.
Mr. Gordon they will have a parking lay out?
Mrs. Larsen will bring a lay out of the lot with the bus and parking shown.
Mr. Ball you better bring everything you can because you will have opposition.
Mrs. Crowe you may wish to think about whether or not you will make it a permenarr
structure.

Mrs. Jones yesterday when I was in the City offices there is another person in
town that would like to start another business like this one. What would you lik
to do about it?
Mrs. Crowe bring it up after the meeting.
V. PUBLIC HEARINGS
A. ZONING
1. Z-79-028. A request to amend the Comprehensive Land Use plan to industrial -
USS 2539. (Koniag, Inc)
STAFF REPORT: Mr. Walton gave the staff report as prepared by the planning
department. Read Ordinance 73-12-0. We are not sure if the Ordinance is legal
or not at this point, we will bbtain a legal opinion, if you would like.
If the land was,transferred to Koniag before Ordinance 73-12-0 then they would bi
home free, if you will,in this case.
Discussion on the history of this case between staff and the Commission.
Mrs. Crowe would like to put this off until we can talk to the attorney.
Mr. Ball feels they should go ahead with this request. Mr. Hill agrees.
Mrs. Walser how can we take action if it is already zoned industrial? If Ordinanc
73-12-0 is valid then we are rezoning land from industrial to industrial.
Mr. Ball we would just be reconfirming a decision.
Mr. Ball was the Comprehensive Plan changed then also?
Discussion between the Commission.
Mrs. Crowe if the wish of the Commission is to go ahead with this item, we will
go on to the public hearing.
Mrs. Crowe closed the regular meeting and opened the public hearing.
Mr. Eaton Koniag Inc. Mr. Eaton read Ordinance 73-12-0. Wilton T. White was the
chairman at the time the Ordinance was signed. I spoke with Mr. White and he
assured me that the reason this includes USS 2539 was to accomodate Martin Olidge
dock and a proposed sawmill that was slated to go in on Fry Point. This had to be
rezoned in order to satisfy the financial backers.
Mrs. Crowe where is Fry Point?
Mr. Ball showed Mrs. Crowe.
Mr. Eaton the contract we have with the Coast Guard at this time specfically
says that only the area we are applying for the rezoning can be used for the
purposes as stated previously by the Planner. The issue of magnetic interference
was broughtup some time ago by Koniag. This is one of the reasons I am skeptical
about some of the agruments put forward by Mr. Bernard and tonight I have brought
with me a letter from the Sullivan Association Technology Engineers add Management
It is dated November 7,1979 and has to do with the proposed processing plant that
we had intended out there at that time. The letter states that there are ways
to correct electromagnetic interference.
Mr. Ramaglia we are looking at rezoning 46 acres and you say Shannon Point is
the only area they can build on, are you going to develop the whole area?

Lt. Kenny we are worried about interference so there is no point in going into
a orrection number 1 land that can be developed for light industry goes
down around the corner. Did not know about the Ordinance before tonight.

Lt. Kenny Does not feel that the Ordinance is binding as the intent was differer
from what the Ordinance states. It is spot zoning -It is spot zoning whenever you
zone one piece of land at a time. You are acting without a Comprehensive Plan.
No permits were given to the private citizens after 1972 for that land. Things
were allowed to continue unless they began to interfer in regards to the Shipyard
It got in there by accident, the accident being the 1964 earthquake; it was
permitted to stay there and by 1972 it was drastically reduced in funtion.It was
defunk by 1976. We had more control over the shipyard than we would over just
rezoned land.
Mr. Ball did they ever cause any interference? (they -shipyard)
Lt. Kenny did they? At that time they were not shut down.
Mr. Ball did they ever cause any interference while they were operating that you
know of?
Lt. Kenny You are talking about the shipyard, you have to remember something Mr.
Ball, that at that time the mission of the communication center was considerably
different from what the mission of the communication center is now.It was not at
the facility that it is now. The level of interference has drastically changed
as before there was no 200 mile limit (1976), we also did not have the responsib-
trtity-.of the small boats.
Mr. Gudenau do you object to Mr. Eaton building those buildings with the
technology that he has to limit the interference?
Lt. Kenny I guess what troubles me about Hank's statement is that all I heard
in the letter he read is that they propose to study. I do not think that means
they can do it. If they could put a processing plant in and meet the grounding
requirements it may be fesible. But what has been requested is an unlimited
rezoning of the land to industrial. Koniag has known all along that we (Coast
Guard) would only allow light industrial.
Mr. Ball don't you have large generators?
Lt_ Kenny Yes Sir.
Mr. Ball do they cause you any problems?
Lt. Kenny yes, they cause certain problems.
Mr. Ball then why don't you shut them down and use KEA's?
Lt. Kenny because KEA cannot provide our power. When KEA can provide us (Coast
Guard) with power we will shut down the generator and use KEA's.
Mrs. Crowe when will KEA be able to supply the Coast Guard?
Lt. Kenny e:frter, Terror Lake. is built.
Mr. Ramaglia when Terror Lake goes on the line they may only be able to handle
85% . By 1985 KEA will need 100% of Terror Lake to handle the City.
Lt. Kenny we have been told by KEA's engineers that they may be able to pick us
up in five (5) years. KEA would like to take over our power.
Mrs. Walser Can I ask a technical question? With the improvements of Solid State
Electronics and stuff like that, would that increase the interference, allow you
to pick up more interference or would it limit the interference.
CO Benard this has allowed us to have more sensitive that hear
receivers could
things the old receivers could not hear, longer range communication system when
you go to a longer range you look for signals that are lower, more pronouced
interference. It makes the problem worse.
Mr. Hill Mr. Kenny said that the Coast Guard does not object to the light indust-
rial uses on the land, but it would be objective to heavy industrial. You have
an agreement that is signed and it has the layout of what you can and cannot do
why do we keep going over this?
CO Bernard we are not sure this is binding. But I would suggest to you that the
purpose of zoning is to protect the adjacent land users and as an adjacent land
owner I am concerned about the zoning of the land.

Lt. Kenny yes this document is subject to legal attack. There are no cases
on easements. We are an adjacent land owner -Before you rezone the have to show
more than it would be desirable to rezone when you are going to overturn somebodi
already existing use.
Mr. Hill it is the consensus of the Planning Commission that anything over 2
acres is not considered spot zoning.
Lt. Kenny isn't the Commission supposed-. to zone for the better of the community
not for the worse? What about contract zoning? If you zone to the limit then
r we will not have to go into litigation.
Mr. Hill we do not have a definition of heavy and light industrial so we could
only zone for business.
Mr. Ball you said we should zone it -To what?
Lt. Kenny I would suggest that you zone the land to what you can do with it not
to zone it for more than it can handle.
Discussion on the agreement between Koniag and the Coast Guard.
Mr. Eaton at no time has Koniag or Koniag's agreement been detrimental to people
as we have people in boats also. It is not our intention to damage the integrity
of the receiver station. As long as whatever we put in does not interfere with
the receiver station I feel we are meeting the requirements of the agreement.
Lt. Kenny the Jerry Rowe proposal,whether it was Koniag's proposal,whether it was
a proposal by Jerry Rowe to buy the land.Jerry Rowe would not buy that land unles.
it was industrial unlimited zoning. Mr. Rowe will not come to town if the zoning
is limited. On the other hand if Koniag's proposal for a processing plant or
ship building yard, they can sell the land. Bottomfish plants have a high
atrition rate, Hank told me that. If that does not work what will be next?
The Coast Guard's policy has not changed.
Mr. Chandler opposed, we do not need any more canneries out there, we already
have more than enough and"they are stinking up the beaches'.'

with Resolution Z-79-025 which describes the 46 acres. Seconded b Mrs Walse

STAFF REPORT: Mr. Walton presented the staff report as prepared by the Planning
Department. Read Ordinance 73-12-0.
Mr. Hill moved to grant a request to rezone USS 2539 from Conservation to Ind
real with Resolution Z-79-025 which describes the 46 acres and with the Decem
9, 1977 contract between Koniag and the U.S. Department of the Interior as th
signed agreement becomes a contract zoning for this land usage as provided in
Title 29 section 29.33.090. Seconded by Mr. Rama lia. Motion PASSED with a
5-1 vote Mr. Ball voted_ NO, Mr. Hill, Mr. Gudena w Mrs. Walser. Mr. Ramaalia
3. Z-81-002. A request torezone-lots 4 & 7, block 4, Miller Point First Addition
from rural residential to business. (Mary Peterson)

Mr. Hodgins yes there is a building going up on that lot. There has not been
a building permit issued for this building.

Mr. Gordon Peterson's started an "A" frame. I told them they needed to get
a sanitation permit before they could go any further on the house.
Mrs. Crowe the construction of the building has been stopped?
Mr. Gordon yes
Mrs. Crowe did you see the plans for this.Is it a home?
Mr. Gordon it is residence.
Mr. Gudenau was there a floor plan?
Mr. Gordon it has been so long since I have looked at it -yes there was.
Mrs. Crowe closed the regular meeting and opened the public hearing.
Mary Peterson is near business land already.Does not feel that it will conjest
traffic. I would put my real estate business there.
Mrs. Crowe if the land is zoned business you could use it for anything.
PIary Peterson I would be interested in zoning just for a real estate office.
There is not any way to do that is there?
Mr. Hodgins you could use it for a home occupation.
Discussion between Mr. Ball and Mrs. Peterson.
Mrs. Crowe 17.06.320 means an accessory use to a main building. Do you want to
live there?
Mary Peterson I do not want to live out there just have a real estate business.
Can I make the lot smaller?
Mrs. Crowe that would be considered spot zoning.

Mr. Ball if we rezone it she would be able to sell the lots.
Mrs. Crowe that is not our concern our concern is that we would be expanding the
business area. Melnitsa Lane has been used as a buffer zone for the end of the
business area, and to protect the residential area.

FAILED by unanimous roll call vote for the following reasons• 1 expan

and Zoning Commission two 2 years ago and 3 does not comply with the Compreh

by the Engineering Department.
Mrs. Crowe closed the regular meeting and opened the public hearing.
Gretchen Saupe opposed to the subdivision. Bought the land four (4) years ago so
we could build cabins. Does not want to see the land become high density.
Shirley Heglin opposed to the subdivision. Bought the land for building cabins.
Not a lot of water.Not sure about the drainage.
Mr. ChandleC owned the land originally, I subdivided it,made some lots larger
r• than others. Pointed out where the low spots were in the land. Opposed to the
subdivision. Would not be able to dig a well.Vy biggest concern is that you might
contaminate the lake.
Discussion between the Commission and Mr. Chandler.
Mr. Ramaglia Did you change the land from conservation to rural residential so
you could sell the smaller lots.
Mr. Chandler I did not know I was changing it.
Mrs. Crowe the shaded in area that is a park.Is that dedicated to the Borough for
park use?
Mr. Chandler anyone could use it. The Borough owns it.
Mr. Ball why did you rezone the land to rural residential?
Mr. Chandler so I could subdivide it and sell it as I can't take it with me.

STAFF REPORT: Mr. Crowe no additional comments.
Mrs. Crowe have you received any comments from Mr. Brighton?
Mr. Crowe yes, he objects to the subdivision because of the stream. That is real
not the concern of the sanitarian as there are alternative septic systems. I wou
recommend final approval.

Mrs. Crowe explained that sometime ago the Commission intitated an Ordinance on
Crab Pot Storage but it was turned down. Now that there is a Planner we would
like to do another Ordinance dealing with outdoor storage.
Mr. Yutzik asked that he be notified so that he could be in on all the discussions
dealing with puttiflg=together an Ordinance? f;this-sort.
