1983-12-14 Special MeetingF F KODIAK ISLAND BOROUGH PLANNING AND ZONING COMMISSION SPECIAL MEETING December 14, 1983 CALL TO ORDER: Acting Chairman Steve Rennell called the Special Meeting to order at 7:45 p•m. in the Borough Conference Room, Kodiak, Alaska. ROLL CALL: Commissioners Present: Steve Rennell Marlin Knight Ken Gregg Fred Patterson Commissioners Absent: Also Present: Linda Freed, Director Community Development Department Jolinda Goodwin, Planning Secretary Virginia Crowe and Tim Hill, Excused; Dan James, unexcused. MR. RENNELL asked for a staff report on the single item on the agenda, the Sheffield House Expansion Finding. MS. FREED reported that on December 6, 1983, a contractor repre- senting the expansion of the Sheffield House requested zoning compliance on a building permit. The plan submitted, however, did not meet Section 17.57.030 of borough code, and staff refused to issue the permit at that time. The Commission then held a work session on December 9, 1983, to discuss the parking plan with the contractor and the development corporation. It was discovered later that a piece of property included in the parking plan was not owned by the developer, necessitating a re -design of the plan. Staff had reviewed the third parking plan submitted to the Commission this evening, Ms. Freed reported. This plan meets all the requirements, including the two major requirements: 1) a specific number of spaces (in this case, 15 spaces) of additional parking; and 2) the area require- ment (including not only the individual parking spaces, but the ingress, egress, and planting areas). Ms. Freed further reported that the one requirement that the plan still does not meet is that parking be on either the same or an adjacent lot to the development. MS. FREED further commented on the zoning in the area. According to the official borough zoning map, adopted in 1980 by the Borough Assembly, all of those lots are zoned Business. MR. RENNELL closed the Special Meeting and opened the Public Hearing. MS. KATHRYN KINNEAR, property owner of Lot 10, Block 19, Kodiak Townsite, presented some objection to the proposed development stating her privacy was being invaded. Ms. Kinnear was not opposed to the height of the building (because it will be below her dwelling), but felt her privacy would be invaded by the rooms of the hotel facing her dwelling. MS. KINNEAR also voiced concern about the retaining wall, or rather, lack of retaining measures. Ms. Kinnear pointed out the steep slope and unstable condition of the hill. MS. FREED referred to a provision in the business district zoning code (Section 17.21.050 C -- Screening) which states, "Where a business use is adjacent to a residential use or district, that business shall provide and maintain screening as approved by the planning and zoning commission. GREGG MOVED that the Planning and Zoning Commission find that it is indeed impractical for them (Sheffield House) to meet the section requiring that parking be on the lot of the building or an adjacent lot (Section 17.57.030), and that they (Sheffield House) be permitted to provide parking per the plan reviewed this evening on Lots 3 and 4, Block 19, and requested that staff note on the building permit that Planning and Zoning Commission reserves the right to specify screening between their business lots (Sheffield House) and any adjacent resi- dential lots. MR. KNIGHT SECONDED the motion and the question was called. r The MOTION CARRIED by unanimous roll call vote. r Discussion on the location of retaining walls and drainage plans followed the passing of the motion. The contractor representing the Sheffield House was present to speak before the Commission and provide information to the audience. MR.
