1983-12-01 Special Meetingr... r— KODIAK ISLAND BOROUGH PLANNING AND ZONING COMMISSION Special Meeting December 1, 1983 CALL TO ORDER Chairman Tim Hill called the Special Meeting to order at 7:02 p.m. in the Borough Conference Room, Kodiak, Alaska. ieanMRem Commissioners Present: Also Present: Tim Hill, Chairman Linda Freed, Director Pat Briggs Community Development Department Dan James Ken Gregg Dave Crowe, Borough Engineer JoAnn Strickert Virginia Crowe Jolinda Goodwin, Planning Secretary Commissioner Absent: Steve Rennell, excused. MR. HILL stated that there was only one item on the agenda, Case S-83-023, subdivision of Tract D-1A, U.S. Survey 1678, recommended for final approval and submitted by Dr. John J. Eufemio. The only handout was the memorandum of December 1, 1983. MR. CROWE reported that the May 24, 1983, letter granting preliminary approval of the subdivision was included in the packet. This letter states the conditions which must be meet in order to grant final approval. At the time the final plat was submitted, some corrections needed to be made, and Mr. Crowe expanded on the fact that Dr. Eufemio must construct the road before the plat is recorded. MR. CROWE further stated that Three Sisters Drive ends in a cul-de-sac. There is a power pole right in the middle of the cul-de-sac. With extending the road through, the power pole will have to be removed, at the applicant's expense. MR. HILL closed the Regular Meeting and opened the Public Hearing. DR. JOHN J. EUFEMIO was present and stated he had no plans drawn up on the road, at this time. The present road, an acceptable road, has been there for five years and is the road that he has been using. Dr. Eufemio wanted an exception granted to sell some of his land to raise the money to construct the road. Dr. Eufemio intends building the road as soon as he gets the money, which he could get from the sale of the land and possibly completing the road next spring. i MR. CROWE mentioned two conditions acceptable to the Borough: 1) that all improvements be constructed; 2) or that a bond be posted to guarantee the construction. If he wants an exception to those, he has got to go to the borough assembly. A discussion ensued among the Commissioners regarding bonds, insurance plans, and the process of estimating construction costs. Dr. Eufemio stated that he just could not raise the money to build the road or post a bond. KIBS225450 Is r— r- Discussion went back and forth between Mr. Crowe and Dr. Eufemio regarding conflicts in getting the plan ready for final approval and a seven -month delay. A POINT OF ORDER WAS CALLED. MR. HILL closed the Public Hearing and opened the Regular Meeting. Discussion followed regarding the history of the power pole and and effort was made to determine who's responsibility it would be to remove the pole. MR. GREGG MOVED IN CASE S-83-023, subdivision of Tract D-1A, U.S. Survey 1678, that the Commission grant final approval subject to the memo from the Borough engineer, dated December 1, 1983, with the nine conditions therein, with the change that condition #7 be reworded to say: "that the roadway construction be completed or an acceptable bond posted guaranteeing construction prior to recording/filing of the final plat and that plans be submitted for review and approval prior to beginning roadway construction." MR. JAMES seconded the motion and the question was called. ROLL CALL VOTE: Mrs. Strickert, no; Mr. Briggs, yes; Mrs. Crowe, yes; Mr. Gregg, yes; Mr. Hill, yes; Mr. James, yes. The Motion CARRIED. MR. HILL: The Commission finds in favor of the final. If Dr. Eufemio is not in favor, he has the right to appeal to the Borough Assembly within ten (10) days, in writing. MR.
