F F F CALL TO ORDER AND ROLL CALL - The meeting was called to order at 7:40 p.m. in the Borough Assembly Chambers. COMMISSIONER'S PRESENT Steve Rennell Pat Briggs Virginia Crowe Ken Gregg Dan James JoAnn Strickert Quroum was established. 1. MINUTES - January 19, 1983 COMMISSIONER EXCUSED Tim Hill ALSO PRESENT Will Walton, Director of Community Devel Joanne Jones, Planning Secretary Dave Crowe, Borough Engineer Mrs. Strickert item #16 will come after item #6 and item #15 will be after item #2. 2. APPEARANCE REQUESTS WITH PRIOR NOTICE AND AUDIENCE COMMENTS 1. Len Grothe extension. Len Grothe the letter I submitted says it all basically. Mrs. Strickert testimony will be limited to two (2) minutes each. Tom Simmons for the extension as we would like to purchase 4 of the lots in Woodland Acres Mr. Briggs what lots? Tom Simmons the first 4. Mrs. Crowe what is the status of selling lots before a plat is recorded? Mr. Crowe Borough Code and State Law state that no offering shall occur before the land is platted. Mrs. Strickert did you receive the letters we have in our packets this evening? Len Grothe no. Mrs. Strickert what type of time limit would you like to see? Mrs. Crowe the 6 month time period has expired, lease as is and have Mr. Grothe resubmit for the March meeting. Mr. Rennell no reason for extension as plenty of notice was given for the 6 month time period. Len Grothe didn't the time limit used to be one (1) year? Mrs. Crowe no. Mrs. Strickert can you resubmit what you already submitted? Len Grothe I do not believe it will go through as the laws are changing. no action on red so no could be granted. Lengthy discussion between the Commission members on what to do next. Mrs. Strickert we will continue this item between 9:00 p.m. and 10:00 p.m. this evening. 2. Don Gott motion revision. Don Gott would like original motion restated as follows "no further building improvements, unless Lot 24A is to be connected to a public sewer." Mrs. Crowe have you talked to Jackson's about hooking into their system? Don Gott there would not be much of a cost break that way. Discussion between the Commission members and Don Gott on taking to Jon Smee to possibly hook into his system which will hook into the City system. Mrs. Strickert would you be will to talk to Jon Smee? Don Gott yes. Mrs. Strickert no action necessary at this time. 3. RECONSIDERATION OF CASE 82-113. A request for a land lease on USS 2539, Tract A, Section 2, T29S, R21W, S.M. Calvin Huggard) Mrs. Crowe moved to recons unanimous voice vote. A request for a variance from Section 17.18.040(C) to permit the construction of a kitchen addition which will encroach 10 feet into the require rear yard on Lot 6, Block 47, East Addition. (Kenneth VanDyke) Mr. Briggs any other building permits issued for this area? Mr. Walton that is spelled out in the handouts you received this evening. Discussion between the Commission members and Mr. Walton on the addition in Photograph #3. Mrs. Strickert closed the regular meeting and opened the public hearing. Sarah VanDyke for the request. Explained the addendum she prepared. Mrs. Strickert could you build out front? Sarah VanDyke I don't think it would be very feasible. Kenneth VanDyke for the request. Mrs. Strickert closed the public hearing and reopened the regular meeting. Mrs. Crowe we would be setting a precident. You could convert the garage. Mrs. Strickert how many feet is it encroaching? Mr. Gregg 10 feet. Mr. Briggs accessory buildings are allowed to be within 5 feet of the rear yard. Mrs. Strickert is the back yard fenced? Kenneth VanDyke yes. Mr. Briggs voted yes because a precident is already set for accessory buildings in the rear yard. Mrs. Strickert voted yes, concur with Mr. Briggs. Mr. Gregg voted yes, concur with Mr. Briggs. Mr. Rennell voted no and concur with Mrs. Crowe. Mr. James voted no and concur with Mrs. Crowe. 5. PUBLIC HEARING ON CASE S-82-031. (Preliminary) Subdivision of Tract F, Russian Creek Alaska Subdivision, creating Lots F1, F2, F3, F4 and F5, Russian Creek Alaska Subdivision. (Donald H. Seixas) Mrs. Strickert closed the regular meeting and opened the public hearing. Hearing no comments the public hearing was closed and the regular meeting reopened. (Preliminary) Subdivision of Lots 1, 2, and Tract Q, Russian Creek Alaska Subdivision: Russian Hill Subdivision, 20 lots. (David J. "Jack" King) Mrs. Strickert closed the regular meeting and opened the public hearing. Lloyd Benton representing Mr. King, we would like to withdraw this case and we will re- submit at a later date. An Ordinance amending Section 16.24.020(B)(1) of the Kodiak Island Borough Code regarding road construction requirements when platting. An Ordinance deleting Chapter 17.12, Rural Residentia Zones and enacting Chapter 17.17, Rural Residential District. (Community Development Department) rMr. Walton presented the staff report based on a memorandum prepared by the planning ` department. Mr. James moved to approve and pass_ to the Borough Assembly an ord al uis unan 14. PUBLIC HEARING ON CASE 0-81-020. An Ordinance amending Title 17 of Borough Code, by deleting Chapter 17.18 Residential Zones and creating Chapter 17.18 Single -Family Residential District, Chapter 17.19 Two -Family Residential District and Chapter 17.20 Multi -Family Residential District. (Community Development Department) Mr. James page 5 - area requirements what is the reason for this? Mr. Walton contractors are asking for relief. Discussion between the Commission members and Mr. Walton on changing lot areas per dwelling units. Discussion between the Commission members and Mr. Walton on the difference between site r plans and construction plans. Mrs. Crowe under Section 17.20.080 change 5 or more dwellings to a tri-plex for site l plan review by the Planning Commission. F Mr. James under area requirements change #4 from 2,000 square feet to 1,600 square feet. Mrs. Strickert closed the regular meeting and opened the public hearing. Scott Arndt I have a problem with submitting a site plan to the Commission for anything larger than a tri-plex, that is why wewhave staff. Discussion between the Commission members and Mr. Arndt on lot area square footages and when to submit a site plan to the Planning and Zoning Commission for approval. Mrs. Strickert closed the public hearing and reopened the regular meeting. Mr. James change the square footage on four plexes to 2,000 square feet. More discussion on land square footages for building types between the Commission members. Mr. Briggs would like to see mobile homes permitted in R-3 zones. John Bealey support the concept for park areas whether they are provided by the municipal- ity or by private individuals. Tony Perez against the ordinance. Mr. Gregg moved to table an ordinance amending Chapter 16.20 on subdivision standards by creating park dedication requirements until April 1983. Secon Rennell. Motion PASSED by unanimous voice vote. Mrs. Strickert call a recess at 9:30 p.m. The meeting was reconvened at 9:45 p.m. 16. PUBLIC HEARING ON CASE 83-010. Parks and Recreation Committee's proposed park locations. Parks and Recreation Committee) Mr. Briggs I would like to be excused from this case as I am a member of the Parks Committee. Mrs. Strickert you are excused. Mrs. Strickert closed the regular meeting and opened the public hearing. Pat Briggs member of the Parks Committee, explained briefly about the four (4) proposed park areas. Mrs. Crowe how much in your budget? Pat Briggs 160 thousand. Mr. Rennell are three wheelers excluded from the parks? Mrs. Strickert do you have an area for three wheelers? Dorothy Holm member of the parks committee, hope you support our recommendations. John Sevier member of the parks committee, would like to have a year round park also. Mrs. Strickert closed the public hearing and reopened the regular meeting. Mrs. Crowe what is a park developer? Pat Briggs they are like an engineer. Mrs. Crowe good plan, would like to see some local people help work on the park layout. Mrs. Strickert would like to see local people involved. Mr. Crowe volunters are fine, but construction plans must be done by a professional. Mrs. Crowe moved to approve and recommend to the Borough Assembly the four (4) areas e Borough Parks and Recreation Committee has come up with and to try to keep the pans basic and simple. NEW BUSINESS - None 18. COMMUNICATIONS - None 19. ADDITIONAL AUDIENCE COMMENTS (1) Len Grothe Mrs. Strickert consensus of the Commission is that the subdivision died at the end of the six 6 month preliminary approval period. Mr. Crowe Mr. Grothe is correct we did not advise him that the six coming up prior to the expiration. We did infact notify him after month deadline was preliminary approval was granted of the six month time period. Discussion between the Commission members and Mr. Crowe on other subdivision cases which have expired due to the six month time period. Mrs. Strickert legally we can not act on this as the time limit has expired. Mr. Crowe no public hearing is required on preliminary plats. Mrs Crowe moved to grant prelmiriary subdivision approval to cases S-82-005 and S-82-016 with the same stipulations and guidelines_ as stated in the original prelim�narY plat ames F Mrs. Crowe Mr. Grothe you should get current copies of the subdivision code for future reference. 20. CHAIRMAN'S REPORT - None 21. COMMITTEE REPORT - None 22. COMMISSIONER.'S COMMENTS Mrs. Crowe I have several things this evening: (1) definition status of all legal actions pending for the definition section of with the Borough Attorney, (2) of site plan the code; (3) make sure the lot behind VanDyke's is in conformity to code and (4) please note to the Borough Assembly that on cases 10 and 11 we had no testimony. Mr. Briggs none Mr. James letters of reminder to developers before six month period expires. Commend the parks committee on a job well done. Mr. Rennell at a worksession would like some information on beach front land. Correspond• ence to developers with a time limit to be sent certified. Do not agree with Mr. Grothe'. tactics this evening. Where is the Borough's Comprehensive Plan? Discussion between the Commission members and Mr. Walton on a new Comprehensive Plan.
