MINUTES - January 20, 1982 - COMMISSIONER EXCUSED Pat Briggs ALSO PRESENT Will Walton, COD, Director Joanne Jones, Planning Secretary Bill Hodgins, Zoning Officer Phil Shealy, Borough Manager Dave Crowe, Borough Engineer 2. APPEARANCE REQUESTS - Kodiak Island Housing Authority. Mr. Marlin Knight - Executive Director of the Kodiak Island Housing Authority, I am appearing tonight for review and approval of the conditions that were establish- ed by the Borough Assembly on this exception to Tracts B and E, Kadiak Subdivision. I have provided Mr. Walton with a review set of the contract documents referencing where the conditions were satisfied in the contract documents. Mrs. Crowe when was this set given to Mr. Walton? Mr. Knight - On Tuesday, the 16th. The conditions that we are addressing are the requirements for the 96 off street parking stalls, handicapped parking stalls, the location of the handicapped access ramps and also the request to include an additional tot lot. We now have 105 parking spaces, 5 are for handicapped use, 2 handicapped units in the complex which are accessable by ramps. Instead of an additional tot lot we have supplied 3 additional tot lots. There are sheets explaining the tot lots and a site plan for each tot lot is included. A time table for the community facility which will be done in phase 1 of the contract is not needed as the entire project will be built at the same time. Discussion on approprating money for the future expansion of Woody Circle between Mr. Ball and Mr. Knight. Mrs. Crowe concerned with building design and sewer system. Discussion between the Commission on the sewer system for the project. Discussion on delaying this request for one month. Mr. Gudenau when will this go to bid? Mr. Knight March 1, 1982. The only thing we have not gone over in depth are the contract specifications. Mr. Hill could we grant preliminary approval to this or does it go to final? A request for a variance from Section 17.18.040(C) of the Kodiak Island Borough Code - rear yard requirements - to permit the con- struction of a new dwelling that will encroach fifteen (15) feet into the rear yard on lot 20, block 5, Leite Addition. (John Doyle) STAFF REPORT: Mr. Walton presented the staff report based on a memorandum prepared by the Community Development Department which recommended denial. 55 notices mailed and 2 returned. Mrs. Crowe closed the regular meeting and opened the public hearing. You will be receiving two more letters in objection to this case. Mr. Hatcher where is this property in relationship to my property? Mr. Hodgins showed location map to Mr. Hatcher. Discussion between the Commission members and Mr. Hatcher on the required setbacks. Mr. Hatcher should have gone through the proper channels, so I am against the variance. Mrs. Crowe closed the public hearing and reopened the regular meeting. Mr. Ball moved to grant a request for a variance from Section 17.18.040(C) of the Kodiak Island Borough Code - rear and re uirements - to ermit the construction of a new dwelling that will encroach fifteen 15 feet into the rear yard on lot 20, block 5, Leite Addition. Seconded by Mr. Gudenau. Motion FAILED by unanimous___ roll call vote. REASONS FOR DENIAL: 1. Alaska Statutes Section 29.33.011(C) states: "A variance shall not be granted because of special conditions caused by action of the person seeking relief or for reasons of pecuniary hardship or inconvenience. A variance shall not be granted which will permit a land use in a district which that use is prohibited." 2. There are no exceptional physical circumstances or conditions applicable to the property; and 3. The strict application of the zoning ordinances will not result in practical difficulties or unnecessary hardship. 4. PUBLIC HEARING ON CASE 82-014. A request for a variance from Section 17.18.040(8) Ti) of the Kodiak Island Borough Code on lot 7, block 7, Aleutian Homes Subdivision to permit the construction of a mud room that will encroach five (5) feet into the required side yard setback. (Sherman Rickard) ISTAFF REPORT: Mr. Walton presented the staff report based on a memorandum prepared by the Community Development Department which recommended denial. 48 notices mailed, none returned. Mr. Ball you recommended denial correct? Mr. Walton yes. Mr. Ball if it is turned down, what happens to the building? Mr. Walton the building would have to be removed. Mr. Ball do we have the proper ordinances to enforce this? Mr. Walton yes. Mrs. Crowe closed the regular meeting and opened the public hearing. Mr. Rickard presented a history of happenings in this case. Would like to see the variance granted but would be willing to tear down the mud room. When the road was paved the property markers were moved and never replaced in the original location so I went from the markers I thought were located in the correct place and that is were I measured from. When I received the as -built survey that is � " when it was brought to my attention I was encroaching into the side yard. Also Iexplained the construction of the mud room. Discussion between the Commission members and Mr. Rickard on putting a mud room on the back of the house. Mrs. Crowe closed the pubic hearing and reopened the regular meeting. Mrs. Strickert I wonder how many other lots in this area are having this same problem. Discussion on how to solve the problem of property markers being moved before doing any building on a lot. Mrs. Crowe Bill, do we require as -built surveys? Mr. Hodgins I would like to use as-builts but I do not require them, as it is costly to the applicant. Mr. Gudenau I do not think it should be a requirement for a building permit as it is too costly. Mr. Ramaglia the grandfather clause is not a cure all. Mrs. Crowe I am also concerned with the grandfather clause and also with safety problems. Mr. Ramaglia can a building inspector do an onsite inspection, and give an opinion as to whether or not the structure can be built? Mr. Gudenau how would the building inspector know if the property markers were in the right place? Mr. Hill moved to grant a variance from Section 17.18.040(B)(1) of the Kodiak Island Borouqh Code on lot 7, block 7, Aleutian Homes Subdivision to permit the continuation of a mud room that will encroach five (5) teet into the requirea si ca c mous ro REASONS FOR DENIAL: 1. There are no unique physical conditions applicable to lot 7; 2. The public's health, safety and welfare may be endangered by allowing a structure within the area used by emergency vehicles in the event of a fire; and 3. The hardship was caused by the applicant and according to A.S. 29.33.110(C) a variance "Shall not be granted" Mrs. Crowe mentioned that Mr. Rickard has appeal rights to the City Council as a Board of Adjustment. 5. PUBLIC HEARING ON CASE S-82-002 (Preliminary)vacation of lots 2A and 2B, block 5, Bells Flats Alaska Subdivision; and replat to lots 2A-1, 2B-1 and 2B-2, block 5, Bells Flats Alaska Subdivision. (Richard Madson) STAFF REPORT: Mr. Crowe presented the staff report based on a memorandum prepared by the Engineering Department which recommended final approval. 23 notices mailed, 1 returned in ojection, as Mr. Madson reportedly does not have clear title to the land. Mr. Ramaglia since our records do not show if there is a problem or not with the title, will our decision be legal? Mr. Crowe I would recommend that you recommend final approval with the verification of ownership and that all parties of interest sign the plat. Mr. Ramaglia the driveway that provides access to the top lot, can he sell the lots and cut off access to the top lot? Mr. Crowe they could always construct a driveway off of Middle Bay Drive. r. Discussion on the use of the flag by others. Mrs. Crowe closed the regular meeting and opened the public hearing. Glen Mathis is the access too steep to get access to the top lot? Aren't you supposed to protect the buyer? Discussion between the Commission members and Mr. Mathis on his concerns. Mr. Ramaglia there are some people who have real steep driveways, and if a person builds on that lot they must have some means of access. Mrs. Strickert there are some people who do not want easy access to their home for privacy reasons. Mr. Madson yes, there has been a building permit issued, the house is not complete yet. Explained the driveway situation and how access was obtained to the proposed lots. Mr. Ball what is the ownership on lot 2A? Mr. Madson the comment Mrs. Hanes made is correct and she will be paid off. I agree with Mr. Crowe's recommendations. Mrs. Crowe closed the public hearing and reopened the regular meeting. Mrs. Crowe if a future owner did not allow the flag to be used for access to lots 2B-1 and 2B-2 access could be obtained from Middle Bay Drive. A Mr. Crowe that is correct. PUBLIC HEARING ON CASE S-82-003. (Preliminary) subdivision of lot 10, block 7, Bells Flats Alaska Subdivision into six (6) lots: lots 10A, 10B, IOC, 10D, 10E, and IOF, block 7, Bells Flats Alaska Subdivision. (Don Rounsaville) STAFF REPORT: Mr. Crowe presented the staff report based on a memorandum prepared by the Engineering Department which recommended that this be returned to the applicant for resubmittal. Mr. Hill were there any comments made on the easement at the top of the circle on Womens Bay Drive? Did you have any problems with that? Mr. Crowe until I see the topography on this lot it is hard to determine. Mr. Gudenau they have to have road access, correct? Mr. Crowe they have to have legal access to the property. Discussion between Mr. Gudenau and Mr. Crowe on road access. Mr. Hill on lot 10A, is the configuration okay? Mr. Crowe yes, it is okay. Mr. Ball where is access to lot 10B? Mr. Crowe it is through an easement. Mrs. Crowe closed the regular meeting and opened the public hearing. Hearing no comments the public hearing was closed and the regular meeting reopened. Mrs. Crowe I talked to the applicant about the recommendations given by the staff and was informed that it would not cause them any hardship. Mr. Ramaglia let the applicant know that the Assembly is not real happy about access easements. Discussion between the Commission members on the action they should take on this I case. PUBLIC HEARING ON CASE 82-005. Public hearing on the Women's Bay Community Plan. Womens Bay Community STAFF REPORT: Mr. Walton presented the staff report based on a memorandum prepared by the Community Development Department which recommended approval of the document and maps. Mr. Ball moved that tonights discussion be held to Map #1 and the are Iin Map #1 only. Seconded by Mr. Hill. Motion PASSED by unanimous ro Mrs. Crowe closed the regular meeting and opened the public hearing. Mr. Bealy Co-chairman of the Womens Bay Community Council. In April of 1981 a charter was developed and finalized to become a Second Class City. A lengthly discussion followed explaining the reasons for the plan and what is contained in it and how and where the information was compiled. Discussion between Mrs. Crowe and Mr. Bealy on a time frame for submitting the rest of the plan. Bill Williams Chairman of the Womens Bay Community Council. I do support the plan. Would like the commission to look into a greenbelt classification. Mrs. Crowe I agree with a classification for greenbelts. Cy Hoen I am opposed to the B Tracts being developed in a residential area. Discussion between the Commission and Mr. Hoen on gravel leases. John Stein Electronics Officer for the USCG Communication Station. I'm here to help protect the receiver site at Holiday Beach. Discussion between Mrs. Crowe and Mr. Stein on the uses permitted in industrial zones. Mrs. Crowe in reading the Philosophy in this plan they make reference to new construction and siting of dwellings on 1 acre lots, would this limit us in future subdivisions in not accepting any subdivisions less than 1 acre where our current regulations are slightly less - change to 40,000 square feet instead of one (1) acre. On your zoning section when you broke this down into precentages and acres were these totals reflecting the total on the whole map or the map we are talking about now? Mr. Walton the 1,051 acre referred to are in the core area. Mrs. Crowe in calculating the acreage for the industrial total, are the B Tracts included in this? Mr. Walton yes. Mrs. Crowe one change I would like to suggest, we do not change the land use on the area currently zoned industrial. I also like Will's idea to use lots 1 and 4 as a park. Mr. Ball how much land is involved in those four (4) acres? Mr. Walton approximately 15 acres. Mr. Ball how much land is involved with our sewer treatment plant? Mr. Walton approximately 2 acres. Discussion between the Commission members on land uses for the park and sewer treatment plant. Mr. Ball do you think it would be better to designate land uses now? I think it would be better. Discussion between the Commission members on the use of lots 1-2, block 5, Tract A, Bells Flats Alaska Subdivision. Mr. Ball in regard to the 300 foot greenbelt I would like you to make a comment. Mr. Walton traditionally a greenbelt stops at the property line. Mr. Ball could we say 300 feet or to the present property line, which ever is great- er. Mr. Ramaglia who controls the land labeled State of Alaska? Mr. Walton it has been tentatively approved to the Borough, but the State can go in and take out gravel when they want to. Discussion between Mr. Ramaglia and Mr. Walton on if tentative approval will limit the State in using the land. Mrs. Crowe delete anything that deals with Map #2 at this time, need a new boundary description, 5% park and 3% municipal I would like to see it listed as a general guideline to be considered when a subdivision takes place. Under future land use - it says the B Tracts are recommended for gravel extraction, the creation of a lake and the end land use to be rural residential. Does it need to be stated that we are assuming that means that at such time all practical extraction of gravel has taken place as determined by the Borough? Mr. Walton yes, it should say that. Mr. Ramaglia 5% land for parks in a subdivision does this mean all subdivisions or just the larger ones. Mrs. Crowe maybe we can delete this about parks and we can discuss it when we look at Map #2. Mr. Hill we should add that all gravel will be removed from the B Tracts before any other gravel extraction tracts are to be opened. Discussion on this statement between the Commission members. Mr. Maass could you repeat your statement Mrs. Crowe on the time frame on the gravel lease. Mrs. Crowe I state until all practical gravel extraction was completed no other pits are to be opened. Mr. Maass could you withdraw that statement and change it to read, "until the covenants of the gravel lease deed are met." Mrs. Crowe okay. Bill Williams greenbelt problem. We do not want to infringe on a persons property. The four 4 tracts or lots zoned industrial should be designated now not later. How is the plan to be submitted? Discussion between the Commission and Mr. Williams on how the plan is to be submitted to the Assembly. Mrs. Crowe closed the public hearing and reopened the regular meeting. A committee was appointed which consists of Mrs. Crowe, Mr. Ball, Mr. Beaty and Mr. Arndt to address specific questions. Would like to see us move to let Brechan lease the land on a month to month basis and hopefully we can bring this up in March. Mr. Richardson is this monopoly going to continue? Mrs. Crowe we will try to reach an agreement by March. Discussion between the Commission members on what the Assembly wants to see on the gravel leases. Mrs. Crowe Mr. Walton will you call the committee members for a lunch meeting on February 22, 1982. I would also like to have a joint work session with the Borough Assembly on this topic possibly March 11th only item on the agenda. 9. PUBLIC HEARING ON CASE 82-015. Public hearing on a controlled livestock grazing district. Community Development Department) STAFF REPORT: Mr. Walton presented the staff report based on a memorandum prepared by the Community Development Department which recommended approval. Mr. Ball has anyone checked into the grazing leases in this area? Mr. Walton Mr. Fields is the primary person involved with some Bells Flats individuals also involved. Discussion between Commission members and staff as to why this has come up. Mr. Gudenau what action can you take if a cow comes on your lot? Mr. Walton you can not shoot the animal, but you can impound the animal and the owner must bail them out and if the owner does not bail the animal out it can go up for public auction. Mrs. Crowe closed the regular meeting and opened the public hearing. Elmer Sorenson Executive Officer for the Coast Guard and representing Captain Schauffer. Read a letter from Captain Schauffer. We are for the district. Mrs. Strickert how big are the Buskin and Holiday Beach areas? Mr. Sorenson I do not have that information with me. Discussion between the Commission members and Mr. Sorenson on the Holiday Beach involvement. Cathy Bishop Principal at Peterson Elementary, concerned about cattle on the play- ground, would like to see something done to protect the children. Pat Lods would like to see something done about the cattle as they really like to eat gardens. Mary Mathis Read a letter from Womens Bay Community Council, stating there was a petition attached that you should have as a hand out. The Community is in favor of the district. Read a letter from herself and is in favor of the district. Bruce Maass explained that he has put up a fence to keep the cattle out but it did not work. Jim Wright Operations Officer at the Airstation, support the district would like to help protect those who fly. John Witteveen Assistant Superindent of Schools, in support of the district and safety of the children. Lou Garrett Acting Airport Manager, support the district. We do not purposely run our live- stock on other peoples private property, the airport or the coast guard base. We have our cattle in the Antone Larsen Bay area and the bears make them run. We have put up a fence and are in the process of getting a cattle crossing in the road. I'm sure our cattle are not the only cattle involved. I think that voluntary control should be the first step. Opposed to the district. Mrs. Strickert how long do you think voluntary control could be tested to see results? Mr. Fields it depends on when we can get the cattle crossing in. Mrs. Strickert how often do you keep tract of the cows? Mr. Fields we have close contact on the cows and we have a part time person at Antone Larsen. Mrs. Strickert do you have a percentage of the problem cows that are your cows? Mr. Fields I would not like to say. Mr. Ball do most of your cows travel by the road? Mr. Fields yes. Mr. Ramaglia how do you feel if a person hits your cow? Mr. Fields if a cow gets hurt the cattleman does not seek reimbursement for the cow. It is an assumed danger. Discussion on cattleman controlling their livestock. Mr. Gudenau why do the cows travel less in the winter? Mr. Fields the bears are in hibernation. Discussion on cattle guards. Cy Hoen I have cattle, and I know they are causing problems but I think I can come up with some solutions. Mr. Ball would you be willing to work with Mr. Fields on solutions? Cy Hoen we are working together now. Discussion between the Commission members and Mr. Hoen on solutions to try and solve the cattle problems. Mr. Cobis I live right in the middle of the cow delicatesen. I also have cows in the winter, we also have a problem with the horses. Cattleman should be responsible for their cows. Mary Mathis read a letter from the Alaska State Troopers supporting creation of the district. Dan Stockdell hit a cow - they are a physical hazard to traffic. Mr. Fields we are not saying there is not a problem. We are all trying to come up with an alternative. Ken Sikora live in Russian Creek area always have a problem with the cows, personal property damage. For the creation of the district. Barb Markowitz control the cows. Mrs. Crowe closed the public hearing and reopened the regular meeting. Mr. Hill I'm in favor of both. I think we should give the cattle owners 90 days to come up with a solution. Mr. Gudenau what about 5 months? Mr. Hill that is too long to wait. Public hearing on lot 3, block 5, Miller Point Alaska Subdivision for the use of the lot as a fire station location for Service District Number 1. (Community Development Department) STAFF REPORT: Mr. Walton presented the staff report based on a memorandum prepared by the Community Development Department which recommended approval. Monashka Bay Alaska Subdivision and replat to lots 8A, 9A and 9B, block 2 Monashka Bay Alaska Subdivision with the following corrections: 1 correction of the curve data for lot 9A to reflect a Delta angle of 49 11'12" and a curve length of 188.25'; and 2 correction of the lot areas to show 40,030 square feet for lot 9A, and 47,522 square feet for lot 9B. (IRA Tribal Council, Karluk) STAFF REPORT: Mr. Crowe presented the staff report based on a memorandum prepared by the Engineering Department which recommended tabling and holding a public hear- ing on this item in March. Mrs. Strickert moved to table action on this until next month (March), so that a public hearing can be held and that the applicant be advised that the following changes need to be made so that final approval can be given: 1 revise the title block to show, "Subdivision of U.S. Survey 162 creating Tracts A, B, and C, U.S. Survey 162"; 2 show entire boundary of USS 162 on the plat; 3 revise the vicinit map: show north arrow, section numbers and township and range designations; 4 re- move witness corner shown in Konia , Inc. property and show monumentation of corne of fuel storaae facility: 5 show areas of each tract established by this subd- 16.
