CALL TO ORDER AND ROLL CALL - The meeting was called to order at 7:35 p.m.

Mrs. Crowe did you get an opinion from Rick Garnett yet?
Mr. Walton he is out of town until tomorrow

3. PUBLIC HEARING ON CASE S-82-008. (Preliminary)Subdivision of Lot 6, Block 7,
Monashka Bay Alaska Subdivision, into two lots: Lots 6A and 6B, Block 7, Monashka
Bay Alaska Subdivision. (Marlin Knight)
Mrs. Crowe closed the regular meeting and opened the public hearing.
Marlin Knight -I have provided the topographic map to the Borough Engineer as he
requested. I hope this will be subdivided.
Mrs. Crowe closed the public hearing and reopened the regular meeting.
Mr. Ramaglia moved to grant final_ approval to the subdivision

PUBLIC HEARING ON CASE 82-026.. Request for a Material Sales Contract to remove
gravel from the E2 of the EZ of Section 24, T27S, R20W, S.M. for the Monashka
Dam Project. (City of Kodiak)
Mr. Walton you can delet condition #1 on our recommendations of approval from
The State of Alaska as it is a hand out this evening.
Mrs. Crowe closed the regular meeting and opened the public hearing.
Mr. Beukers Superintdent of Public Works, once the gravel is removed the area
will be reseeded and no ponding areas will be allowed. These requirements are
contained in our bid documents.

Discussion between the Commission members on water sources and road access.
CONSIDERATION OF CASE S-8I-027. Subdivision of lot 9, block 3, Russian Creek
Alaska Subdivision into lots 9A and 9B, block 3, Russian Creek Alaska Subdivision.

Mr. Ball it was brought up at the work session that Mr. Martini was not able to
purchase land from adjacent landowners to meet the 120 foot width requirement. I
feel this is a hardship to Mr. Martini.
CONSIDERATION OF CASE 82-015. Controlled livestock grazing district. (Community
Development Department
Discussion between the Commission members on opening this up for public hearing.
Commission agreed to open for public testimony.
Mary Mathis_ I have a problem with some of the solutions to the cow problems. I
do not think voluntary contol is going to work as the problem has been going on
for several years. I also do not think it is the responsibility of the land
owner to have to fence their property to keep out thb cattle and horses. The
livestock owners Should have the responsiblity. People are also being driven to
shoot the animals, which is against the law. It seems to me the only solution
is a controlled livestock district.
Mr. Gudenau do you know of any problems lately with cattle or horses?

Mary Mathis yes, I do know of problems lately. I also know that people are
really trying to keep the cows out.
Mr. Ball do you know of any controlled grazing districts in Alaska?
Mary Mathis I do not know for sure where they are.
Discussion between the Commission members on giving the cattlemen a chance for
voluntary compliance.
Mary Mathis how do you propose to contact people with only 1 or 2 cows or horses
which do not have markings of any sort?
Commander Wessling would like to lend our help to the Bells Flats Community.
School children and safety of aircraft are our concerns. We are in favor of the
district.
Mr. Ball have you had problems with cattle in the last 60 days?
Commander Wessling I have not noticed any cattle.
Mr. Gudeanu how do cattle come onto the base?
Commander Wessling through the main gate and through the opening by Peterson
School.
Duncan Fields to answer the question about cows on the base in the last 60 days,
the answer is yes, we had to herd our cows off the base recently. The reason for
the cows travelling is because of the snow in Anton Larsen and they are looking
for food.
Mr. Ball would you explain your cattle guard?
Duncan Fields it will be located at the Anton Larsen Bay switchback, if it is
approved by the State. We have not applied to the State yet.
Mrs. Crowe why haven't you applied? Is it primarily because of the weather?
Duncan Fields that is correct.
Discussion between Commission members and Mr. Fields on how much time would be
sufficient for voluntary control to work. Discussion on the problem with the
cows on the school yard and the Coast Guard Base if the fence was mended.
Barb Markowitz we have a problem with the cows in the spring and winter, it makes
no difference. What about branding or marking the cows in some way? Isn't it a
State Law?
Omar Stratman there is a law about branding and marking livestock. It does not
require branding.
Discussion between the Commission and Mr. Stratman on chainlink and barbed wire
fencing.
Barb Markowitz what is it going to take to get something done about our cow
problem?
Mr. Ball Omar, how will this district affect you? Can you tell us anything about
r barbed wire fencing?
Omar Stratman I would probably go out of business if this district was created.
Barbed wire is a lawful fence, if a cow or horse comes through the fence the owner
(of the cow) is liable.
Mary Mathis what is the fear of this district?
Omar Stratman I do not know if I could affort the insurance.
Discussion between Commission members on ways to go about creating this district
or a time limit for the livestock owners to be allowed to try voluntary control.

Mr. Ball send something to Assembly on this, stating we would like to give the
cattlemen time to prove themselves.
Mr. Gudenau we should define a specific area for the grazing district.
Further discussion between the Commission members on a specific area for the
grazing district.
Mrs. Crowe I would like staff to send letters to the following:
(1) State Highway Department - regarding fencing and signs for the road warning
of livestock;
(2) Coast Guard about mending their fence; and
(3) Letters to livestock owners about marking their cattle in some way.
Lengthy discussion on ways to remedy the problem with the cattle.
Mrs. Crowe -called a 5 minute recess at 8:45. The meeting was called back to
order at 8:55.
Mr. Gudeanu read a part from the Alaska Statutes Title 3, Chapter 35.
Discussion between the Commission members on the section read.
Mr. Briggs give the cattlemen at least one year trial for voluntary control.
Mr. Hill people in Womens Bay want protection.
Mr. Gudenau I go along with the one year time limit. The people should petition
the court.
Mr. Briggs moved to allow livestock growers a one year (April 1983) time period
in which to implement measures to control their cattle and horses in the Bells
Flats/Russian Creek area Coast Guard Base and State Airport. Seconded by Mr.
Ball Motion PASSED by unanimous roll call vote.
Mrs. Crowe could staff write to Rick Garrnet on the following items:
(1) What is cultivated land?
(2) Is it okay for the Bells Flats people to petition the court on this?
(3) Who is responsible for fencing? State? Cattleowners? Or private individuals?
Also please send information to Assembly and after six (6) months write to the
following people to see if they are still having the livestock problems:
1) Bells Flats/Russian Creek residents,
2) Coast Guard personnel, and
3) Airport personnel.
9. NEW BUSINESS - None
10. COMMUNICATIONS
a). Request for reconsideration of Case Z-81-005. A request for an exception from
the Borough Code of Ordinances to permit the use of a bus as a fast food service
to the public on lot 12, block 16, Kodiak Townsite. (Linda Larsen and Della Fannin
Mr. Ball would like to see it renewed for one year.
Commissioner's agreed.
Mr. Ball moved to grant a one (1) year extension to permit the use of a bus for
a fast food service facility on lot 12 block 16, Kodiak Townsite. Seconded by
Mr. Hill- Motion PASSED by unanimous roll call vote.
b). Comments about the John Doyle case - no action.
c). May meeting agenda items - no action.

12. CHAIRMAN'S REPORT
1. Can we get a price for reprinting Volumes 1 and 2 of the Comprehensive Plan?
2. Put a clause in the by-laws that states there must be a six (6) month period
for reconsideration on any type of case that is denied, and
3. What is the status of establishing a line for the crab pot storage at the end
of Lilly Lake?
13. COMMITTEE REPORTS - None
14. COMMISSIONER'S COMMENTS
Mr. Hill Mr. Nordgulen called me about storing junked cars on his Rural Residential
lot, is it permitted?
Mr. Walton no it is not.
Mr. Ramaglia - nothing.
Mr. Ball - we need an ordinance for crab pot storage only for crab pots, not lines
and bouys.
Mr. Briggs - nothing.
Mr. Gudenau - nothing.
15. DEPARTMENTAL REPORTS - None
