2. APPEARANCE REQUESTS WITH PRIOR NOTICE AND AUDIENCE COMMENTS. None.
Mrs. Crowe we are going to add a 10A to the agenda. The item is: Case
$7--6$7-.--Tn exception to Section 17.15.010(E), Uses Permitted in the
Conservation District, to permit a retail business land use on Lot 11, USS
3474, Mile 42, Chiniak Road. (Ernest and Dorothy Hopper)
Commissioners all agreed unanimously to the addition of item 10A.
3. PUBLIC HEARING ON CASE 82-083. A request for a variance from Section
17.18.040 C to permit the construction of a day care facility which will
leave a 10' rear yard on Lot 2, Block 17, New Kodiak Townsite. (Small
World, Inc.)
Mrs. Crowe any additional staff report?
Mr. Walton Small World Inc. is looking into purchasing the LDS Church,
but nothing has been decided yet.
Mrs. Crowe closed the regular meeting and opened the public hearing.

Mrs. Crowe this case will be placed on the September 15, 1982 agenda. No

PUBLIC HEARING ON CASE 82-070. A request for a land lease on the Nz of the
Sz of Section 36, T18S, R20W, S.M. on Shuyak Island at Carry Inlet, for
a homesite and trapping site. (William and Tammy Cool)
Mr. Walton read an objection letter from Mr. MacIntosch. Gave an update
from Tubbs and explained about the appraisal from the Borough
Assessor.
Mrs. Crowe how much land will come into the Borough on Shuyak?
Mr. Walton 30 thousand acres approximately.
Mrs. Crowe closed the regular meeting and opened the public hearing.
William Cool we just want to lease the land, not buy it.
Mr. Hill if they are unable to purchase the land can't we lease it for
trapping purposes?
Mr. Ball who's land is it?
Mrs. Crowe it is state land. It is over the appraisal so it should go to
public offering.
Mr. Walton we need to get the State's approval. During phone
conversations they have indicated no leases will be possible until
underlying native claims are settled.
William Cool we would like our file left open.
Bill Herman potential State Park and Wildlife Refuge. CZM plan designates
this area for special attention. Should be left open for recreational
purposes.
Therese Ametto feels the same way as Mr. Herman, would like to see the
land for and recreation.
Mrs. Crowe closed the public hearing and reopened the regular meeting.
Mrs. Crowe I would like to turn this down with the recommendation that the
Cool e notified when the land becomes available.
Discussion between the Commission members on what the advantages of
tabling or turn down this request would be.
Mr. Walton explained advantages of tabling vs. turning down the request.
Mr. Ball it would be better to table this item.

PUBLIC HEARING ON CASE 82-072. A request for a land lease on Section
33,T24S, R24W, S.M., adjacent to ADL 59171, on Raspberry Island, at Onion
Bay. (Dodd Shay).

Mrs. Crowe do you have an update on this?
Mr. Walton gave a presentation on happenings with the State and alleged
vioTaions of cutting wood. Went to Raspberry on Thursday - no
violations. No action is needed from the Commission as the land involved
was retained by the State. We have also asked that Mr. Shay's $25.00 be
refunded.
Mr. Hill where trees being cut?
Mr. Walton on Mr. Shay's property.
Mrs. Crowe would like to request that the Borough Assembly take action on
reputing the Onion Bay area for more remote areas to sell to the public.
Discussion between the Commission on the availability of remote areas for
the Borough to sell.
Mr. Walton we will do a map which shows Borough land.
Mrs. Crowe we meet with the Borough Assembly tomorrow night. When could
we put this on a work session agenda?
Mr. Walton we could have the preliminary maps next week.
Mr. Ramaglia what is the status of the fishsites on Raspberry Island?
Mr. Walton they are shorefisheries leases from the State.
Mrs. Crowe no action needed.
8. PUBLIC HEARING ON CASE 82-075. A request for a land lease on Section
32,T24S, R24W, S.M. on Raspberry Island at Onion Bay for a cabin during
salmon season and for minor storage. (Dale Scott Lee).
Mr. Walton need approval from the State. We do have a copy of the letter
to Mr. Lee from the State referring him to the Borough. There are a cabin
and net racks on the property presently. No problem with a 1 year lease
as Mr. Lee is only there for 3 months out of the year.
Mrs. Crowe I don't mind the fish nets but the cabin bothers me.
Mr. Hill did Mr. Lee build the cabin?
Mr. Walton yes.
Mr. Ramaglia is the land flat or hilly?
Mr. Walton hilly.
Mr. Rama lia how much of the island can we run into this leasing problem

9. PUBLIC HEARING ON CASE 82-081. A request for a land lease for a youth
camping face ity on Tract B, Miller Point Alaska Subdivision,
approximately 35 acres. (B.P.O.E.)
Mr. Walton read letter from Dale Tubbs and the sample resolution. This
will be on the August 26, 1982 Borough Assembly work session.
Mrs. Crowe when is the Borough Assembly meeting in September?
Mr. Walton on September 2.
Mrs. Crowe closed the regular meeting and opened the public hearing.
Ken Lester in the Resolution you state no trees, lakes, or wetlands are to
be disturbed. That could create problems when building trails.
Mrs. Crowe what do you use as guidelines for tree sizes?
Mr. Walton 12" to 18" diameter.
Mrs. Crowe the Planning Commission should review plans before any work is
to be done. Would you object to us tabling this until September?
Discussion between the Commission members and Ken Lester on what the best
way to handle this case would be.
Mr. Ramaglia I think the scouts should get the land, but that also the
public should be able to use it.
Mrs. Crowe I would like to add a #7 to the Resolution to read "detailed
development plan to be submitted to the Planning Commission for approval."
Ken Lester we would like to get this over with in September.
Discussion between the Commission members on additions to the resolution.
Mr. Ramaglia S/R means anyone can go on it.
Mr. Walton that is correct.
Mr. Ramaglia I don't want to see this area closed off to the public.
Ken Lester we won't close it to the public, but when there are boy scouts
and/or girl scouts present we would not want a lot of people crashing in
on them.
Mrs. Crowe there would be posting. I do not think is would be a problem.
Ken Lester I do not feel there will be a problem.
Roberta Lockman we need a restricted area. During camp the area must be
restricted. Our regulations state that we must have 1 acre per child.
Mrs. Crowe in this area you could only have 35 people.
Roberta Lockman that is correct. If we lose the Island Lake area we will
need changes in the resolution.

Mr. Hill moved to table a request for an Ordinance amending Title 17 of
Borough Code --Zoning, by repealing Chapter 17.21--Business Zones and
enacting Chapter 17.20--Business District until September 15, 1982.

Motion PASSED with a 4-1 vote with Mr. Hill, Mr. Ramaglia, Mr. Briggs and

Mr. Ball I abstained as I am listed on the license.
11. CONSIDERATION OF CASE LL-81-002. A request for a land lease on Section
2,portion of KIB 12, materia site along Russian Creek Subdivision. (Gary
A. Johnson)
Mr. Walton the Johnson's and Blair's are still squatting on the land.
Mr. Hill moved to reaffirm a motion made on October 21, 1981 that the 5
acre ortion of Section 2, T29S, R21W, S.M. be declared sur lus to Boro
needs, su divided an offered for sale. Seconded by Mr. Ba Motion
PASSED by unanimous voice vote.
Mr. Ball please place this on the September 2, 1982 Borough Assembly

12. CONSIDERATION OF CASE 82-079. Public hearing on an Ordinance enacting
Chapter 17.53 of Borough Code on Recreational Vehicles. (Community
Development Department)
Mrs. Crowe there should be something in the ordinance about total
maintenance.
Mr. Walton it should be in the intent section of the ordinance.
Mr. Hill moved to approve and pass to the Borouqh Assembly an
Ordinance enacting apter 17.53 of Borough Code on Recreational Vehicles

Mr. Walton explained why the house numbering was needed.

Mr. Briggs none
Mr. Hill change the Commission bylaws for attendance - there should also
e�hing on work session attendance.
Lengthy discussion on measures to take on meeting attendance, define
regular meetings. 3 meetings a month regular and work sessions combined
are grounds for removal.

21. DEPARTMENTAL REPORT
Mr. Crowe August 19, 1982, 7:00 CTA will meet on the Hosptial Plan and at
77:7--on—Tugust 19, 1982 there will be a presentation on the preliminary
subdivision by the Municipal Airport. Both meetings are in the Assembly
Chambers.

meetings will be in the High School Library.
