1981-11-18 Regular Meetingr KODIAK ISLAND BOROUGH PLANNING AND ZONING COMMISSION MINUTES November 18, 1981, regular meeting Page 1 (No tape recording of this meeting per a tape machine malfunction) CALL TO ORDER AND ROLL CALL - The meeting was called to order at 7:40 p.m. COMMISSIONER'S PRESENT Pat Briggs Virginia Crowe Jerry Gudenau Tim Hill Jim Ramaglia JoAnn Strickert A quorum was established. COMMISSIONER'S EXCUSED Ron Ball ALSO PRESENT Joanne Jones, Planning Secretary Bill Hodgins, Zoning Officer Dave Crowe, Engineer 1. MINUTES - October 21, 1981 - Mr. Ramaglia moved to approve the minutes. Mrs. Crowe stated that she had some corrections; page 1 - item #3, Mrs. Crowe's statement under public hearings should read - you are allowed only a mini -warehouse on business zoned land, page 2 - Mrs. Crowe mentioned that the reasons for denial should have been listed on the Buccaneer Case, page 5 - in Mr. Gudenau's motion the notation that the subdivision was approved per drawing in the case file (S-81-022), page 6 - Mr. Ball's motion should reflect the changes mentioned by Mrs. Crowe. Motion Seconded by Mr. Gudenau Motion PASSED by unanimous roll call vote. 2. SPECIAL ORDER OF BUSINESS. Election of Officers. MrRamaglia nominated Mrs Crowe as Chairman. Seconded by Mr. Guder PASSED with a 5-1 votend Mr. HiMrs. Crowe abstained and Mr. Ramaglia, Mrs. Briggs Mr. Gudenau all voted yes. Mr. Briggs nominated Mr. Ball as Vice-Chairman."Seconded by Mrs. Stri PASSED by unanimous voice vote. 3. APPEARANCE REQUESTS AND AUDIENCE COMMENTS - None 4. PUBLIC HEARING ON CASE 5-81-024. (Preliminary) Subdivision of lot 1, block 8, Monashka Bay Alaska Subdivision into three lots: lots 1A, 1B and 1C, block 8, MonashkE Bay Alaska Subdivision. (Paul Harder) STAFF REPORT: Mr. Crowe presented the staff report based on a memorandum prepared by the Engineering Department. Discussion between the Commission members on the topography of the lot. Mrs. Crowe closed the regular meeting and opendd the public hearing. Bob Tarrant Land Surveyor. I went out and shot some elevations of this flag lot, at the beginning of the flag there is a 7% grade at 50 feet, 18% at 100 feet, 20% at 150 feet and as you go up into the flag at the peak of the flag approximately 200 fee there is a 30% grade. Mr. Hill do you feel this would be a feasible lot for building with such a steep grad Bob Tarrant yes, as the buildable portion of the lot itself is not that steep. Paul Harder I feel that the lot is buildable. If someone was interested in purchasin This lot they could always traverse from side to side on the flag (not stem). Discussion between the Commission members on the ability to build on the lots. Lorna Arndt are these lots an acre or more? Mrs. Crowe the lots are 40,000 square feet or more. Mrs. Crowe closed the public hearing and reopened the regular meeting. Mr. Gudenau do we need to provide legal or practical access? Mrs. Crowe legal access is necessary. Mr. Briggs by eye sight of this lot it does not look feasible to build but on paper it may be feasible. Mr. Briggs I have no problem with this as long as we don't have to issue variances. Mr. Ramaglia wouldn't an easement be more practical? Mrs. Strickert shouldn't we be careful in asking for an easement rather than a dedicated road right-of-way as the problem we are having with Otter Way? Mrs. Crowe this is a little different, as one road access is private and one is public access. (Mary Peterson) STAFF REPORT: Mr. Crowe presented the staff report based on a memorandum prepared by the Engineering Department. Mr. Briggs what is the definition of a flag lot? Mr. Crowe our code does not discuss a flag lot. Discussion on straight subdivision lines. Mrs. Crowe closed the regular meeting and opened the public hearing. Mr. Gudenau what about subdividing the lot cross ways instead of lenghtwise? Bob Tarrant this way both pieces of property will have oceanview and beach front. Discussion between the Commission members, Bob Tarrant and Dave Crowe on alternative ways to subdivide the lot. Mrs. Crowe called a five (5) minute recess at 8:15 p.m.. Mrs. Crowe reconveined the meeting at 8:20 p.m. Mrs. Crowe closed the public hearing and reopened the regular meeting. There was some discussion on tabling this item. Mr. Hill moved to qrant Dreliminary approval of the subdivision of lot 18, block 1, Monashka Bay Alaska Subdivision into two lots: lots 18A and 16b, block 1, Monasnka Bay Alaska Subdivision with the following condition: the 120 foot lot width require- ment can be met by moving the interior lot line five 5 feet to the East. Seconded Ey Mrs. Strickert. Motion FAILED with a 5-1 vote, Mr. Hill voted YES, and Mr. Briggs, Mr. Gudenau. Mrs. Crowe. Mr. Ramaqlia and Mrs. Strickert voted NO. REASONS FOR DENIAL: 1. Denied on the basis that there were no topographical features of the land which made irregular shapes of lots desirable; 2. Lot could have been subdivided in another way, and 3. The commission does not have to approve a subdivision for the applicants financial gain. 6. PUBLIC HEARING ON CASE S-81-026. (Preliminary) (Resubmittal) Subdivision of lot 10, USS 3099 into two lots: lots 10A and 10B, USS 3099. Mr. Paden for the subdivision. The trailer is a rental and presently we are hooked into TT Jackson's sewer system. Mr. Briggs the shop encroachment bothers me. Mr. Paden the shop encroachment has been approved by the City of Kodiak. Mrs. Strickert what is the deal with the 25,000 square feet per lot? r — Mr. Crowe in the subdivision code it states that when a septic tank or other individua sewer system is installed... in no case shall the area of such lots be less than twenty-five (25,000) thousand square feet and only under ideal conditions shall the area be less than forty (40,000) thousand square feet. Mr. Ramaglia do you have a septic tank on the lot? Mr. Paden yes, but as I stated earlier, we are presently hooked into TT Jackson's sewer system. Mr. Crowe TT Jackson's system is not a public sewer system. Discussion on the sewer situation. Mr. Paden reiterated that he has verbal approval from TT Jackson to use his sewer system. Mr. Ramaglia what about a covenant on this property that no septic tanks be install- ed this lot, move the rental trailer and a written guarantee that you can hook into TT Jackson's sewer system. Mr. Paden no problem. Lorna Arndt last night at the Service District I meeting we discussed the possibility r-- of no more building permits being issued in the Service District area until water and sewer are installed. Discussion between Lorna Arndt and the Commission members on the Service District. Mr. Crowe when Don Gott applied for a subdivision it was approved with the stipulation that he hook into City sewer. You may wish to stipulate the same with Mr. Paden. Mr. Paden it would be a matter of condition to the sale. Bette Bishop at the July meeting I was under the impression that a two lot subdivision would be granted. The City granted approval for the shop encroachment. TT Jackson would like to hook up to the City sewer system but they are not taking any new additior If you grant this subdivision you will not be adding any more units as the rental trailer will move to the lot being created by the subdivision. Mr. Gudenau how much would it cost to hook into the City sewer system? Mr. Crowe If only a manhole has to be built, approximately $1,500 to $2,000, Any design will have to meet City requirements. Mr. Hill at this point I'm for tabling this item. Mrs. Crowe called a recess at 9:10 p.m., the meeting was reconveined at 9:30 p.m. r" Mr. Ramaglia moved to grant final approval to the subdivision of lot 10 USS 3099 into two lots: lots 10A and 10B, USS 3099 with the following conditions: 1 Change the Title block to "subdivision of lot 10. COMMUNICATIONS - No action needed. 9. CHAIRMAN'S REPORT - None 10. DEPARTMENTAL REPORTS - None 11. ADDITIONAL AUDIENCE COMMENTS Bob Tarrant why was Mary Peterson's subdivision turned down? And how would you like To see it subdivided? Mr. Gudenau like I stated before subdivide it crosswise instead of lenghtwise. Mrs. Crowe the reason for denial was because there are no topoqraphical reasons for th lot to be subdivided in this manner and we are not supposed to approve a subdivision or anything for financial gain. 12.
