The meeting was called to order by Chairman John Burnham, at 7: 40 p.m.
in the meeting room of the Kodiak Island Borough Office Building.

III MINUTES FROM PREVIOUS MEETING
A. P&Z - Regular - July 16, 1975 - Mr. Erwin made a motion to approve
the minutes from the previous meeting. Seconded by Mr. Lincoln. Motif
passed by unanimous roll call vote.
IV MINUTES FROM OTHER MEETINGS
A. Assembly - Regular - August 7, 1975
B. Assembly - Special - August 11, 1975 - Mr. Simmons noted that the
Boroug Kssembly overrode the Planning and Zoning's decision at their
regular meeting of August 7, 1975, on denying Mr. Zentner's subdivision.
Mr. Simmons stated that the Commission should make sure that Mr. Zentner
abides with the rules. Mr. Terry stated that at the meeting they had a letter
stating that Mr. S'satman could not deny access across the bridge, because Mr.
Zentner owned it. Mr. Burnham stated that it could be denied because Mr. Stratman
owned the bridge. Mr. Gariss noted that he had written the Bureau of Land
Management to grant an easement for access to the subdivision, and no answer has
been received as cf yet. Mr. Terry noted that in the minutes, the Commission will
note that after the Assembly's vote of approval, they moved for reconsideration to be
taken up at their next regular meeting. Mr. Hayden moved that we accept the
minutes as presented. _Seconded by Mr. Erwin. Motion passed by unanimous
consent.
V COMMUNICATIONS AND CORRESPONDENCE
A. Letter from Tom Terry Re: Vacation & Replat of Lots 14 & 15, U. S. Survey 3098 -
Mr. Holt moved for approval for public hearing on the vacation and replat
of Lots 14 & 15 U. S. Survey 3098. Seconded by Mr. Hayden. Potion passed
by unanimous roll call vote. Mr. Gariss noted that the water and sewer lines
should be shown on the plat, that it is required. Mr. Terry stated that this
r— is not a subdivision, only a vacation of a lot line and he will put it on the plat map if
the Commission so desires, but according to code is is not required. Mr. Burnham
suggested that it be put on the map.

C. Letter from Charles Powell Re: Permit Warehouse in a Business Zone -
Mr. Burnham explained that the reason Mr. Powell wrote- this letter is because
a warehouse is not defined for a business zone and to be in conformance with
the code, he is writing for an exception. The Secretary noted that when Mr.

the violation to the code has already been committed and a great deal of expense
has gone into a project and so the Commission is put into a spot where they
just about have to abide with the person's request and that the Commission should
be able to stop this sort of problem. Mr. Simmons noted that there are many other
warehouses already constructed in this, area and that they too are located on.a business
district. Mr. Simmons moved that we grant Mr. Powell his additional use
as he requested. Secondedy Mr. Trwin. Mr. Gariss stated that he woul
like the motion changed o include that the plans be submitted to the City
Engineer, Borough Engineer and the Planner to check out the traffic pattern.
Mr. Gariss was informed that the building permit was already issued and that
the building was already built. Mr. Gariss stated that he would still like to
check the traffic pattern out. Mr. Simmons noted that Krafts will create more traffic
than this warehouse. Mr. Gariss stated that the Commission could grant this exception
because it was not specifically called out for in the Industrial zones uses permitted.
Mr. Hayden mentioned that he talked;with.Norma Holt, and she had mentioned that a
buffer zone was to be kept between the business area and the residential area when
it was rezoned and he would like this to be upheld on this lot. Mr. Lincoln r.ecom,--
mende&that;;thV raotion be amended to include that Mr. Powell put up the buffer zone
of some type in this area. After some discussion, Mr. Simmons amended his motion
to include "conditional upon compliance with the original rezoning" Motion being

F. Letter from Lee Russell re: Temporary Sawmill Site - Mr. Burnham asked
how,long he would like to have the temporar; use. Mr. Russell stated that two
years is what he would like to have it for. He has 6 00, 000 feet of board lumber
to cut according to Reed Oswald. Mr. Erwin asked Mr. Russell if he had
contacted Mr. Stover to use some of his space. Mr. Russell stated that he did
contact Mr, Stover and the space he had available was not enough. Mr. Russell
stated that the two nearest houses at present would be at least 1200 feet away.
He further stated that the closest a house could be , if one was built, would be 500
feet away. Mr. Erwin suggested that the Commission let Mr. Russell use the
temporary sawmill for one year with option for one year extension. Mr. Simmons
suggested that we have a public hearing on this because of the flap that was
caused previously of a sawmill operating.in a residential area. Mr. Holt stated that
this was different in that he will be,processing his own timber on his own land and
not for a commercial venture. Mr. Russell stated that he will be cutting only the trees
within his road right-of-ways. Mr. Lincoln stated that the restriction he is
concerned about is that this temporary use does not includeany additional cut elsewl •e.
Mr. Erwin suggested that he be permmited to saw any trees within his subdivision.
Mr. Gariss stated that the Borough is twelve months away from acquiring any
industrial land. Mr. Gariss recommended that this be granted. Mr. Erwin moved
that Mr. Russell be granted the temporary permit for one year with option
for one year extension and that he cut only the trees off his property and process
them. Seconded by Mr. Hayden. Motion passed by unanimous roll call vote.
G. Letter from Jerry Johnson and Bob Mulcahy with letter from -,the City of
Kodiak to vacate street. Mrs. Johnson, explained where the, street llth Avenue
was located and that she had talked with the Public Works Superintendent and
he stated that this road would never be built because of the steep slope and

and plat map. Mr. Holt moved for public hearing and that the plat be presented
at the public hearing. Seconded by Mr. Lincoln. Motion passed by unanimous
roll call vote. Mr. Gariss stated that he will check this out with the City of Kodiak.

P&Z ITEMS
A. Report from Planner - (1) Mr. Gariss noted that the Borough has not
created a watershed district and that after some research from other codes
around the state he has modified somewhat the Greater Anchorage Borough
regulations on watersheds., for Kodiak. He would like to incorporate these changes
into the Borough Code. This is more of a housekeeping ordinance. He stated that
this would cover the City of Kodiak, U. S. Coast Guard and the second class
cities. Mr. Simmons moved that we recommend this to the Borough Assembly
and let them handle it. Seconded by Mr. Erwin. Mr. Lincoln recommended that
communication lines be included in this. Mr. Simmons so amended his motion
with the approval of the second. Motion passed by unanimous roll call vote.
(2) Mr. Gariss explained that the memo efore them on recreation -strict
was done after some research from codes from Fairbanks, Anchorage and
Ketchikan. In reviewing their regulations, he noted that there is a tendancy
to keep the improvements down to a minimum. Mr. Gariss recommended that
the Commission not create a recreation district, because of Section 16.28.010
is sufficiently broad enough where deviations can be granted within subdivisions.
He stated that the Commission could waive the requirements on subdivisions
and continue to use the present ordinance and adjust accordingly. Mr. Lincoln
asked if this is what he is suggesting and Mr. Gariss stated yes. After some

discussion, it was brought out that Chapter 16.28.010 and Chapter 17.12.030
might possiblybe in conflict with each other: Mr. Burnham stated_that the Commission
study this and bring it back to the next meeting for action. (3) Ivfr. Gariss
stated that the request for revision of the minimum improvements required within
a subdivision was given to the Borough Attorney for him to draw up a new
change. (4) Home Occupations is still being reviewed. (5) Mr. Gariss
explained the Native land Claims Map and their selections (6) Mr. Gariss
explained the area in which the Borough is presenting selecting to acquire
some land for a quarry site in which the City of Kodiak, and the Kodiak Island
Borough will use jointly. Three contractors will be able to use this area. (7)
Mr. Gariss stated that the proposed extension of Rezanof Drive will create
five acres of stumpage and it should be looked into as to what should be done
with these stumps. Mr. Erwin suggested piling them in the City dump. (8)
Ivir. Gariss stated that he is preparing a packet of forms and procedures for
Planning and Zoning and developing a check list to go by. He would like to have
a couple meetings with the Engineer, surveyor and a member of the Commission
to see if everything is covered. Mr. Erwin stated that he will volunteer until
such time that he goes on vacation.
Mr. Burnham noted the information on the Zimmer warehouse. The secretary
noted that this matter is now in the Borough Attorney's hands.

I Mr. Erwin suggested that the clock be fixed in the meeting room.
Mr. Burnham stated that this would probably his last meeting as he was leaving
and that he has enjoyed his term on the Planning & Zoning Commission.
