Minutes of School Board Meeting of September 8, 1969 - there were no convents on these minutes. V CalVNICATIONS AND CORRESPONDENCE - NONE VI' PUBLIC HEARINGS - NONE VII ZONING ITEMS A. Petition fron Wakefield Fisheries for Rezoning of Pribilof Point from Conservation to R-1. The petition was read in part which stated that the re- zoning was being requested due to the need for additional residential area and the rezoning is needed for the planned subdivision. This case had been reviewed by Pair. Madsen and his cannnents were read; An original application should be filed and signed and no allegation of or proof of ownership accaTpa hied the petition and one should be required. if these two points are satisfied the matter can be approved. Mrs. Kvallheim moved that Planning & Zoning give tentative approval until conditions ore and two are satisfied and if they are so satisfied the public hearincr will be set for the next reoular Planniina & Zoning meeting, B. Petition for Vacation of Existinc 10-foot Wide roadwwv. Vance Block 5, U.S. Snrvey 3474, Case 224-A. The petition signed by Vance and Eva L. Christian was, read stating that the access road described in the petition is not in use and the public would in no way be affected by the vacation. The Case had been ravieued by the, Borough Attorney and he recommended that in order to avoid possible legal complications that the Comer or Owners of Lot 4 should be contacted and a letter of non -objection obtained. The approval of the Planning & Zoning could be given for the advertising and public hearing to be held at a later date. Mr. Wallace moved for the approval of the vacation of the 10-foot wide Roadwav, Block 5, U. S. Survev 3474, Case 224-A and that the C. Approval of Placement of Trailer in R-2 Zone, Block 1, Lot 12, Miller Point 2nd Addition, Mr. John Vollmer. A letter was read from Mr. Vollmer requesting that he be allowed to place a trailer on his land at Miller Point; he further stated that he hoped to build on the lot at a later date. Mrs. Kvalheim moved for approval of placement of the trailer on Lot 12, Block, Miller Point 2nd Addition, seconded by Mr. Welch. Roll call vote was as follows: Mr. Wallace NO; Mrs. Gellis ITS; Mr. Welch YES; Mrs. Kvalheim YES; Mr. Waller YES. Motion passed. KIBS272654 PLANNING & ZONING COAMSSION - SEPTUMER 10, 1969 Page 2 • D. Ratification of Work Session and Establishment of Date for Public Hearing on Zoning of Bell's Flats. The work session minutes were read and Mrs. Gellis moved for ratification of the minutes, seconded by 11r. T,7elch, motion passed by unanimous voice vote. 11rs. Gellis moved that a public hearing be adverti for zoning of Bell's Flats for the next meeting, September 24th, 1969, secon by Mr. Wallace. The motion carried by nrnnim im cmira vni-o IX SUBDIVISION FINAL A. Approval of Final Plat, Scott Subdivision, Lots 1, 2 and 3, Block 2, USS 3066 A&B, Robert Scott (Case 221-A). This case and Case 221-B (rezoning) was discussed to great length at the previous meeting and in conjunction with the subdivision a rezoning of the area had been denied by the Planning & Zoning Commission. The I Attorney had been contacted on this subdivision and the Statutes were cited: Chapter 5, Sub -Chapter 4, Section 9 which states in part that the Borough Assembly, after a report from the Planning & Zoning Commission, may vary or modify such requirements of the subdivision, so that the subdivider may develop his property in a reasonable manner, but so that at the same time, the public welfare and interests of the borough and Surrounding areas are protected and the general intent and spirit of these regulations preserved. A letter received fran the City of Kodiak after the last meeting was read into the record. The letter listed objections to the proposed rezoning as this was considered to be spot zoning. Further the City felt this was not a subdivision and did not meet the mi.nisman requixements of the zoning ordinance for access to lots not now on public roads. The plat shows a 10 foot wide access to the back lots. This was vne of the points previously discussed and at the close of the last meeting, 114r. Scott was to contact his lawyer to see what arrangements could be made for an increase in the easement. To date nothing has been accomplished in this direction. The Commission noted that due to an exception granted in the past by the Borough Assembly there are violations to the zoning ordinance in this area and felt that -the Ccmdssion could not pass this final plat. without a recommendation by the B=,;ugh Assaobly. Mrs. Gellis moved that this be forwarded to the Borough Assembly with the note that the Co =fission could not approve this as it does not meet the subdivision requirements and request the assembly's recarnnendations. Included as a part of the motion was the stion that a continued effort should be made on the part of the lawyer to resolve this matter, seconded by IIr. Welch.
