The meeting was called to order by Acting Chainnan Harry Wallace at 7:35 P.M.
in the Courtroan of the New State Office Building, Kodiak, Alaska.

A. Regular Meeting - January 29th, 1969. Mr. Brothers moved that the minutes
be approved as presented, seconded by Mrs. Gellis. Motion passed by unanimous
voice vote.

A. Rezoning East Addn., Blks 36, 44, 45, 40,43, 46 & 47, from R-1 to R-2 (Case 209-1
The case was reviewed and a letter from Mr. Elledge was read stating that he
was not able to attend the meeting but was in favor of the rezoning. A petition
objecting to the rezoning was presented to the O mrission. Mrs. Gellis moved
to approve the rezoning of East Addn., Blks 36, 44, 45, 40, 43, 46 & 47 from
R 1 to R-2, seconded by Mr. Welch. The meeting was recessed and the Public
Hearing opened. Mr. W a� for any comments from the audience :od this
proposed rezoning. The following people were present;Bix Bonney, Mr. Thonssen,
Mr. Lassen, Mr. Reynolds, Mr. Stewart, Mrs. Andrich, Mr. Andinger and Mrs. Saupe
opposing the rezoning and voiced the following objections:
(1) A considerable amount of money has been spent on the homes and this
area was chosen because it was R-1.
(2) If rezoned there would be no protection for the present owners to
insure that homes built would not downgrade the area.
(3) Poorer homes would be built if this were to be rezoned to alleviate
the tax burden.
(4) At the time many purchased the lots R-2 was cheaper and people that
wanted to build in an R-2 Zone should have purchased in an R-2 area
and not change the present zoning. There is not much R-1 area left.
(5) The location i some instances was chosen for the view and if two or
three story buildings are but up the view would be spoiled.
It was a consensus of opinion of these people that perhaps a restricted type
R-2 could be written into the Ordinances in order to offer sore protection to
the present owners. This could stipulate either over/under type construction
or side by side and also with the agreement that the house must be owner
occupied.
11r. Anderson, Mr. Dyson, Mr. Nesnidal and Mr. Zimmer spoke in favor of the
rezoning but did not want to see the property in any way downgraded because of
the rezoning. They were in agreement also with the restricted type R-2. O`dher
points were brought out: (1) the need for extra housing in Kodiak; (2) the
high rate of taxes makes it necessary to have some assistance in meeting these
taxes; (3) the fact that an area is R-1 does not prevent a cheap building
being built; (4) Multiple dwellings can not be built on single lots as they
are not big enough and hither pointed out that this would up grade the area
rather than the opposite. It Uras suggested that perhepo a smaller area could
be taken into the rezoni-ig so as not to inconvenience the people not immediately
concerned.

It was noted that a revision of the zoning ordinance is ncxa in the working
stage and this would inoo;:porate the amendments. Under this, restrictions
can be established as perhaps R-2A and R-2B which could limit the tyre of
dwelling, whether it would be over/under or side by side, the height and
parking facilities. A zoning ordinance is a way of insuring an organized
growth pattern. A change will occur at any rate due to the economic growth
which would dictate the way buildings would go. Just because an area is zoned
one way does not mean that it will always stay zoned in that manner. It is
not possible to stipulate that a person must occupy the house he is renting,
even in an _R-2 zone, but a limitation can be made on the type of dwelling
built in that area.
Mrs. Gellis explained that the Comprehensive Plan had been adopted and that
the Bcrough will try to wo' toward implementation of the plan over the next
30 years. This area under that 1999 Land Use Plan is scheduled for Medium
Density which includes duplexes on lots of 7,200 square feet. It was further
noted that a Public Hearing will be held at the time that the revision of the
zoning ordinance is completed to allow the public a chance to be heard on the
matter.

A. P&Z Recommendations on Amendment to Code To Include USE Variance. in discussion
of this it was pointed out that this would just be spot zoning and could serve
no purpose. Mrs. Gellis stated that the variance granted to iIr. Ron Chase
should be taken back as it was not legal. Mr. Brothers moved that the
Ordinance not be amended to include a USE variance, seconded by Mrs. Gellis
The motion passed by unanimous voice vote. Mrs. Gellis moved that ii outside
laiyer look into the possibility of rescending the use variance issued to
Mr. Chase. seconded by Mr. Welch. The motion passed by a unanimous roll call
B. Bui.lding_ Restrictions - Mr_ Br ers_suggested that some way be found to
prevent people from building for speculation under the guise of building
a private home; stipulating that the work be done by licensed plumbers
and electricians,
- C. OFF - Street Parking - Mrs. Gellis suggested that the ordinance be changed
to require two off street parking spaces as most families have more than one
car.
