I CALL TO ORDER
The meeting was called to order by Acting Chairman, Jerry
Holt, in the Courtroom of the State Building, at 7:30 P.M.

Mrs. Holt read the letter to the public I'or infcrmatlon.
The zoning in this area is R-3. The Borough Attorney
stated that P&Z could not grant an exception for this type
of case but they coud grant a certain type of special policy.
Mr. Erwin stated we should check with the Fire Marshall
f;r any objections he might have. Mr. Erwin moved that if
the Fire Marshall has no objections on the sleeping quarters
in the Baptist Church. P&Z concurs with his decision.
B. Letter from Rolland Jones with recommendations on the
Wakefield Subdivision - Mr. DeVaney is checking with the
Engineer on the recommended changes. Mrs. Holt stated if
the committee wants to concur with Mr. Jones recommendati
we will notify Mr. DeVaney and Mr..Jones as such. Mr,

of the Environmental Protection Agency.

The other lots that are zoned R-3 have single unit houses
on them. The reason for zoning the lots Lo R-3 is because
they wanted to house some carpenters in the basement, that
would be building the other new houses this summer. Mrs.
Heitman ob-ected to the rezoning to R-3 bec:'w -, she believed
there rou:i-d be to much traffic and she lived right across
the street from the apartments in question. Mr. Holt

was someone from the audience who asked if every lot owner
in Bells Flats mould have to go through requesting for a
variance on lots "hat involved foundations close to the
road. T,_e gentleman further stated that this in effect
is depriving a lot owner of his land and also that it should
have b,2en taken into consideration on the original survey
of the area. Mr. Greer believes that the set back require-
ment of 50 feet is to much. Captain Acker stated that the
people *ho bought the property in the auction believed
they could build on the foundations. He also stated that
there should, b-: a blanket precedent for all the lots instead
of each individual case. Mrs. Holt stated that the lots
were sold a:; i,,improved lots. The public hearing was closed
and the regular meeting reconvened. Mr. Terry chanled_h?•=
motion, with the approval of the second to read: that the

It was indicated on the submitted map that the straight
line was the proposed sewer line and the crooked lino.

if the Borough could request for a 60 foot utility easement
from the main road along the back side of this surv3y
He further stated that this was what Roy Ecklund and Rolland
Jones and the City Manager suggested to him. Mr. Shockley
asked that if P&Z could approve this right-of-way, he would
be able to hook up to City water from the road. Mr. Benton
had suggested that Mr. Shockley could have a 5,OODgalion
holding tank t- _ July 1st, when the ground thaws. Mr.
Burnham moved for approval of such to an acceptalbe sewer
facility. Mr. Burnham withdrew his motion. wr_ !11cs.ted

B. Mildred Markham - U. S. Survey 3218, Lots 1-8 - There was
a letter from Mr. DeVol, State Sanitarian, requesting
that Mrs. Markham hook up to the sewer line when it does
come by her property and that it be indicated upon approving
her final plat. It was stated that if Ci-;� water and se-.: 3r
did pass her property it would be manditory for her to d�
SO. It was also noted that there was a 15 foot utility
easement on her lot. Mr. Erwin moved that we approve thc:_
final plat subject to Mrs. Markham's approval of the 15
foot utility easement. Seconded by Mr. Terry. Motion
naeaed by unanimous roll call vote.
IX P&Z ITEMS
Mrs. Holt stated that a letter is being written to Iver
Malutin, to be on the P&Z Commission, he will be taking
Jim Wheeler's place.
