I CALL TO ORDER
The meeting was called to order by Chairman, Mr. John Welch
at 7:45 p.m. in the courtroom of the State Building.

V COMMUNICATIONS AND CORRESPONDENCE
A. Letter from James and Sandra Peotter - Request for a

that this was a reasonable request and that he had read
somewhere a regulation stating that if 75% of the dwelling
were closer than the regular setback that a new dwelling
could be brought up on a line which was the average of the
other setback. He could not remember where he saw this
regulation and stated that if this was infact a regulation
then they do not need a variance, only application of the
ordinance. Mr. Holt recommends that we send a memo to the
building inspector stating that the Planning and Zoning
Commission concurs with this recommendation and notify 'him
that it is in our Code Book, Chapter 5.2.12. Mr. Welch
recommended that the building inspector take a look at the
site to see if it meets the requirements of the Code.
B. Memo from Borough Clerk on the Foreclosure of U. S. Survey
372, Three Saints Bay, Kodiak, Alaska - There was some
question as to whether or not we had any choice of stopping
the previous owner from retaining the land. Mr. Burnham
stated that it should be platted on some map, if it is near
a historical site. Mr. Holt recommends that we ask the
Historical Society if this survey is of some importance and
if it is near a historical site. Mr. Burnham recommends
that the man be allowed to proceed according to the law.
Mr. Welch also recommended that we let the man pay his
taxes and retain the land. Mr. Erwin made a motion that we
table until we aet more information on this suoject.
Seconded by Mr. Holt. Motion passedb unanimous roll call
vote. Suggestions were to ask the Histor ical 6ociety and
also perhaps have someone go out and look at this site and
see if it is on the same side of the bay as the site.
Mr. Burnham believed that the Whaling Company and the site
were on opposite.sides of the bay.

B. Letter from Borough Attorney - Decision on Ronald William's
request for a variance - The letter was read by Mr. Holt.
The commission unanimously agre.;.s with the Borough Attorr..,y
on denying the request of Mr. Williams. His variance.doos
not fall in any of the 18 catagories required for a variance.

by Mr. Erwin. Mr. Welch closed the regular meeting and opened
the public hearing. It was noted that on the fifteen foot
easement there will be a stipulation that. no less than eight.,
feet will.remain open at all times for a fire lane. Mr.
Breokburg will own lot 6, and the Borough is granting an
easement for Mrs. Strigga to be.able to have --access onto tl±e
main road.from.her•.property. Mrs...Strigga-was concerned a~ou',
being able to use the road -and that it would not be blocked
off. It was noted that an. easement will always -give .her
the right of way. Mr. Welch closed the public heartng.and
reconvened the regular meeting_ Question being called for

A.__..Mr., Hickman wanted the Planning..and--Zoning Commission to
review the plat of the proposed Chiniak land sale. The
Commission only questioned where this land was located. The
location of the sale is located right along the boundaries of
_ the Chiniak Military reservation and extends toward town.
Mr. Welch stated -we -should set a- date to have a work. session.
with the Borough Assembly, and it should be. --in some form of
a letter stating that this matter should be attended to as- -
soon as possible because it has been apparent in the pact
_ that both.bodies' have"not been thinking in the same direction
and there has been many conflicts. The suggested date --was"
set for April 24, 1973 at 7:30.
