P$Z - Regular - June 20, 1973 - Mrs. Holt noted the corrections made to the minutes, under Communications & Correspondence - No. A should read Vacation and Replat instead of rezoning and under Subdivisions, Final, - No. A should read Block 1 and No. B should read U. S. Survey 3465. Mr. Holt moved for approval with the corrections as stipulated Seconded by Mr. Erwin. Motion was unanimously favorable. ' IV MINUTES FROM OTHER MEETINGS A. Assembly - Special - June 22, 1973 - No comments B. Assembly - Special - June 26, 1973 - No comments C. Assembly - Special.- June 29 1973 - No comments V COMMUNICATIONS $ CORRESPONDENCE A. Lettbr from the City of Kodiak RE: Use Permit for Busi Use on City OwnedLan ots 3, 4 an 5, U. S. Survey 3099 (Near Kodiak Airways - Municipal Strip along Mill Bay Road) - Mrs Holt read the letter tthe public for their information. The City is requesting thios in order to lease to Lloyd Benton, who plans to store some lumber on this land. There is a ,height restriction in this area. Mr. Holt moved for approval seconded by Mr. Erwin. Motion passed by unanimoug- roll call vote. Mrs. Holt stated if it is determined we need a public hearing on this she will let the Planning d Zoning Commission know. B. Exception Request - RE: Fencing Height Limitation - Greenup - Mrs. Holt read hir. Greenup's letter to the public for their information. She noted that in an "R" district you may have a fence height up to six feet, except for that area from the setback line to front property line when the fence may be no more than four feet high. Mr. Greenup stated the reason he wanted a higher fence is that he is completely surrounded by commercial zones and he wanted to put a higher fence in so he will not be bothered by them. Mrs. Holt stated that we cannot grant him an exception. She further stated that we would have to change the Code in order to grant his request. We could revise the ordinance so that fence limitations and exceptions can be done by the P$Z Committee and the Borough Assembly and the owners be contacted to this respect. Mr. Terry stated there is a need for a definite change and he moved that we keep the limitation in The book but that particular limitations can be modified on a case by case basis after submission of request to the P$Z Committee and a public hearing should such hearing be deemed necessary. Mz. I�elch stated that since we are plan- ning to have a work session we can look over this section on exceptions and fences. Mr. Erwin seconded the motion. Public Hearing, Vacation and Replat portion of U. S. Survey 1396, and Lots 31 and 32, Block 1, Airpark Subdivision r-- (John Fray - Case 289-A) B. Public Hearing, Rezoning Portion of U. S. Survey 1396 from Unclassified to Coincide with front portion of Lots 31 and 32, Block 1, Airpark Subdivision ( Case 389-b+- Mr. Holt moved for approval on the above requests. Seconded by Mr. Terry. Mr. Welch closed the.regular meeting and opened the public hearing, there being no comments, he closed the public hearing and reconvened the regular meeting. Question being called for, Motion Dassed by unanimous roll call vote. C. Public Hearing on Request for Additional Use Permit to Allow for Transmitter Station in Unclassified Zone on Lots 6, 7, and 8, Block 1, Kadiak Subdivisior_, First Addition, (U. S. Survey 3512) (Case 291-A) - Mr. Holt moved for approv Seconded by Mr. Erwin. Mr. Welch closed the regular meeting and opened the public hearing. Mr. Dewitt Field, who represented the Church of Christ, stated that they were curious as to what it was and where they were going to put the road in etc? Mrs. Holt stated that they were planning to put up a transmitter station with an antenna field. Mr. Holt stated that it did meet with the airport height safety requirements, Mr. Erwin stated that it might interfere with the Loran Station communications systems. There was some question as to what road R.O.W. was going to be used. Mr. r Welch closed the public hearing and reconvened the regular meeting. Question being called for, Mr. Erwin stated that he would consent to the motion if the Loran Station was notified and that it would not interfere with their equip- ment. Motion was changed as such and with the concurrence of the second. Motion passed by unanimous roli call vote.` VII SUBDIVISIONS, PP.ELIM:NARY A. U. S. Survey 1396 - Catholic Church - Tracts A-E - Subdivisicn - (Case 254-C - Bundy) - Mrs. Holt briefly ex- plained the area in question. Mr. Bundy plans to put a trailer court on Tract C and that he does have plans that were presented about two years back and should be presented again with the new subdivision. Mr. Burnham moved for approval on the preliminary plat. Seconded by Mr. Erwin. Motion passed by unanimous roll call.vote. B. Subdivision and Exception - Houser/Nordgulen - Lot 8, Block ":, Monashka Bay Alaska Subdivision - Lot 8A and 8B are both over the required 40,000 squ,_ feet. Mr. Holt stated that he doesn't think we can grant exceptions on this case. He further stated we should send this to the Borough Attorney for his opinions for interpretation of the work "conditions". It was noted that they are probably u ag I— the same septic systems. But PP,Z felt that putting"a new house up would constitute getting a new septic system test, etc. Mr. Holt moved that a question be submitted to the Borough Attorney to determine whether P$Z can legally gran exceptions and secondly that prior to the next meeting we !' have a statement from the sanitarian showing that it is or _ is not in accordance with the current sanitation standards for sewage and water. Seconded by Mr. Burnham. Motion passed by unanimous roll call vote. C. Ca niak Preliminary - a) Subdivision b) Rezoning - There are about 44 'c involved it this sle. There is 8,000 l$nQal' feet of proposed access roads. Mr. Ecklund, Registered Land Surveyor, explained the terrain of the area. Mr. Bill Kirk asked if Ray Hickman, had checked with the State of Alaska, to contract with them to put in the access roads ►"- perhaps they would do it at a cheaper price. Mrs. Holt stated she would ask Mr. Hickman when he returns. Mr. Ecklund stated that it would cost perhaps about $8.00 a foot to put in the road. This would average about $1300 a lot. Mr. Holt moved for approval of this preliminary plat. Seconded by Mr. Burnham. Motion passed on the following roll call vote: Mr. Holt - YES, Mr. Terry.- NO Mr. Welch - YES Mr. Burnham - YES Mr. Erwin - YES. Mrs. Holt stated that we need a public hearing on the re- zoning.for our next meeting. Mr. Holt so moved. Seconded Mr. Terry. Motion passed on the following roll call vote Mr. Holt - YES, Mr. Erwin - YES, Mr. Burnahm - YES, Mr. Terry - NO, Mr. Welch - YES. VIII SUBDIVISIONS, FINAL A. Final Plat Vacation and Replat, Lots 5, 6, 7, 8, 19, 20 and 21, Block 7, Leite Addition to SA, 5B, 6A, and 7A, Block 7, (Case 285-A) - Mr. Holt moved for approval. Secon by Mr. Terry. Motion passed by unanimous roll call vote. IX P&Z ITEMS A. Review of Recommendations for Building Permits in the r Island Lake Area, To be Forwarded to Borough Assembly - Mrs. Holt stated that she would like some recommendation from the P$Z Commission or their concurrence on Mr. Cherrys' letter which recommends that no more building permits be issued in the Island Lake Area. There was some discussion as to build- ings that were already being put in and the water shortage conditions. Mr. Terry moved that we concur with Mr. Cherrys' letter. Seconded by Mr. Burnham. Perculation tests are now required before putting septic systems. Mr. Hangstefer, the Building Inspector, noted a trailer had recently been placed on a lot in the Miller Point, First Addition area. Although this Lot was previously occupied by a trailer, the septic system was approved in 1969, the Lot has not been occupied for the past year. It is the feeling of the Building Inspector, that because of the period in which the lot was not occupied; constitutes a new installation and would have to conform to the new regulations. The Commission Concurred. Mr. Terry stated that the people should be notified to vacate the property. Motion passed by unanimous roll call vote.
