gave a brief summary on the background involving this case.
Mr. Del Valley was issued a variance in 1965 to build a multiple
dwelling on these lots, he was also issued a building permit
but never used either of these. Since it has been about eight
years, it cannot apply any longer. A variance is only valid
for six months and the construction must start within that time.
The area in question is presently zoned R-1. It was further
stated that in the Comprehensive Plan, this area is proposed
for high density use. The four lots involved have 24,000 square
feet. Dr. Eufemio plans to build a 23-unit apartment building on
these lots. Mrs. Holt stated that you need 1600 square feet
lot area per unit for eight or more units. Mr. Vogt, who is
also involved with the building of these apartments, stated
that he believed the ordinance was too strong on the amount of
area required, and he further stated that the reason for buying
these lots is because they wanted to find lots that did not have
too many existing houses and on which would be economical to
build. Mrs. Gellis, asked if there was a restriction the heighth
of the buildings. Mrs. Holt stated that they either must be 2 1/2
stories or 35 feet. Mr. Holt felt that what P&Z is doing is spot
zoning and this is what they were told not to do. Mr. Vogt
stated that they will build the apartment building according to
the amount of square feet involved. Mr. Terry stated since the
whole area is proposed for high density in the Comprehensive
Plan, that instead of spot zoning, we should try to rezone a
good portion of the area and by notifying all :the people to see
if they want their property rezoned to go along with these four
lots. Mr. Holt had some question as to the road #ervicing this
area, if it would stand up to all the traffic. Mrs. Gellis
stated that we should notify the City that we are going to rezone
a great portion of the area on Mission Road and that they should
improve the road system. Mr. Holt asked how firm Mr. Vogt's and
Dr. Eufemio's plans were? Mr. Vogt presented the Commission with
the set of plans for the apartment complex. Mr. Holt moved for
a public hearing on lots 1, 2, 13, & 14, Block. Motion died

wanted rezoned and if there were a lot of objections from the
property owners, they could cut it down to a smaller size.

The area the P&Z Commission wants to rezone to R-3 was described
to include as follows: Tolbert Subdivision, Leite Subdivision,
Leite Addition and Urdahl S,-'zdivision which includes cross
streets Spruce, Delaroff and on the Oceanside of Mis.:ion Road.
Mr. Holt moved for a public hearing on the area Mrs. Holt had
described. Seconded by Mr. Terry. Motion pass,-d bir unanimous
roll call vote. Mr. Vogt stated that he would like to have -
the public hearing sooner, so they could start l;uilding this,
before the f_i,ozing develops. Mrs. Holt stated it wouldn't make
any difference when we had our public hearing, ,a would have
to wait for the October meeting of the Assembly for the first
reading on the Ordinance anyway.
B. Letter from Ok_ey Chandler - Requesting a variance on Lot 2,
U. S. Survey 3099 - Mrs. Holt stated what Okey Chandler was
really asking for was a rezoning of this lot. It was noted that
we were looking at this area last year to rezone the whole area.
Mr. Terry suggested that we zone the whole area up to the
sewerplant (inclusive) commerical. -But commerc`:al does not limit
this area as R-3 would. Mr. Holt moved to table until the next
work session and we will review this further. Seconded by Mr.
Terry. Motion passed by unanimous roll call vote. Mrs. Holt
suggested that we look over our ordinances at this work session
because the Borough Attorney hasb--e intown for the past two days
and he b some suggestions on changing the ordinance. She
also stated that we should review our ordinance to enable
persons to build in an Unclassified area on a 20,000 square foot
lot if it has water and Permanent sewer.

does not have the authority to do this. Mrs. Holt stated that
the commission does have land use authority and we can make
recommendations. Alaska Welding plans to clean up the area and
will gravel the area and enclose it with an 8' chain link fence
with lights in the winter months. Mrs. Gellis stated that they
mere supposed to put a park on this lot. Mr. Terry moved that we
disallow this request. Seconded bey Mr. Holt. N1rs. Holt stated

Alaska Welding Enterprises, Mr. Holt asked about the sewer lane
going through this lot. Question being called for -motion pasted

VI PUBLIC HEARINGS
A. Rezoning Chiniak Subdivision from Conservation to Unelr�ssified-
Mr. Holt moved for approval of the rezoning. Seconded by Mr.
Terry. Mr. Welch closed the regular meeting and opened the
public hearing. Soreone from the audience had a question on
the lot sizes, if th:y would be too small. It vas noted t'^at
the smallest one is 1 1/2 acres, well abcae one 40,00 square
feet required. He also stated that if he did buy the land he
was now living on, he already has a sceptic system and i-ater.
What would he have to do with his present system. Mrs. Holt
stated that he would have to meet state standards. A question
was raised on the projected schedule of the sale? Mrs. Holt stated
she did not know and Mr. Hickman would be the one to ask.
Mr. Terry still believed that we should give them the land bepause
of the $1800 for the road for each lot and a perculation test,
which is $200 would run $2000'for eacli lot. Mrs. Holt stated at toe
last meting Mr. Ecklund had indicated that it would run $8 a
foot for the road.

Mr. Welch closed the public hearing and reconvened the regular
meeting. Motion passed by the following roll call vote: Mr.
Welch - YES - Mr. Holt - YES, Mrs. Gellis - YES, Mr. Terry NO, Mr. Burnham - YES.
VII SUBDIVISIONS, PRELIMINARY
A. Chiniak Subdivision - Mrs. Gellis moved for approval
of the preliminary subdivision. Seconded by Mr. Burnham.
r- Mrs. Holt noted that it was already approved at the previous
meeting. Mrs. Gellis withdrew her motion, with the second
concurring.
B. Tideland Tracts 16A, 16B, and 16C- Mildred Muller -
Mr.. Holt stated that we needed a letter from Mrs. Muller
stating why she wants this vacation and replat, in order for
the commission to do anything. Mrs. Gellis moved that we
have a letter describing: the action Mrs. Muller would like the

Mrs. Holt asked the Commission if they could table this until
more research is given. She stated that the Borough owns the
land on the other side of Nordgulen and possibly we could
sell him 20 feet to give him enough width requirements for his
lot. The -Borough Attorney stated we could grant him a setback
variance, but it did not meet the requirements on the lot wid h
even though they both had sufficient ground. It was suggested
that they could present other plans on subdivision of this
lot. Mr. Holt stated that according to the Borough Attorneys
letter we cannot grant him the variance request. Mr. Holt moved

IX P&Z ITEMS
A. Mrs. Holt stated that Mr. Bundy's trailer court plans have
been approved by the State Sanitarian and that he is waiting
for a letter from them indicating this, but have not received any word
as of yet. It was noted that we should take a close check on the
width between the trailers. The required width is 15 feet
between mobile homes. Mr. Welch states we should not consider
this until we receive a letter from the State approving the
court.
X AUDIENCE COMMENTS
Mr. Armstrong was in the audience, representing Mrs. Austermgn,
who wanted to put a porch on her house. He.had'already talked
with Mr. Hangstefer, and he said Mr Armstrong would probably
have to go to P&Z because the porch might come too close to
their lot line. She wants to put on a five foot porch (not en-
clozed) on her house. P&Z stated that he should go to Mr.
Hangstefer-and have him measure his lot line to where the pro-
posed porch will -be -to see if he would have enough room. If'
not he would then have to come to the commission for a variance
request.
