1972-01-19 Regular MeetingPL1aINING AND ZONING COMMISSION, KODIAK ISLAND BOROUGH JANUARY 19th 1972 r r- r I CALL TO ORDER The meeting was called to order by Chairman John Welch at 7:30 P.M. in the Courtroom of the State Office Building, Kodiak, Alaska. II ROLL CALL Present Absent John Welch, Chairman Coleman Constance E. E. Erwin Gary Hinkle Jerry Holt Jim Wheeler Also present: Judge Waller and Sam Graber III MINUTES OF PREVIOUS MEETING A. P&Z - Regular Meeting - December 15, 1971 - There being no objections voiced the minutes were approved as presented. IV MINUTES OF OTHER MEETINGS - NONE v COMMUNICATIONS AND CORRESPONDENCE - NONE VI PUBLIC HEARINGS A. was noted on the Borough Zoning Map. Mr. Hinkle moved to grant the ex- ception to use the Public Health Building as a Half -Way house, seconded by Mr. Holt. The regular meeting was closed and the public hearing opened. Mr. Graber was in the audience and had been asked by two of his tenants to voice their objections concerning this additional use. Mr. Graber did note however, that the two tenants were not in the immediate area. It was pointed out by a member of the Commission that perhaps those individuals objecting thought the Half -Way House would be on the same order of a Skid - row Mission and this is not the case. Judge Waller was in the audience as a representative of the Kodiak Council on Alcoholism, Inc., and gave a short resume on the operations of the Half -Way House. It was pointed out that no one will be admitted to the House while drunk; admission will come through the hospital or through the Police Department. This is a much needed facility in our community and felt that there will be no problems with drunken people wandering around the residential area. The public hearing was closed and the regular meeting reconvened. The questions was called for and the motion passed by unanimous roll call vote. VII ZONING ITEMS A. t-4emo from City Re Building Code Concerning Old Buildin s, read in full along with that portion of the Uniform Building Code, 196 , which covers the subject on old, unsafe buildings. This memorandum was received in answer to a letter to the City asking about ordinances on the books that govern the removal of old, unsafe buildings. It was pointed out that the new Building Official, Mr. Pugh, has been checking into this also and in fact has several buildings that he will be requesting the City Council to take action on. He was not able to present this to the Council at their last meeting as the City Manager was out of town. The Ordinances do give the Building Inspector and the City Council the authority to have the buildings removed (if the owner does not do so within a given period) and to attach( a lien against the land for the cost of such removal. Mr. Holt moved that a letter be drafted for the signature of the Chairman of the Planning & Zoning Commission expressing the position that the P&Z Commission is in favor of enforcing the ordinances regarding damaged and unsafe s ruc ures, seconded by Mr. Wheeler. The question was called for and motion passed by unanimous roll call vote. IKIBS272730 KIB PLANNING & ZONING COMMISSION, JANUARY 19, 1972 Page 2 VIII SUBDIVISION, PRELIMINARY A. Vacation and Replat of Lot 25, U. S. Surve I'll Clayton B Parker (Case 260 A) It has been brought to the attention of the Borough that Mr. Parker has subdivided his lot in Survey 3471 without going through the proper procedure as set out in the Borough Code of Ordinances and the Alaska State Statutes, Mr. Clayton was written a letter requesting that he comply with the regulations. This would be handled as if it were a new subdivision. During the course of r- the meeting it was noted that the lot does not in fact meet the area require- ments under its present zoning, however it was further noted that very few of the lots in the surveys in the Chiniak area meet the area requirements. After considerable discussion concerning the alternatives on this matter it was moved by R7r. Hinkle that a letter be sent to the Borough Attorney citin the case in point and asking his advise as to what can be one correct discussion that followed it was suggested that he motion changed to read "ask that the Borough Attorney give the alternatives that are avai to resolve his problem" the motion was so changed with the consent of second. The question was called for and the motion as amended Dassed B. Vacation and Replat, Aleutian Homes Subdivision Sam Graber (Case 258-A), letter read in full. It was no that this has been sent to the Borough Engineer and the the Borough Attorney. The Engineer reviewed the proposed plat and returned same with several changes noted. The changes as noted, as well as an outline of the utility easements, have been forwarded to Mr. Isberg, the engineer for this replat. The Borough Attorney reviewed the request and noted that rather than a retracement as had been submitted originally this would be a vacation and replat. Mr. Graber was in the audience and pointed out that the block area had not been changed, however there were several changes on some of the lot lines. It was pointed out that all people with deeds to the r- property would have to sign the plat and Petition. Mr. Graber did have several of those petitions signed at this time. The Commission requested that all those people that had deposited earnest money should also sign the petition. All individual owners will be shown on the plat. Mr. Graber was requested to furnish the Borough Office with a list of the owners of record as well as those that were in the process of buying the houses on contract. Mr. Holt moved for approval for a public hearing on the Vacation and Repla—tt-o-be-7ZIT-at the IX SUBDIVISIONS, FINAL A. X PLANNING & ZONING CODSFMS A. Mi. Hinkle re Rat Problem: At the last meeting Mr. Hinkle had requested that a check be made to insure that the garbage is being covered over at the dump rather than burned. This has not been done, but a check will be made and reported on at the next regular meeting. r B. Mr. Welch re Zoning Problems. Mr. Welch noted that there is still Lproblem with a shortage of R-2 and R-3 zoning. It was pointed out that previously the Commission had gone on record as being in favor of rezoning the Aleutian Homes Subdivision from the present R-1 to R-3, noting that the area is ideal for dense population and that the community should be looking to the future development in this area ofapartment houses and multiple units. Mr. Graber was in the audience and stated that he was in favor of this course of action, He stated that he would pres nt sucha me request and that at the satime would request the area near the City Hall and Teen Center be rezoned to Business as the lots are level and suitable for business district. xi AUDIENCE COMvM KIBS272731 XII ADJOUFMENT - The meeting was adjourned at 9:30 P.M.
