1973-11-21 Regular MeetingKODIAK ISLAND BOROUGH PLANNING & ZONING NOVEMBER 21, 1973 I CALL TO ORDER The meeting was called to order by Mr. John Welch, Chairman, at 7:35 p.m. in the courtroom of the State Office Building. Ross Wood, Borough Chairman, and also Mr. Dick Sims MINUTES FROM PREVIOUS MEETING MINUTES FROM OTHER MEETINGS A. Assembly - Re ular - November 1, 1973 - There were no comments on the re erenced minutes. COMMUNICATIONS & CORRESPONDENCE A. �. B1K 1, ErsKlne Subdivision - Case 301-A - it was explained that this area was located above the Kodiak Mortuary along Rezanof Drive. This project consists of a total of forty- four units. Mr. Terry believed that we could not give them a variance. Mrs. Holt, Borough Clerk, stated that it could be possible to grant a rear yard requirement variance, but the lot area unit variance could not be granted. She further stated that she believed the area should have 2400 square feet per unit dwelling. Mr. Jones stated that if Brechan/ Iani could not have the 1600 sq. ft., that he felt was required they would probably change their project to an.apartment type complex. Mrs. Gellis felt that there would be a traffic problem. The units will average about 5-8 feet apart. Mr. Holt moved that we aDDrove reauest #1 and denv request B. for Lot 25 U.S.S. 3098 from Unclassified to R-1. Correspondence fr6M Mr. Sims was read to the commission by Mrs. Holt. Mr. Sims stated that the water line will be on an eight inch main, which will hook up from the backside of the lot. He also explained that the City will run the line to the back of the lot and he will take care of the expense of running the line and connecting to the proposed subdivided lots. It was noted that Lot 26, U.S.S. 3098, is zoned R-1. Mr. Sims read the letter from the City Manager concerning the sewer and water hook-up. Mrs. Holt noted that this would change Lot 26 and if the P&Z Committee approve this subdivision; Shockley/Eufemio would have to bring another final plat back to the P&Z Commission with the changes which would involve the road right-of-way. Mrs. Gellis stated that she would like to table until more information is received. Mr. Stover felt that these lots are more feasible for business than R-3. Mr. Holt moved that we table until more information is received. Seconded by Mr. Stover. D. Letter from Felton land. Blk 39. East Add tor or their City sewer project - Mrs. Gellis believed that this area if not kept in by a fence would be dangerous for children. Mr. Hickman, Land Director, stated that we should charge rent for the use of this space; he feels that it should not be a free use but it should bring in some type or revenue. Mr. Terry made a motion that we allow this use for this nroiect oniy. Seconded by Mr. Stover. Mr. Holt feels that the area should be fenced in to keep children out. Question being called for, motion passed by unanimous roll call vote. The commission did express concern tk,,&.t the proper safety precautions be taken and asked Mr. Hickman to make special note of this to the lessee E. Letter from Jake Blanc RE: Reauestinq a subdivision of U.S.S. 5667 - This area is zoned for Conservation and this zoning requires five ar:.res per lot. Mrs. Holt stated that if they approve this preliminary plat that they would also have to change the zoning. P.r. Holt moved for a public hearing on rezoning and arproved tFF� oreliminary subdivision. Seconded Mr. Terry. VI PUBLIC HEARING VII SUBDIVISIONS, PRELIMINARY A. Request for Subdivision of Lot 11, Blk 7, Bells Flats Sub., Case 300-A, William Fearn - Mr. Jones stated that a perculat o1 n test has been done on this lot. Mrs. Holt stated that the subdividers are required to put up a bond to insure that the access road will be put in. Mrs. Gellis stated that we should approve this preliminary subdivision with the stipulation that the subdivider put up a bond for the proposed access road. There was some question on the legality of the access road to the back two lots of the subdivision. Mr. Jones stated that this was a dedicated road and could serve as an access to the two (2) lots. P&Z felt that it could not serve as an access road. They believed that the subdivider has to physically put an access road to connect to all lots. Mr. Terry asked to have a legal interpretation of the law on the subdivision access of lots. Mrs. Gellis made a motion to table the subdivision. Motion died for lack of second. Mr. Jones, Engineer, asked that we approve the first four (4) lots in the proposed subdivision. Mr. Holt moved for approval of the preliminary subdivision only as pertain, to lots 11A, 11B, 11I, and 11H. Seconded by Mr. Terry. Motion Passed by unanimous roll call vote. Bundy - Mr. Jones noted that there is a cemetery on Tract E. that is 120' x 1501, this is to be bounded from the subdivision. Mr. Bundy has plans to sell Tracts A, B, D. and E. He plans to keep Tract C. Mr. Stover moved that we approve this final plat subject to the Engineer's correction. Seconded by Mr. Holt. Mn1-4nn nnmePA by unanimous roll call vote. IX P&Z ITEMS A. Mrs. Holt stated that the Borough Assembly at their last regular meeting asked that P&Z give consideration to an area in the Bells Flats Subdivision, for the possible location of a school. It was noted that Mr. Hickman, who was familiar with this area, could designate some locations and they could look into it. B. Mr. Wood, Borough Chairman, stated that he had appointed Mr. Hickman as an ex-officio member of the Planning & Zoning Commission. He also stated that he could see the necessity of the Borough Assembly and the Planning & Zoning Commission setting up a joint meeting. XI ADJOURNMENT The meeting was adjourned at 9:45 P.M.
