The meeting was called to order by Chairman Tom Hayden at 7:32 p.m. in
the Borough .`.,!eating Room.

COMMUNICATIONS AND CORRESPONDENCE
A. Lot 16A, block 51, East Addition, Group Home Permit for the Kodiak
Baptist :Mission. :air. Childs stated that after operating on a one-year permit
with favorable results it seems that a request for a 2-year permit is in order.
The Department of Health E Social Services issues an annual license for this
operation. Also, as the program warrants, the Baptist Mission will erect
their own building. The Group Home houses children (1) that are delinquent
as adjudicated by the court and (2) children that have problems and in need
of supervision. Favorable reports were made as to conduct and appearance of
the home. The primary requisite for house parents is their interest in taking
care of children. Mr. Brenteson moved to grant a 2-year extension of the
Group Home Permit with the stipulation that at any time there are children in
the building they be supervised by one adult. Seconded by iAr. Heglin. ''lotion

B. Rezoning R-1 to R-2 blocks 45 8 51, East Subdivision, Lots 5 through 15,
Block 1, All of Block 2 and Lots 1, 2, 18 S 19, Leite Addition (Asa Beehler).
iAr. Busch moved to hold a public hearing on this matter. Seconded by •"Ir.

C. Request from City of Kodiak for the Amendment of Kodiak Island gorough
r Zoning Ordinance Creating a 'a: tershed ''District Classification. Mr. Ogg moved
to schedule a public hearing for the request from the City of Kodiak for amend-
ment of the Kodiak Island Borough Zoning Ordinance Creating a 'Jl-±tershed
District Classification. Seconded by i.lr. Erwin. �sIotion passed by unanimous
voice vote.

A. Roger Page (Lot 2, Block 17, New Kodiak Subdivision. Request to expand
rezoning to business to include Lots 23, 24 and 25, Mock 2, Erskine Subdivision,

Lots 8, 9, 10, 10A, 11 and 11B, Block 3, Kodiak Townsite and Lots 1, 2A and 3
Block 17, New Kodiak Subdivision. Chairman Hayden closed the meeting and
opened the public hearing. =.lr. Ken Creamer voiced objection to rezoning this
area to business. Mr. Page stated he recognized the need for the availability
of more business property not only for the present, but alas the future. A
letter from Community Baptist Church was read in favor of rezoning. Letters
from St. Herman's Pastoral School and Holy Resurrection `.?ussian Orthodox
Church opposing rezoning were read. The public hearing was closed by the
Ichairman. Mr. Ogg moved to approve rezoning from R-3 to business Lot 2,
Block 17, New Kodiak Subdivision; also Lots 23, 24 and 25, Block 2, Erskine
Subdivision, Lots 8, 9, 10, 10A, 11 and 11iB, Block 3, Kodiak Townsite and
Lots 1, 2A and 3, Block 17, New Kodiak Subdivision. Mr. Busch seconded.
Motion passed by unanimous roll call vote.
B. Lloyd P. MiicBride (Lot 12A, Block 1, USS 3219, Island Lake Subdivision).
Request for Horne Occupation. Ar. ;vlcBride withdrew his request on October 20,
1976.
VII ZONING ITEMS
A. Request for Variance (should be Rezoning) (Lawrence Jo Shaw) R-3 to
Commercial Lots 18A and 183, Block 1, Townsite Addition. 11r. Busch moved to
hold a public hearing to consider Pfir. Shaw's request to rezone from R-3 to
commercial. Seconded by Mr. Ogg. ftTiotion passed by unanimous voice vote.
B. Extension of Commercial Zoning to Include a Portion of Land Approximately
100,000 sq. feet, Adjacent to Lots 1-A, 2-A, 9, 10, 11, 12, 13 and 14, Block 1,
Allman Addition. Request submitted by Lee Russell. The request was first made
February 4, 1976; a public hearing was held on i1.:Aarch 3, 1976. This matter was
tabled due to comments of the City Manager because of plans for another develop-
ment. The City has now abandoned these plans. Mr. Heglin moved to approve
extension of commercial zoning as submitted by Lee Russell. Seconded by F,lr.
Ogg. Motion passed by unanimous roll call vote:.
Vill SUBDIVISION, PRELIMINARY & FINAL
A. Tideland Tract H-27-A (City of Kodiak). Alr. Erwin moved to approve the
request provided the errors in the legal description are corrected and additional
monuments are set and/or recovered. Seconded by r9r. Brenteson. ,lotion
passed by unanimous roll call vote.
D. Petition for the Vacation of Easement, Island Vista Subdivision Owners and
Residents. It was requested the original letter be available for the next meeting
to help clarify the actual request of the petitioners. Mir. Brenteson moved the
item be rescheduled. Seconded by `&r. Busch. Motion carried by unanimous
voice vote.
C. Preliminary Plat, Russell Estates Townhouse Addition, USS 1396, (Leroy
Russell) . Three variances of existing ordinances to accomplish this project
are reugested: (1) a smaller minimum lot area (20 x 60 feet), (2) minimum lot
Iot width and side yards, and (3) elimination of rear yard requirements. At
8:42 p.m. a ten minute recess was called. Ar. Ogg moved to approve the pre-
liminary plat of Pussell Estates Townhouse Addition, USS 1396 with the stipula-
tion that adjacent property owners have their names on the plat. Seconded by
Ar. Heglin. notion passed by unanimous roll call vote. Mr. Brenteson moved
to grant building setback in recognition that within a block, a group of condomin-
ium dwellings will be treated as a single structure and that setback requirements
will, wherever possible, be met for front and side locations with the exception

the common walls as part of the architectural treatment. A variance for rear
yard requirements is granted where parking and/or townhouse garden loca-
tion enhances the functional design in rear yard areas. However, setback
requirements outlined in Municipal Code 17.18.040 (c) will remain. Seconded
by Mr. Williams. Motion passed by unanimous roll call vote.
D. Request for Subdivision of Tracts M 5 N, Russian Creek Alaska Sub-
division. Due to late submission of this request it was not possible to receive
the comments of R. A. Jones, Consulting Engineer, KEA or Glacier State
Telephone Co. i'dr. Ogg moved to reschedule this request in light of these
facts. Seconded by %Ir. Busch. 1"Aotion carried by unanimous voice vote.
IX SUBDIVISIONS, FINAL
None
X OLD BUSINESS
A. iAr. Ogg stated that two trailers were on the Coons -Boyer property. On
February 2, 1976 a 6-months temporary permit was issued to afford ample time
for removal of one trailer in order to conform with the code. This matter
has been taken care of.
B. On February 2, 1976 it was brought to the attention of the P E Z Com-
mission that Billy Bacus had a building which was placed on the State road
right-of-way. This situation has not been remedied and should be checked
into by the building official and appropriate action taken.
1 PLANNING AND STAFF ITEMS
A. Status of Rock Quarry at Dcadmen's Curve. -Mr. Hayden reports that Mr.
Denslow is checking into this nutter. i<4r. S:3m Cough is checking into the
State's transferal of their jurisdiction so that some other municipality may have
the utilization of that rock quarry. Will have more information at the next
meeting.
B. Status of Rock Quarry Proposed Behind Beaver Lake. An application has
been made by the Borough and City to obtain easements across SLIM land;
these easements have not been granted as yet.
C. i4r. Hayden recommends sending a letter to the City Council, Borough
Assembly and tentative building official to emphasize the urgency in cleaning
up the old wrecked automobiles within the city limits. This should be ex-
tended to the Borough at a later date. The P E Z Commission would like to
impress on the City Council and Borough Assembly that the building official
should have funds made available to him to seek legal counsel to ascertain
how he could go about enforcing the removal of these wrecked automobiles as
well as any other enforcement matWx he might deem necessary.
D. Mr. 14lilliems suggestad that an up to date map for the greater Kodiak
r area including Bells Flats -Russian Creek as approved by the P E Z Com-
mission bL� placed in the Borough meeting room.
E. Mr. 1,11illiarns requested that the future P E Z agendas have a comment
section on the right hand side for the convenience of the commissioners.
