CALL TO ORDER IV The meeting was called to order by Chariman Tom Hayden, at 7: 30 p.m., in the Borough Meeting Room, Borough Building, Kodiak. ROLL CALL PRESENT Tom Hayden Paul Lowe Dan Busch Dan Ogg Bill Williams Harold Heglin ABSENT Don Brenteson There were approximately 24 people in the audience. MINUTES FROM PREVIOUS MEETINGS A. Planning & Zoning Regular Meeting of January 21, 1976. -Ur-. Ogg mnved to accent tha minutas seconded by Mr_ Busch. Motion passed unanimously by roll call vote B. Assembly Regular Minutes of February 5, 1976. OLD BUSINESS A. Whitney-Fidalgo's request for rezoning to allow for construction of a bunkhouse. Lots 7 & 8, Block I, Kodiak Townsite. Mr 0a Mr Rucrh Mntinn I rl unanimously by voice vote. Mr. Lovett stated he hoped he could buy another lot that is presently zoned business and wanted approval from the Commission that they would approve the construction of the bunkhouse before he purchased the property. Mr.Jensen I stated that he thought this would be an acceptable solution as long as it did not affect his house. Mr. Lovett also said that adequate parking would be available in front of the bunkhouse and at Whitney-Fidalgo's plant which is,adjacent. The bunkhouse will be designed for 48 people and not more than 20 feet high. Mr. Lowe move that the Commission will endorse nny hnilNi.rKg'that meets the Rornugh Code__ Reconded by Mr_ Heglin. Mr. Ogg stated that it was a good solution to a bad problem. Discussion was voiced on the request that was submitted and it was agreed that this'new lot 'in question was an entirely different matter and should bq taken up at a later time in the meeting under Planning and Zoning Comments.' Motion passed by a roll call vote with Mr. Lowe casting the no vote. Request from William Fearn & Eugene Pherson to locate a general store on Lot II -A, Bells Flats Alaska Subdivision. Mr. Ogg mentioned that this would be an additional use permit and would require a public hearing. Mr. Busch moved bo have the public hearing at the next scheduled meeting. Seconded by Mr. Ogg. Motion passed unanimousl by a roll call vote. Mr. Fearn commented on the survey he had taken of the surrounding area and had these comments in writting ready to submit to the Commission at this time. It was also noted that no one had objected to this proposal when surveyed. Mr. Lowe moved to schedule a special meeting, two weeks from this date for the purpose of a public hearing, seconded by Mr. Heglin. Motion passed unanimously by a roll call vote. B. Request from Glenn Suydam, for additional use permit for approval to locate a fiber glass boat repair and engine repair business on Lot 2, Block 4, Miller Point Subdivision, Ist Addition. Mr. Ogg moved to schedule this for a public hearing at the special meeting on March 3rd. Seconded by Mr. Busch. Motion passed unanimously by a roll call vote. C. Lee Russell request for extention of boundaries R-2 and R-3 to encompass Russell Estates U.S.S. 1396. Mr. Russell was instructed to resubmitt his request at the March 3rd meeting with additional information from the adjoining property owners. D. Lee Russell's request for extention of boundaries of commercial zoning to include a portion of unclassified land adjacent to lots �..+ I -A, 2-A, 9, 10, II, 12, 13, 14, Block I, Allman Addition. Mr. Lowe moved that this matter go for public hearing at the special meetim seconded by Mr. Heglin. Motion passed unanimously by a roll call vote. E. Tidelands Lease Application, Kodiak Lumber Mills, Discoverer Bay, Afognak Island. Mr. Ogg expressed concern in regard to pedestrian right of way by the beach. The commission felt non -objection as long as there was adequate access provided on the upland portion. Mr. Heglin moved to accept this proposal seconded by Mr. Busch. Motion passed unanimously by a roll call vote. F'. Ldher from Mr. & Mrs. Coons and Mr. & Mrs. Boyer in regard to the problem on their property with an excess number of trailers. Mr. �i;n oui moved to grant a temporary permit until September Ist, 1976 which wld allow ample time for the removal of one of these trailers, Seconded by Mr.BuAltj It was noted that if this problem was not resolved by September Ist, 1976, that this matter would go to the Borough Assembly for approval to take legal action. G. Letter from Ted Gerkin was read into the minutes regarding the r— city's policy on additional hookups to new subdivisions. Mr. Ogg requested that a letter be sent again to the city asking specifically what is going to be their policy on additional hookups. H. Request from Toni Burton for additional use permit in regard to Kodiak Livestock Corp. Mr. Busch moved to grant a temporary permit until September.1st thus aiLowing enough time to find other means of disposing of their wastes from the Corn Seconded by Mr Dgg. Motion passed unanimously by a roll call ..ate VI. PRELIMINARY PLAT KIBS272906 A. Ray Tuft, Lot 4, Block 3, Miller Point Alaska Subdivision. PLANNING & ZONING MEETING OF FEBRUARY 18, 1976 page 3 Mr. Ogg read from the Code, 16. 16.101 . Mr Lowe moved to accept preliminary sketch and when the final is ready to be submitted that all requirements be met on that final. Seconded by Mr. Williams. B. R.A. Jones, U.S.S. 1396 and a portion of "G". Mr_Og9 moved to accept 1396 and a portion of "G", seconded by Mr. Heglin. h., a nrianimnuc roll call vote. C. George Magneson, Lot 2 & 3, Mission Subdivision, U.S.S. 2843. Mr. Healin moved to approve with the stipulation that the easement on the tinai plat on-r+. sec v a unanimous roll call vote. VII. FINAL SUBDIVISION A. L. Russell Mountain View Subdivision, U.S.S. 1678. Mr. Hee lin moved to accept Mountain View Subdivision, U.S.S. 1678 ,{keconcled by Mr. Ogg. Motion passed by unanimous by a roll call vote. B. Beachcombers, Vacation & replat, U.S.S. 3066-A, Lots 3 & 4 of Block 2 and a portion of Lot 4, Block I. Mr. Ogg moved to accept the vacation and replat of the Beachcombers seconded by Mr. Busch. Motion Dassed by a unanimous roll call vote. _ C. Mike Shockley, Lot 24, U.S.S. 3098. Mr. Lowe read from the Code, 16.20.050 and 16.24.020 with regard to drainage. Mr. Lowe stated that he felt the Commission had a role to uphold and that r.. adequate drainage should be on these lots. Mr. Shockley stated he was infact planning to channel and fill on the two back lots thus to elevate the problem of drainage. He also stated that a topography study had been made by Mr. Ecklund and the surveyor had told him that if the channeling and fill were done this would be a buildable site. Mr. Heglin moved to accept the final plat. Seconded by Mr. Busch. Mr. Lowe questioned if the plat met all the requirements as specified previously. It was established that it did. Motion passed 5 I with Mr Lowe casting the Inn vote. D. L. Russell, U.S.S. 1678, First Addition. Mr. Lowe moved to defer final review subject to the easement of tract L & M being _gn the revision of the Ip at on the March 3rd. meeting�SarnndPd by Mr. Healin Motion passed 5-' with Mr. Ogg obstainina because of conflict of interest. E. Russell Estates second addition. U.S.S. 1396. Mr cR moved to accept the final plat seconded by Mr. Heglin. Motion .passedd uy unanimous roll call vote. Vill. AUDIENCE COMMENTS Lou Schneider said that the Commission should take a hard look at the r" Miller Point, Monaska Road right of way. He suggested that road right of way excavation should be stopped, due to future complications that could arise when this fill might be required to be put back. Reed Oswald 5 yr. temporary Iccat!on for a say: ,mill. Letter from the city was read voicing objection. The Commission recommended tha: this matter be sent to the Borough Assembly. B. Fred Ogden, Jr. & Sr. Violation to Building Inspectors notices of stop work order. A letter was noted from George Vogt the Ogden's Attorney. Mr. Ogg moved to decry the appeal from the Ogden's attorney acid recommend this matter go to the Borough Assembly for their approval, to initiate legal proceedings, specifically the additional use, trano perml} sewage, & lot size. Seconded by Mr. Lowe. Motion passed by unarithloud roll call vote. C. The Commission feit the subject on bike trails could be scheduled fbr a work session. D. Mr. Ogg voiced concern over the section of Mission Road that he felt had inadequate pedistrian right of way and poor lighting. He asked That a letter go to the City notifying them of this ,:rnmi diate..znd ssential n:ed. E. Mr. Ogg had a few ordinance charoes that he read to the Comeriisslon, 6,jt it was felt that perhaps these could wait for the work session. However, he did request a ctianye in setback requirements in unclassified zones to be the same as in other residential areas, 25 feet, F. Mr. Lowe made a comment that if the Commission were to enforce the two week time limit requirement on all plats being submitted before the next meeting that perhaps this wouldl speed up the process of both the engineer being able to make corrections and reviews plus save the subdivider time that could be lost due to technecalities.
