CALL TO ORDER The meeting was called to cyder at 7:35 p.m, by Chairman Tom Hayden, in the Borough Meeting Room, Borough Building, Kodiak. II . ROLL CALL y., PRESENT r;:m Hayden ' Paul Lowe Dan Busch, Donald Brentesen Dan Ogg Bill Williams Harold Heg!in There were approximately 43 people in the audience. III. MINUTES FROM PREVIOUS MEETINGS A. Planning and Zoning Regular Meeting of December 17, 1975: Mr. Brenteson moved to accept the minutes of the Drevious meetini B. Assembly Regular Minutes of January 14, 1976. Mr. Lowe commented that he hoped the Commission would not take the position of approving any illegal a ts. IV. PUBLIC HEARINGS r� A. Tory/ Perez- Proposed ?-railer Court. Considerable objection was voiced by members from the audience including Jerry Holt, Rud Wasson, Knox Christie, Dorothy Ho!ms, ect. Mr,, & Mrs.. John Randolph, objecting, pre- sented a telegram from Robert C. Flint, Environmental Protection Agency, (EPA), stating that EPA was aware of Mr. Powell's outflow, and that this was a Federal perrnit honored by the State, however, any additional hanku?s t,culd result in State action against such additional usage. Members from the audience asked whether or not unclassified zoning allows for trailer park growth. Mr. Ogg read from the Code stating that this would be an allowable additional use. The reasons for objection to Mr. Perez's plan were similiar, most being (a) Mr. Perez has not demonstrated in the past his ability to prevent the accumulation of materials on his land, (b) parking space thought to be inadequate, sewer hookup permit requirements were not met. After considerable discussion the public hearing r.,as closed. Mr. Lowe moved to deny the request. Seconded by Mr. Busch. Mr. Hayden said that Bureau of Land Management has an easement on the road right of way, thus the commission is not able to grant a vacation of this easement because it was not within their jurisdiction. Question called. Passed by unanimous roll call vote. B. T.T. Jackson -request for Trailer Park Expansion on U.S.S-:3099, Lot 27. Mr. Oaq moved tq accept T.T. Jackson's proposed plans. Seconded by Mr. Lowe. The regular meeting was closed and the public hearing opened. Mr. Jackson was asked to comment on his plans. Questions were asked regarding parking, snow removal and sewage hookups outside the city. Mr. Jackson stated he was not prepared to answer these questions not knowing that the Cos^„.ission required all this information at a public hearing. Mr. Jackson noted the plans had been prepared by'R.-A. Jones in ;accordance with L'or u_:jn -de and did meet minimum requirements. PRELIMINARY PLATS A. Russell Estates Subdivision. Will gariss pointed out that one block in the subdivision does not meet Borough Code requirements in that it exceeds the allowable length. The engineers comments were noted and Mr. Russell indicated that if the one street had to be extended it would result in the deletion of the park area. As far as the length of Block 4, the area is very steep and problems would be created with a through street. It was noted that under certain conditions this requirement could be waived with the provision that a walkway be dedicated. Other requirements were noted as being required for preliminary plat. Mr. Brenteson moved to accept the preliminary plan with stipulation that the proper block length be replaced with necessary items of the Borough Code and that all the preliminary requirements be on the final plat seconded by Mr. Heglin. Motion passed by unanimous roll call vote. B. Mountain View Subdivision, Lee Russell. Mr. Lowe stated that he felt Planning and Zoning should stand by their code, setting policy of not considering preliminary plats until all requirements are met. Mr. He lin moved to accept the preliminary plat providing that park tests are to be done before recording and all requirements must be met on final Motion passed 6 to 0 with Mr. Ogg abstaining because of confli, of interest, on the roll call vote. Mr. Rasmussen commended the Commission for their intention to stick., to the Code. He asked, "Why hash over problems for a half an hour and then pass it onto the city." Mr. Williams commented the commission should know where they stand legally. Rasmussen, asked if his property was affected by the City's denial of hookups outside the city, replied yea, The city had denied him access to the main while permitting it elsewhere. Mr. Hayden stated that in a recent work session with the city, city representatives stated additional hookups cause a strain on city :1:2511 flow.
