I CALL TO ORDER
The meeting was called to order by Chairman John Wblch at 8:05 P.M. in the Courtroom
of the State Office Building, Kodiak, Alaska.

V COMMUNICATIONS AND
A. Exception to Lot Size for Two Dwellings, Unclassified Zoning. Mr. Walker noted
the receipt of a verbal request from a couple desiring to purchase a lot in the
I Miller Point area. The couple recently purchased a trailer and are in the process
of purchasing the land on which the trailer is located; however this purchase will
hinge on whether or not a second trailer can be placed on the lot. The previous
owners of the trailer had arrangements with Naughton's for use of the water and
sewer system; however with the ch«nge in ownership a new well and sceptic system
will have to be constructed. The new owners would like to be able to place another
trailer on the lot to help defray the cost of new well and sewer system construction.
The lot area is a little over an acre as the new highway took a small portion of a
that lot. The lot requirement for Unclassified Zoning is 40,000 square feet per
single family dwelling. The Borough Attorney was contacted and recomended that
this exception not be considered as there are problems with the sceptic tanks in
that area, and the well might be polluted. It was thought that the sanitarian had
indicated that if the well is no nearer than 100 feet to the sceptic tank there would
be no problems. Pam. Holt moved to deny the request, motion died for lack of a second
It was suggested that the Sanitarian be contacted to determine if there is enough
space for such occupation; however the Attorney has said there is nothing in the
code to give the authority to grant this exception. During the discussion it was
pointed out that should consideration be given to rezoning and changing the lot
requirements in some of the unclassified areas, recommendations should be received
from the Sanitarian and Borough Engineer in this matter. Mr. Holt moved for denial
of the request, seconded by Mr. Wheeler, motion passed by unanimous roll call vote.
Mr. Walker noted that this is the second such request that had been received in the
borough offices, for exception to allow second trailer occupancy on smaller lot in
antmclassified zoning.
VI PUBLIC HEARINGS KIBS272713
A. Vacation Request - Block 47 East Addition Wri t & Arndt. Requested in order
to have lots that will meet the zo i requirements of 200 square feet in R-1 zone.
Mr. Edris moved to approve the vacation and replat of Block 47, East Addition,
seconded by Mr. Holt. The regular meeting was recessed and public hearing opened.
No one was present requesting to be heard on this vacation, the public hearing was
closed and the regular meeting reconvened. The question was called for and the
motion passed by unanimous roll call vote.

B. Vacation Request - Dennis Cessna, Block 51, Lots 16, 11, 18, read by the Borough
Clerk .noting that this was being requested in order to sell a single family dwelling
located on two of the lots. This vacation and replat will establish lots 16A & 18A.
Mr. Holt moved for aunroval of the vacation and replat of Lots 16, 17, 18, Block 51,
hearing was opened. There being no comments from the audience, the public hearing
was closed and the regular meeting reconvened. The question was called for and
motion passed by unanimous roll call vote.
C. Vacation Request and Replat of Lots 33 and 34 Airpark Subdivision, Block 1 -
read by the Borough Clerk and preliminary map studied. lcr. Wheeler moved for
approval of the vacation and replat request on Lots 33 and 3 , Airpark Subdivision
One individual in the audience was interested in the lot next to those being replatted
and questioned if that lot was to be subdivided. It was noted that this was not the
case. There being no other questions or comments, the public hearing was closed
and the regular meeting reconvened. It was noted that the replat does meet the
zoning requirements for lot area. The question was called for and the motion passed
by unanimous roll call vote.
D. Variance Set -Back Request, Block 55, Lot 4, William Russell, an additional letter
submitted by Mr. Russell was read by the Borough Clerk setting forth various points.
The points noted that the exceptional physical conditions make it necessary to
request variance as the site is on a steep slope; the amount of fill necessary
would make it very expensive and unsightly,; there would be no damage to the area
with the granting of the request, however, if not granted it would mean the cutting
of several trees which are desirable for the whole neighborhood. The Borough Clerk
noted that one comment had been received from Mr. Eggemeyer, owner of the next lot,
who voiced the opinion that the variance should not be granted. Mr. Holt moved to
approve the Variance Set -back, seconded by Mr. Edris. The regular meeting was
recessed and the public hearing opened. Mrs. Russell was in the audience and noted
that for the information of the commission Mr. Russell had taken a can of spray
r paint and drawn out the location of the proposed garage. She further rated that
I they hoped to extend the deck from the house and attach to the garage and therefore
the garage would not be out at too much of an aggle. The garage will have the same
design as the house and will have the same siding and color so that it will be
correlated. Roy Ecklund was in the audience and did state that the slope was about
2-1 ratio: Any other fill would result in the loss of the trees on the slope. The
garage will be :fofir feet:from the property line, the house now sits ten feet from
the property line; there •is-,t1drrty-three feet from the lot line to the end of the
pavement. There is room for turning radius from pavement to the garage door.
The public hearing was closed and the regular meeting reconvened. The question was
called for and roll call vote as follows: TL-. Wheeler -YES; Mr. Edris - NO;
Mr. Holt -YES; Pam. Welch - YES. Motion passed.
VII ZONING ITEMS
A. Letter Rezoning Request- Lot 12, Block 54, East Addition. It was noted that
this is in the same area that a proposed zoning change is being considered. The lette
for rezoning was read, stating that there is no demand for a house of this size in
Kodiak and that in order for an individual to purchase it would be necessary for a
rental to be placed in the basement. The minutes of the Borough,Assembly'spublic

be tabled until the Commission had had a chance to have a work session on the proposef.
rezoning. Mrs. Lechner was in the audience and asked if representatives of the
area could attend the work session, the Commission indicated that this would be
welcomed. It was further suggested that those individuals that desired such changes
in the zoning should also attend in order that both sides could be heard. The work
session was set for Wednesday, June 30th, at 7:30 P.M. It was requested that the
number of R-2 lots with City Water available as compared with R-1 lots (both vacant)
be obtained for the information of the Commission.
Mrs. Lechner asked about the requirement for two family dwelling, lot size. The
Clerk not-dd that it would required 7200 square feet to build a two family dwelling.
Some of the lots in East Addition are smaller and would have grandfather rights
for building of single family dwelling. The Commission members were in agreement
that a letter should be directed to Shelley Graybill, representative of Mr. Moore,
stating that the rezoning of the entire area was under consideration and results
would be forwarded.

A. Variance Request - Cessna, Lot 1, Block 2, Allman. Several members of the
Commission had
received letters asking for a variance set -back on the side lot
and and exception to the lot area for a 4-plex. It was noted however, that the
request for such had not been submitted to the Borough Office. Further in checking
the zoning, the area is zoned R-1 and not for multiple dwellings. The commission
asked that a check be made concerning the building permit for the construction.
No action was taken due to the fact that the request was not submitted to the
Borough Office.
B. Borrow Site Leases - The Borough Clerk stated that Mr. Large had requested
a more tangible type lease. The area had previously been eet aside for borrow site
however, Mr. Large's lease does not encompass a large area and with the restrictions
of not being able to dig closer than thirty feet to the road, Mr. Large cannot use
this area for aggregate. The Clerk recommended that the Commission withdraw this
land from the Borrow Site Lease and allow Mr. Large to apply for an industrial type
lease. Mr. Edris moved to eliminate this area from the Borrow site and do as

A. Mr. Breckberg re Vacation of Street, Leite Addn. It was again noted that the
final plat has not been submitted for consideration although contact was made with
the engineer in Anchorage. The duplicate original has been received in the Borough
Office and work can now be done on the final plat. This should be ready for the
next meeting.
