II ROLL CALL Present Absent Carl Kuer, Chairman John welch Charles Edris Eugene Erwin Coleman Constance Also present: Mr. Eugene; Brassie, Mr. Royal large, and Robert E. Ntr. 6lelch moved for approval of the minutes seconded by Mr. Constance and the motion passed by unanimous roll call vote. IV MINUTES OF MIER MEETINGS A. Assembly - regular meeting - July 2, 1970 - There were no cenTmnts B. Ass y - regular meeting - August 6, 970 - Reviewed and no c�n¢nents were _ made. C. Assembly - Special Meeting - August 21, 1970 - There were no comments. r V C(MiUNICATIONS AND CORRESPONDENCE - NONE VI PUBLIC HEARING A. Public Hearing - Vacation and Replat of Lot 1, Block 2, Shahafka Acres - ouutaty to.waa, aucc+. �..aac cr va, au. is - '^YYi of Lot 1, Block 2, Si ahaf-- Acres, seconded by Mr. Welch. The regular meet was closed and the public hearing opened. There being no comments from the public, the public hearing was closed and the regular meeting re -opened. It was noted that the Borough Sanitarian and the Borough Engineer had re- viewed this subdivision and recommended approval. I;r. Edris called for the question and the motion passed by unanimous roll call vote. VII ZONING IMIS A. Request for Set -Back Exception, Lots 113 and 114, Block 9 of USS No. 444. Mr. Wallace appeared and requested that an exception to the set -back re - requirements be granted for Lots 113 and 114, Block 9, USS 444, with the total amounting to less than two (2) feet of the required twenty-five feet. A After a review of the plat, with it being noted that the house was built some time ago, Mr. Edris moved to grant the set -back exception request, seconded by Mr. THelch. The motion passed by unanimous roll call vote. r VIII SUBDIVISION, PREMIi ARY REVIEId A. James Pearson - USS 3218, Tracts E-2 and E-1 (Case 231-A) It was noted that the Borough Engineer and the Sanitarian had reviewed the requested prelmminay and had stated their approval. ilr. Edris moved to approve the preliminary plat of Subdivision of USS 3218, Tract E, seconded by Mr. Welch. Motion passed by unanimous roll call vote. Ix SUBDIVISION KIBS272690 A. James Pearson - USS 3218, Tracts E-1 and E-2 (Case 231-A) - It was noted that the Final Plat will be the same as the preliminary. Mr. Edris moved for approval of the Final Plat of the subdivision, seconded by B4r. P?elch. Bells Flat's Residents - Several members of the audience were in in attendance to speak on behalf of the Bells Flat's land sale. Mr. Large stated that he had leased land that he wanted to buy from the Borough. He also stated that he had, in the past, considerable damage fray. vandalism. Mr. Large presented a copy of Chapter 58 of the 1965 Session Laws relating to perference rights to each of the Co-ftission members, and requested that a Borough ordinance be adopted along the lines of this Act. Mr. Brassie stated that possibly there unuld be very few native claims allowed within the Bells Flats area. Mr. Brassie made several other additional recomnendatic and requested that the Planning & Zoning Commission and the Borough Assembly give consideration to his recommended changes in the Borough Land Disposal Ordinance.
