CALL TO ORDER The Regular Meeting of the Planning and Zoning Commission was called to order at 7:40 p.m. by Chairman Steve Rennell on March 19, 1986 in the Borough Assembly Chambers. II. MINUTES OF PREVIOUS MEETING COMMISSIONER JAMES MOVED TO ACCEPT the minutes of the February 19, 1986 Planning and Zoning Commission regular meeting as presented. The motion was seconded and CARRIED by unanimous voice vote. V. APPEARANCE REQUESTS AND AUDIENCE COMMENTS Appearance Requests: A) CASE 83-135. Request for a one-year extension for a previously approved variance that permitted a detached garage to encroach into the side yard setback in a R2--Two-Family Residential District. Lot 9, Block 33, East Addition; 716 Mission Road. (William Bacus) BOB PEDERSON indicated that a vicinity map had been included in the "additional handouts" and that staff recommended approval of this request. COMMISSIONER KNUDSEN MOVED TO GRANT A REQUEST FOR A ONE-YEAR EXTENSION for a previously approved variance (Case 83-135) to permit a detached garage to encroach into the required side yard setback in a R2--Two-Family Residential District on Lot 9, Block 33, East Addition and to adopt the finding contained in the staff report dated November 16, 1983 as "Finding of Fact" for this case. COMMISSIONER ANDERSON MOVED TO GRANT A REQUEST FOR A ONE-YEAR EXTENSION for a previously approved variance (Case 84-107) to permit a 6-foot by 10-foot arctic entry/mud room addition to encroach 6-feet into the required 16-foot front yard setback in the Rl--Single-Family Residential District on Lot 9, Block 9, Aleutian Homes Subdivision and to adopt the findings contained in the staff report dated September 11, 1984 as "Findings of Fact" for this case. The motion was seconded and CARRIED by unanimous roll call vote. FINDINGS OF FACT: 1. Exceptional physical circumstances or conditions applicable generally do not apply to other properties in the same land use district. The original design of Aleutian Homes did not incorporate front entryways into the structures. In order to build an entryway that does not encroach into the front yard setback, prevent weather and mud from directly entering the living room and make the home somewhat more energy efficient, the house would have to be moved back six feet. r 2. Strict application of the zoning ordinances would result in practical difficulties or unnecessary hardships. 3. Strict application of the zoning ordinance would not allow any construction in front of the house. Many homes in this subdivision have enclosed front entryways. or prejudice to other properties in the vicinity nor mental to the public's health. safetv and welfare. No prejudice or material damage to other properties will occur. The arctic entry design may enhance the neighborhood by adding structural variety to the front of this house. 4. C) CASE S-85-004. Request for extension of the preliminary plat approval period for the subdivision of Lot 6, Brookers Lagoon r Subdivision, U.S. Survey 5701. (Omar Stratman) COMMISSIONER RENNELL indicated that Omar Stratman could not attend the meeting and had asked that his desire that the Commission look favorably upon this request be noted. COMMISSIONER JAMES MOVED TO GRANT A TWELVE-MONTH EXTENSION of the preliminary plat approval period for the subdivision of Lot 6, Brookers Lagoon Subdivision, U.S. Survey 5701 per the memorandum from the Borough Engineer dated March 11, 1986. The motion was seconded and CARRIED by unanimous roll call vote. KIBS225931 P & Z REGULAR MEETING 2 MARCH 19, 1986 MINUTES D) CASE S-83-014. Request for the third extension of the preliminary plat approval period, Cape Chiniak Subdivision. (Koniag, Inc.) ROBIN HEINRICHS asked Dave Crowe if this subdivision met the current requirements of the subdivision code. Mr. Crowe answered "yes." COMMISSIONER ANDERSON MOVED TO GRANT AN ADDITIONAL ONE-YEAR EXTENSION of the preliminary plat approval period, Cape Chiniak Subdivision per the memorandum from the Borough Engineer dated March 10, 1986. The motion was seconded and CARRIED by unanimous roll call vote. There were no further appearance requests or audience comments. VI. PUBLIC HEARINGS A) CASE 86-007. Request for a variance from Section 17.36.070 (General Provisions) of the Borough Code to permit the expansion of the cubical content of an existing nonconforming single-family residence in order to construct a 10-foot by 12-foot addition onto the rear of the existing structure in a R1--Single-Family Residential District. Lot 13, Block 6, Aleutian Homes Subdivision; 616 Thorsheim Street. (Stanley Kaneshiro) BOB PEDERSON indicated 77 public hearing notices were mailed for this case and 1 was returned stating non -objection to this request. Staff recommended approval of this request. Exceptional physical circumstances or conditions applicable to the property or intended use of development, which generally do not apply to other properties in the same land use district. In this case the unique physical condition is the existing nonconforming structure located on the lot. Any expansion of this structure will require a variance. 2. Strict application of the zoning ordinances would result in practical difficulties or unnecessary hardships. The strict application of the zoning ordinance would not allow any additions to the existing structure. This is a practical difficulty and unnecessary hardship when the encroachment is only 1.1-feet and the addition will comply with all current setback requirements. 3. The granting of the variance will not result in material damages or prejudice to other properties in the vicinity nor be detrimental to the Dublic's health, safetv and welfare. Lot 1, Block 3, Leite Addition; 1610 Ismailov Street (Eric and Marion Stirrup) BOB PEDERSON indicated 40 public hearing notices were mailed for this case and 2 were returned in favor of this request, 1 of which stated opposition to any human traffic across her property. Request for Planning and Zoning Commission review of the disposal of Borough property in accordance with Section 18.20.030 of the Borough Code. KIBS225936 A discussion ensued amongst the Commissioners, Engineering Department staff, Community Development Department staff and Bud Cassidy, Resource Management Officer concerning the rationale for disposing Borough lands, the need to reserve adequate lands for parks and public services such as a sanitary landfill and a fire hall and the status of a comprehensive plan for the Chiniak Community. The motion was seconded and CARRIED by unanimous roll call vote. F) CASE 86-019. Shuyak Island Comprehensive Plan. (Community Development Department) BUD CASSIDY presented a slide show and discussed the development of the draft Shuyak Island Comprehensive Plan. The process involved defining "why a Shuyak Island Comprehensive plan," the purpose of the plan, how the plan was put together, general recommendations and recommendations specific to Borough -owned lands. A discussion ensued between Bud Cassidy and Dave Herrnstein. Mr. Herrnstein indicated that he liked a lot of things about the plan but he disagrees that the Borough should encourage development in the Port Williams/Shuyak Straits areas. Bud Cassidy noted that P & Z REGULAR MEETING 7 MARCH 19, 1986 MINUTES this was a draft plan for public comment, that the plan needs more work and more public comment before the Planning and Zoning Commission, that the Assembly had asked for something concrete at their April meeting and that this was why the plan was before the Planning and Zoning Commission at this time. Public Hearing Opened: r-' ROGER FLANDERS appeared before the Commission and expressed some of his concerns regarding the present draft of the Shuyak Island Comprehensive Plan. Mr. Flanders indicated opposition to the development of the Nikita Bay/Big Bay areas and that land trades and cooperative agreements with the State of Alaska ought to be pursued to protect the "true wilderness values" of Shuyak. DAVE HERRNSTEIN appeared before the Commission, expressed his support of Mr. Flanders' statements and requested that his earlier comments be taken as part of the public hearing on this item. The Commission agreed to Mr. Herrnstein's request that his earlier comments be a part of the public hearing. Public Hearing Closed. Regular Session Opened. Request for a variance from Kodiak Island Borough Code Section 16.20.050(C) to permit platting of a lot with a width less than that required by Zoning Regulations and vacation of Lot 3C and a Portion of Lot 3, Block 3, Leite Addition and Lots 11 and 15, Urdahl Subdivision and replat to Lots 3C-1 and 3E, Block 3, Leite Addition.
